This Wetlands Permit # 25 has been granted by the Southold
Town Board according to information furnished in Application # 37
filed by Applicant W. S. Gardner
on March 2 19 79 A map of the proposed work will
be kept on file in the Town Clerk's Office under the application
number given.

The validity of this permit is or may be subject to the' approval of
other governmental or municipal authorities. The Town accepts no
responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit
shall not commence operations hereunder until such approval has been
obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the
Town Clerk upon receipt by the Town Clerk of written notice from such
other governmental or municipal authorities of its refusal or disapproval
The applicant does by the acceptance of this permit, assume all
responsibility for operations undertaken pursuant to this permit,
and shall take all precautions for the prevention of injuries to
persons and property resulting from such operations. By such _ -
acceptance, the applicant also agrees to indemnify and save hatm-
less the Town, and its officers, agents and employees from any and- -
all claims arising from operations under this permit and any and
all acts or omissions of applicant, his agent and employees.
The applicant and the owner- and occupants of the premises upon which
the operations authorized by this permit are being conducted, do,
by the acceptance of this permit, give consent to the Town, and its
officers and employees to enter upon the premises where such' opera-
tions are being conducted to make such inspections as the Town may
deem necessary to insure that such operations are being conducted
in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion intothe fresh water resources
of the town.
D_ Adversely affect fish, shellfish or other beneficial marine
organisms, aquatic wildlife and vegetation or the natural
habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal
flow of the tidal waters of the town .
G. Change the course of any channel or the natural movement
or flow of any waters_
H. Weaken or undermine the lateral support of other lands in
the vicinity.
I. Otherwise adversely affect the health, safety and general
welfare of the people of the town.

FOR A WETLAND PERMIT
A public hearing was held by the Southold Town Board at the Southold Town
Hall, Main Road, Southold, New York 11971, at 3:42 P.M. on Tuesday, April 10,
1979 in the matter of the application of W.S. Gardner, Vanston Road, Cutchogue,
New York, for a permit under the provisions of the Wetland Ordinance of the Town
of Southold for permission to construct 104 feet of bulkheading and dredge approxi-
mately 200 cubic yards and place behind proposed bulkhead and proposed retaining
wall on his property on Vanston Road, Cutchogue, New York.

NOTICE IS HEREBY GIVEN that a public hearing will be held by
the Town Board of the Town of Southold at the Southold Town Hall,
Main Road, Southold, New York, at 3:40 P.M., April 10, 1979 in
the matter of the application of W.S. Gardner, Vanston Road, Cut-
chogue, New York, for a permit under the provisions of the Wetland
Ordinance of the Town of Southold for permission to construct 104
ft. of bulkheading and dredge approximately 200 cu. yds. and place

Re: W.S. Gardner Application
JUSTICE SUTER (continued): I have an affidavit of publication from the
Suffolk Weekly Times, and an affidavit of publication from the Long Island
Traveler-Watchman, an affidavit from Judith T. Terry, Town Clerk, that it was
posted on the Town Clerk's Bulletin Board, Town Clerk's Office, Main Road,
Southold, New York. I have a letter to the Southold Town Board:
.. .Gentlemen: The Board of Town Trustees took the following action
at a regular meeting held March 6, 1979: RESOLVED to recommend to
the Southold Town Board approval of Wetland Application #37 of Wil-
liam S. Gardner to dredge approximately 20 by 30 feet on private
property of the applicant with the condition that the spoil wings be
moved above highwater mark so as not to disturb the 12 feet of marsh
on the north and south sides of the boat slip. Signed Philip G.

Also, a form, of the application of W.S. Gardner, from the Southold Town
Conservation Advisory Council.. .conditions, if any, would like to recommend
an amended application for overhead catwalk and floating dock. This would
minimize wetland destruction and necessary dredging. Signed by Frank
Kujawski, Jr. , Southold Town Conservation Advisory Council.
SUPERVISOR MARTOCCHIA: You have heard the reading of the application
of W.S. Gardner, application #37, for a wetland permit; that it has been
legally advertised in the local papers, The Suffolk Weekly Times and the
Long Island Traveler Watchman. Also that it was posted on the Town Clerk's
Bulletin Board, heard the comments of the Southold Town Trustees that they
approve it with conditions that were read previously, and from the Southold
Town Conservation Advisory Council approval with conditions minimizing
destruction. Is the applicant here; Mr. Gardner?
MR. GARDNER: I have nothing to say except to answer any questions.
SUPERVISOR MARTOCCHIA: The hearing is open to the audience for discussion.
PAUL STOUTENBURGH: I believe that was amended, the resolution from the
Trustees that it would not grant it or allow it. I believe the wings on the
side were taken off of this application, you will see the drawing there.
JUSTICE SUTER: Yes, that the spoil wings be moved above highwater mark.
MR. STOUTENBURGH: Therefore, there would not be that 100 and some feet
of-.
JUSTICE SUTER: They just say, "be moved above highwater mark so as not
to disturb the 12 feet of marsh on the north and south sides of the boat slip."
FRANK KUJAWSKI, JR. : Also, I think our report read "disapproved."
With the amendments for overhead catwalk and floating dock.
SUPERVISOR MARTOCCHIA: That's what was suggested.
JUSTICE SUTER: There is checked off "disapproval" and then you specified

JUSTICE SUTER (continued) : conditions underneath it.
SUPERVISOR MARTOCCHIA: The Counservation Council did disapprove it as
submitted but did offer a suggestion of how they would like to see it.
MR. TASKER: I presume that the application was really to dredge and to
bulkhead, and the Counservation Advisory Council disapproved that and it is
suggested that that be an overhead ramp and a floating dock, which is entirely
different than what was applied for. So I would imagine that, if you were
going to abide by the Conservation Advisory Council that you would have to
disapprove the application and ask for a new application.
SUPERVISOR MARTOCCHIA: That's why we have referred it to you because-.
You disapproved the application as submitted and added comments as to how
you would like to see it. It's different than what was applied for.
MR. STOUTENBURGH: The vote was four in favor and one was against the
application - the Town Trustees.
JUSTICE SUTER: The Conservation Council has a vote here - five no,
zero yes.
SUPERVISOR MARTOCCHIA: Well, based on what we have just heard with the
Conservation Council, their recommendation is that we disapprove it and
they offerred 'a counter suggestion in one way more palatable to the owner
but that ,would have to be in the form of another application.
MR. TASKER: Either that or at least another hearing, I think. What we
did, we noticed the hearing for dredging and bulkheading, isn't that correct?
Not an application for a dock.
JUSTICE SUTER: "Construct 104 feet of bulkheading and dredge approximately
200 cubic yards."
MR. KUJAWSKI: I think our group realized it would be a problem and that's
why the comment was made. It is a narrow channel, and an overhead walk with
a floating bulkhead would propose a navigation problem; and I think we were
aware of this when we were looking. We also noticed though that rather than
to dredge, I forget the distance back, that a minimum amount of dredging could
be done, instead of going all the way back. We still could have some sort of
a compromise here with a small amount of dredging back to get out of the way
of the channel, and this way it would really minimize the amount of wetlands
removed. It still requires some dredging and bulkheading; I believe the float-
ing dock would be on the west, but would probably have to do under three appli-
cations if they were intended to go that route.
MR. GARDNER: It started four years ago, this thing. I tried to get a
floating dock out there; my neighbors objected to it, narrow channel. So I
went to the Department of Engineers with a floating dock and they turned me
down. I even tried to cut back - I went the whole way, to cut back into my

MR. GARDNER (continued) : own property. Got the proper permission from -the
D.E.C. Now the Trustees. I've been glad to put a floating dock in there. -It-
would cost me alot less money. But I'm not going to go through four more years
of this, I'm not going to live that long.
SUPERVISOR MARTOCCHIA: Is there anyone else wishing to speak on this
application? For? Against?
(There was no response.)
SUPERVISOR MARTOCCHIA: Hearing none, the hearing is closed and the Board
will make a decision at the proper time. Thank you all. We will keep Mr.
Gardner informed.
The hearing was declared closed at 3:55 P.M.

Dear Ms. Terry:
I receiveda.letter from the Board of Town Trustees
requesting that I fill in a wetlands permit
application and return it to�, you. I enclose the
completed form and my check for $25.
The form contained questions which I was not sure
how to answer but I believe the measured drawing
which is attached will explain the project. Actually,
instead of reducing the amount of wetlands I am
increasing them by about 600 square feet by
turning my above tide private property into _-
below water property.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by'typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of"the Pilot Plan may be made by a copy machine and attached
to the Permit Application.')
C. - Ivo operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revolted or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request 710 -.07 applicant for a per it, may waive in whole or in part,
the provisions of Article Il, Section/ , subdivisions 5 and-9 where it finds that nature of, the
proposed operations are such. that -the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.

DESCRIPTION OF WORK
I .
It-is-proposed to construct 104 feet of timber bulkhead, dredge and place
fill behind the proposed bulkhead and proposed timber pile supported
retaining wall (as shown on the attached plans). The boat slip is to -be
dredged to a depth of 6 feet below the plane of mean low water yielding
approximately 200 cubic yards of fill material. Suitable marsh vegeta-
tion will be planted on the spoil to stabilize it.
The purpose of the work is to enable the applicant to moor -his private i
sailing craft.
This proposal was previously presented in Corps of Engineers Public Notice
Nos. 7755 and 8532 and were considered cancelled.
