The applicant and the owner and occupants of the premises upon 'which the operations authorized by this permit are being conducted, dq, - by the acceptance. of this permi-t, give consent to the Town, and its officers and employees to enter upon the premises where such opera- tions are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being conducted in conformity with this permit_ This operation will not 'substantially: A. Adversely affect the wetlands of the town_ B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion intothe fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof_ E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town_ G. Change the course of any- channel or the natural movement or flow of any waters_ H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. FOX, 365 FREEMAN ROAD, MATTITUCK, NEW YORK A public hearing was held by the Southold Town Board at the Southold Town Hall, Main Road, Southold, New York, 11971 at 8 : 00 P.M. on Tuesday, July 10 , 1979 , on the application of Thomas E. Fox for a Wetland Permit to fill back yard marsh area on property located at 365 Freeman Road, Mattituck, New York 11952 PRESENT were: Deputy Supervisor James F. Homan Councilman Henry Drum Councilman William R. Pell , III Justice Martin Suter Justice Francis T. Doyen Town Clerk Judith T. Terry Town Attorney Robert W. Tasker Deputy Supervisor James F. Homan called the hearing to order at 8 : 03 P.M. (D.S ,T. ) . Councilman Drum read the Notice of Hearing as follows : NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board of the Town of Southold at the Southold Town Hall, Main Road, Southold, New York, at 8 : 00 P.M, on July 10, 1979 , in the matter of the application of Thomas E. Fox for a permit under the provisions of the Wetland Ordinance of the Town of Southold for permission to fill rear yard marsh area at 365 Freeman Road, Mattituck, New York. We also have a Determination of Environmental Significance stating that the applicant has submitted a written statement (Environmental Assessment Form) in accordance with Chapter 44 of the Town Code and Article 8 of the Environmental Conservation Law and the rules and regulations promulgated pursuant thereto. RESOLVED to recommend to the Southold Town Board approval of Wetland Application No. 38 of Thomas E. Fox to fill back yard marsh area at private property of the Applicant with the following conditions : 1 . The filling should not go further than the existing fence. 2. CHAIRMAN DEPUTY SUPERVISOR HOMAN: Ladies and Gentlemen you have heard the reading of the public notice, proof of publication, report of the Trustees of the Town and report of the Conservation Advisory Council. At this time I will ask for any comments in favor of this application. Is there any- one who wishes to speak for this application? Yes, would you please give your name to the Steno. HELEN FOX: I 'm in favor of the application. DEPUTY SUPERVISOR HOMAN: Is there anyone else who wishes to speak in favor of this application? (there was no further response) . Is there anyone present who would like to speak in opposition to this appli- cation? FRANKLIN BEAR: I 'm not speaking in opposition to the application, but I would like to ask the Board what will be done to monitor the actual action in this case to see that the conditions set forth in these recom- mendations are carried out. DEPUTY SUPERVISOR HOMAN: At this time there are no conditions set forth. You will have to assume if the Town Board approves this application they would consider the recommendations of the other organizations. MR. BEAR: There were recommendations about filling only to the fence and the retaining walls. DEPUTY SUPERVISOR HOMAN: That ' s correct. MR. BEAR: Who is going to see to it that will happen. Page 4 Public Hearing: Thomas E. Fox July- 10 , 1979 DEPUTY SUPERVISOR HOMAN: The Building Department of the Town will monitor the conditions of this application, when and if it is granted. MRS . SAMUEL MARKEL: I would like to know what kind of retaining wall you are going to require. DEPUTY SUPERVISOR HOMAN: I 'm sorry I do not think it is the busi- ness of this Board to get into the actual construction of the proposed work, or the type of materials used in it. This will be left to , the discretion of the Environmental Council and the Building Department and if -necessary recommendations along those lines will be made in granting the permit. Is there anyone else who wishes to speak either in opposition to the application or who has any comments at all. Has everyone had the opportunity to' speak on this application? This application is to be completely filled in by typewriter or ink and submitted to the Town Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not the same as the applicant. B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location of property, the names and locations of owners of adjoining properties, and o•detailed description of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached to the Permit Application:) C. No operation shall be initiated by the applicant until all permits that are required are issued. D. A detailed statement of the rehabilitation and proposed condition of the premises after the work is completed must be given, including a survey if required. E. If permit is being sought for a more sizeable excavation than the construction of a private single dock or jetty, then this application must be accompanied by a survey and topogrop'hical map certified by a registered land survey or Professional Engineer. The horizontal control of survey shall be based upon an approval local coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological Survey datum. F. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revoked or suspended by a governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection, there is a $5.00 fee for each additional inspection. H. The Town Board upon request of the applicant for a permit, may waive in whole or in part, the provisions of Article II, Section 210, subdivisions (d) and (g) where it finds that nature of the proposed operations are such that 'the requirements of such provisions are not necessary for a proper consideration of a permit application.
