The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant, does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
C employees. .
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit. _
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof. - -
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the,tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

PUBLIC HEARING
SOUTHOLD TOWN BOARD
NOVEMBER 5, 1981
3: 35 P. M.
IN THE MATTER OF THE APPLICATION OF FRANK FRANKOLA FOR A PERMIT UNDER
THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD.
SUPERVISOR PELL: I will open up the next public hearing. Affidavit
will be read by Councilman Nickles .
COUNCILMAN, NICKLES: "In the matter of the application of Frank
Frankola for a permit under the provisions of the Wetland Ordinance
of the Town of Southold for permission to construct 320 feet of timber
bulkhead and backfill with 150 yards of bankrun sand from upland source
on his property located at the south side of Glenn Road at dredged
boat basin off Goose Creek, Southold, New York, "
I have proof of publication from Pat Wood of the Long Island
Traveler-Watchman, also from Troy Gustayson of the Suffolk Weekly
Times, from the Town Clerk that it was posted on her Bulletin Board.
I have a letter from Anna T. Hataier, President, Southold Town
Trustees. "Dear Mrs . Terry: The following action was taken by the
Board of Southold Town Trustees at a regular meeting held on November
4, 1981 : Resolved to recommend to the Southold Town Board to hold in
abeyance decision on the wetland application #73 of Frank Frankola. "
I also have another letter, a previous letter dated October 15th
from the Town Trustees. "Dear Mrs. Terry: The following action was
taken by the Board of Southold Town Trustees at a regular meeting
held October 7, 1981: Resolved to recommend to the Southold Town
Board approval of the wetland application, #73, of Frank Frankola for
a bulkhead in the dredged boat basin only and to deny it for the unnamed
creek off Goose Creek, as most of the wetlands are not bulkheaded in
that creek Also, the wetlands on front are to be left as they are,
application for a permit for the existing ramp must be submitted and
no permit will be granted until the application for the ramp is
received. Very truly yours, Anna T. Hataier. "
I have a letter to the Town Clerk in response to< a letter from
the Town Clerk regarding the ownership or the principals of the
corporation. "To: Southold Town Clerk: October 14, 1981. In
response to your letter dated October 8, 1981, a copy of which is
enclosed, please be advised that we are principals of Gelfra Corp.
I, Rina Frankola is the President of Gelfra Corp. and Frank Frankola
is the Treasurer. I hope this will clarify the matter and correct

I have a letter dated October 27th from Frank Cichanowicz,
Chairman of the Conservation Advisory Council. "Dear Mrs. Terry:
Resolved to recommend to the Southold Town Board approval of Wetland

SUPERVISOR PELL: Thank you, Councilman Nickles. At this time does
anybody wish to speak in favor of the application? Mr . Carrig.
PATRICK CARRIG: I don' t know what exactly happens, there are for
and against it . I have a letter from the Town Clerklstating there
is no adverse effects are likely to occur if this project is
completed . I thought that was for. I also have a permit from New
York State if you are interested in seeing it . The DEC.
TOWN CLERK TERRY: I could read what is on the permit from the DEC.
"Bulkheading along North Shore of unnamed creek is to be at or above
mean high water line. Bulkheading in boat basin may be from 0 to 5
feet offshore of present mean high water line in the southerly 100'
portion and is to be at or above mean high water in the northerly
portion. "
MR. CARRIG: What will we do, get some sort of notification on this?
SUPERVISOR PELL: We are going to try and explain that to you in
about two minutes. Bob, the Trustees sent a letter out, one letter
saying okay on this application and last night they sent another
letter out and said to wait on it .
TOWN ATTORNEY TASKER: Is this the one we discussed?
SUPERVISOR PELL: This is one of the ones. What was the reason they
gave?
COUNCILMAN NICKLES: "Resolved to recommend to the Southold Town
Board to hold in abeyance decision on the wetland application, #73,
of Frank Frankola" . That' s all, it doesn' t give a reason, it just
says to hold in abeyance.
COUNCILMAN MURDOCK: What' s the other one say, it says approval.
COUNCILMAN MURPHY: They need more information on the application.
COUNCILMAN MURDOCK: You've got one there, John, that says the
Trustees also gave approval for the application.
COUNCILMAN NICKLES: That ' s an October 15th letter. October 15th,
Board of Town Trustees: "Resolved to recommend to the Southold Town
Board approval of the wetland application, #73, of Frank Frankola
for a bulkhead in the dredged boat basin only, and to deny it for
the unnamed creek off Goose Creek, as most of the wetlands are not
bulkheaded in that creek. Also, the wetlands on front are to be
left as they are, application for a permit for the existing ramp
must be submitted and no permit will be granted until the application
for the ramp is received".
SUPERVISOR PELL: All right, here ' s in the Code we read at Town
Board today, it says, "If the Conservation Council or the Town
Trustees shall recommend that sudh application be disapproved,
the reasons for such disapproval shall be set forth" . They didn' t
recommend disapproval, they just recommended in abeyance.

COUNCILMAN NICKLES: Well, they disapproved a portion of the applica-
tion, and , then they basically asked that it be held in abeyance.
TOWN CLERK TERRY: Mrs. Hataier is here, maybe she can answer some
of these questions.
COUNCILMAN MURDOCK: Why would you give two letters for the same
project?
MRS. HATAIER: Because of the ramp. They have no permit for the
ramp going down.
MR. CARRIG: The blacktop one?

MRS. HATAIER: Yes.
MR. CARRIG: That has been there for years.
MRS . HATAIER: What we're waiting for--the wetlands was approved.
So, we approved the wetlands and the dredged boat basin and the
unnamed creek happens to be a little dish that they dug out to
pull the boat up. It ' s no creek.
(Discussion between Mrs. Hataier and Mr . Carrig. )
SUPERVISOR PELL: Bob, you want to add anything to it?
TOWN ATTORNEY TASKER: I don' t know whether you are discussing a
Trustee permit or wetland permit. This is a wetland application
hearing.
MR. CARRIG: The canal and the boat basin were dredged, I don' t
believe the Trustees have any jurisdiction over that.
SUPERVISOR PELL: What we're going to do, Pat, and I know this is
not going to set well with you. We discussed this prior to coming
in here today. We are having the hearing today and we are going
to recess the hearing, until, when we get through it, until 11/24,
two weeks from today and give a decision, we hope, at that time.
This will give us a chance to clarify in the Board' s mind what
responsibility or anything else that might come up with the Trustees,
where they did ask us to wait. Thats what we 're going to do.
Councilman Nickles.
COUNCILMAN NICKLES: Mrs. Hataier, why are you recommending we
hold this in abeyance? What is it you need, just a permit for
the ramp?
MRS. HATAIER: The permit for the ramp is what ' s holding it up.
COUNCILMAN NICKLES: But you're not going to grant that .permit for
the ramp. It ' s not within your jurisdiction.
MRS. HATAIER: No.

TOWN ATTORNEY TASKER: Then you don ' t have anything to do with it .
Who has jurisdiction 'for the ramp?
COUNCILMAN NICKLES: The Town Board, it ' s on Town wetlands.
TOWN ATTORNEY TASKER: But he says that has been in existence.
MR. CARRIG: It existed before I came on the scene. It was there
this past summer,' but I don-'-t know when that was put in.
MRS. HATAIER: The reason we saw it was because we happened to be
up there at a yard sale.
TOWN ATTORNEY TASKER: Is it, in fact, in wetlands?
MRS. HATAIER: Yes. _
MR. CARRIG: It does go to the water, yes. .
TOWN ATTORNEY: You are talking about wetlands. Are there wetland
grasses there or is it just a sand beach?
MR. CARRIG: There is -wetlands next to it. There' s a bulkhead on
one side of it and there' s wetlands on the other side of it .
SUPERVISOR PELL: It does go right next to the wetlands?
MR. CARRIG: Yes.
SUPERVISOR PELL: Therefore, what we are going to do is ask you to
give us two weeks to get this thing squared away. We have to find
out--there is a little cross-fire here. Councilman Drum and I
talked about it prior to this. Whose jurisdiction is it . A wetland
permit that comes to this Board then it is our responsibility. If
it is a Trustee permit , then it will have to come from the Trustees.
We want to get this squared away.
COUNCILMAN NICKLES: Bill, I think it has already been resolved
right here that this is Town Board jurisdiction over the wetlands.
There is, in fact, a report of a ramp that is in violation and
lacking a permit and the building inspector should be notified
and go down there and if it is in violation, there is no permit,
a violation should be issued which then would give them the
opportunity for making application for the ramp if necessary.
The Town Attorney can correct me if I' m wrong.
COUNCILMAN DRUM: How long has it been put in? One year , ten years,
twenty years?
COUNCILMAN NICKLES: He doesn 't know. All he knows is it was there
when he visited the site this summer to do the estimating and start
this permit . It' s on West Creek off of Glenn Road, which is West
Creek Estates. It' s a man-made boat basin that was put in late
19501s, early 601s.

TOWN ATTORNEY TASKER: Was the ramp there ten years ago?
COUNCILMAN NICKLES: Was there a ramp there then? I don't know.
COUNCILMAN DRUM: There was a ramp there ten years ago anyway.
TOWN ATTORNEY TASKER: Because we have only had the wetlands law
for the last two years.
SUPERVISOR PELL: To continue the hearing, does anybody else wish
to speak in favor of the application of Frank Frankola? (No response. )
Does anybody wish to speak in opposition to it?
MRS. RUTH OLIVA; North Fork Environmental Council: I would just like
to go along with what the--Trustees has suggested in granting the
wetland application, part of it, that the bulkhead be allowed in the
dredged basin only and not along any wetlands that had not been
bulkheaded previously.
COUNCILMAN NICKLES: I ' d still like to raise the question as to why
this should be held in abeyance until November 24th on the basis of
the Trustees. As Ruth Oliva has just pointed out, the Trustees have
recommended the bulkheading within the boat basin area but not in
the creek area. If somebody could explain to me why this should be
held in abeyance, I 'd be happy to do so, otherwise think that this
application should be handled like all applications in a judicious
manner.
COUNCILMAN DRUM: And I agree. 'I thought we were going to proceed
under those circumstances.
COUNCILMAN NICKLES: I don' t know that I am prepared to make a
decision today because I haven' t inspected the site. But certainly
I don' t know any reason that if the Town Board desires, they could
do it on the 10th, otherwise hold it in abeyance.
COUNCILMAN DRUM: I concur with Councilman Nickles, close the hearing.
COUNCILMAN NICKLES : Is that all right with you, Mrs. Hataier?
MRS. HATAIER: Yes.
SUPERVISOR PELL: Does anybody wish to speak in opposition to, other
than Mrs . Oliva? (No response. ) At this time does anybody wish to
be heard on this application at all? (No response. ) If not, I will
close this hearing.

RESOLVED to recommend to the Southold Town Board approval of
Wetland Application #74 of Richard Seelig to build a wooden retain-
ing wall (bulkhead) along the eastern edge of the property, Stillwater
Avenue, Cutchogue.
RESOLVED to recommend to the Southold Town Board approval of
Wetlarid Application #75 of Charles De Luca to construct a catwalk,
ramp and floats to moor a private boat, Richmond Creek.
Application #76 of Fred Cowan, submitted by'Costello Marine
Contracting Corporation. It is the recommendation of the Conservation
Advisory Council that the application show' therlocation of therbothe
boat shed will be. Also, it is the recommendation of the Council that
the catwalk be no greater then 4' in width over the grass area.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6 NYCRR Part 617, Section
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted, will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Frank Fxankola, for a wetland permit to construct
320 feet of t>,mbex bulkhead and backf�,11 w�-,th `150 yards bankrun sand
from upland source on his Property located at south side Glenn Road
at dredged boat basin off Goose Creek, Southold, New York.
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment are likely to occur should the project be
implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comrhents by that agency.

Dear Mrs. Terry:
The following action was taken by the Board of Southold Town
Trustees at a regular meeting held October 7, 1981 :
RESOLVED to recommend to the Southold Town Board approval of
the wetland application, ##73, of Frank Frankola for a bulk-
head in the dredged boat basin only and to deny it for the
unnamed creek off Goose Creek, as most of the wetlands are
not bulkheaded in that creek. Also, the wetlands on front
are to be left as they are, application for a permit for the
existing ramp must be submitted and no permit will be granted
until the application for the ramp is received.

( County Tax Map #78-2-36 ) . Gelfra Corp . as the owner of the
Basin which has no subdivision lot number ( County Tax Map
#78-2-35 ) . This is located adjoining and West of Lot #19 .

at south side Glenn Road, at dredged boat basin off Goose Creek,

This project is unlisted and our initial determination
of non-significance has been made and we wish to coordinate
this action to conform our initial determination in our role
as lead agency .

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revolted or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon reque t aIthe applicant fr a per t, may waive in whole or in part,
the provisions of Article II, Sec �
ti r�� 9, subdivisions Z) and l;where it finds that nature of the
proposed operations are such that -the requirements of such provisions are not necessary for a
proper consideration of a permit application.

The decision whether to issue a permit will be based on an evaluation
of the probable impact of, the proposed activity on the public interest.
That decision will reflect the national concern for both protection and
utilization of important resources. The benefit which reasonably may be
expected to accrue from the proposed work must be balanced against its
reasonably foreseeable detriments. All factors which may be relevant to
the proposed work will be considered; among those are conservation, eco-
nomics, aesthetics, general environmental concerns, historic values,
fish and wildlife values, flood damage prevention, land use, navigation,
recreation, water supply, water quality, energy needs, safety, food pro-
duction and, in general , the needs and welfare of the people.

A preliminary review of the application indicates that an Environmental
Impact Statement will not be prepared. A review of the latest publish-
ed version of the National Register of Historic Places and of the pre-
sence or absence of registered properties or properties listed in
the latest published version of the Register as being eligible for
inclusion, therein, has been made. Presently unknown archeological,
scientific, prehistorical or historical data may be lost or destroyed
by work to be accomplished under the required permit.
The evaluation of the impact of the activity on the public interest
will include application of the guidelines promulgated by the Adminis-
trator, U.S. Environmental Protection Agency, under authority of Sec-
tion 404(b) of the Federal Water Pollution Control Act or of the
criteria established under authority of Section 102(a) of the Marine
Protection, Research and Sanctuaries Act of 1972, as appropriate.
Any person may request, in writing, within the comment period specified
in this notice, that a public hearing be held to consider this appli-
cation. Requests for public hearings shall ,state, -with particularity,
the reasons for holding a public hearing.
The following government authorization(s) has(have) been obtained or

shown on the attached drawing. Approxina Lely 80 cubic yards of sand
obtained from an upland source will be placed as fill behind the proposed
bulkhead.
The purpose of this project is to stop further erosion of the applicant's
property.
