The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion,turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F.• Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I.' Otherwise adversely affect the health, safety and general welfare of the people of the town.

—617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application_ of Joseph Fischetti for a Wetland Permit to install upland bulkhead,
return, fixed dock, ramp and three float docks at the north end of Arshamomaque
Pond, on the south side of Middle Road, Southold, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment .
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.

SUPERVISOR MURPHY: This is a hearing on the wetland application of Joseph
Fischetti. It will be read by Councilman Schondebare.
COUNCILMAN SCHONDEBARE: "Notice is hereby given that public hearings
will be held by the Town Board of the Town of SoUtho-Id�at-.-the-�Southold7Town
Hall, Main Road, Southold, New York, on Tuesday, April 10, 1985, on the
following application for a permit under the provisions of the Wetland Ordinance
of the Town of Southold: 3:02 P.M. - In the matter of the application of Joseph
Fischetti for permission to install upland bulkhead, return, fixed dock, ramp and
three float docks at the north side of Arshamomaque Pond, on the south side of
Middle Road, Southold, New York. All persons interested in said matters shall
appear at the time and place above specified and will be given an opportunity to
be heard. Dated: March 27, 1984. Judith T. Terry, Southold Town Clerk."
We have an affidavit of publication from The Suffolk Times, and an affidavit
of publication from The Long Island Traveler-Watchman, and -affidavit from Judith
Terry, Town Clerk, as to the posting on the back bulletin board.,
I have a letter from the Board of Southold Town Trustees, dated February
28, 1984, Henry P. Smith, President: "Resolved to recommend to the Southold
Town Board approval of the Wetland Application #183 submitted by The Land
Use Company on behalf of Joseph Fischetti as per application."
And I have a transmittal from the Southold Town Conservation Advisory
Council, dated March 21, 1984: "Reso,lved to recommend to the Southold Town
Board approval of the wetland applicastion #183 submitted by Joseph Fischetti
to install 55 feet of upland bulkhead, 15 ft. return, fixed dock, ramp and three
float docks secured by 6 spites, Southold."
SUPERVISOR MURPHY: Thank you. You've heard the reading. Anyone here
would like to speak' in favor of this application?

MR. CHUCK BOWMAN, The Land Use Company: I represent Mr. Fischetti. I
notice some concerns from the neighbors here and if there is any questions
that I can answer pertaining to the application I will ' be happy to.
COUNCILMAN TOWNSEND: This is located at the very end of Arshamomaque
Pond. Is it adjacent to what property down there? Is it the northeast or the
northwest?
MR. BOWMAN: The northwest side.
COUNCILMAN TOWNSEND: This is where ther condominiums are to be?
MR. BOWMAN: Yes. The idea behind this application was rather than have
condominium owners coming in for individual applications, we would do this
and limit the size of the dock that would be installed and that would be it,
the end of it. This is a very small dock. There are ten unit owners.
COUNCILMAN TOWNSEND: In other words, what's- the intent of it, how is
it supposed to work when this is developed?
MR. BOWMAN: Well, they're probably going to have to work out some sort
of property owners association. as to who gets to, tie fup what boats where.
I would imagine they would have to limit the size of the boats.
COUNCILMAN TOWNSEND: What about the number of slips? Is that specified
'in it? Ten slips? How many?
MR. BOWMAN: Well, the slips aren't really set up. Right now you could
probably fit 'maybe six boats, depending on the size. It depends on the size.
COUNCILMAN TOWNSEND: And there is no dredging involved in-this?
MR. BOWMAN: No, there is not.
MR. BOWMAN: I talked to the DEC yesterday and we should be getting their
approval shortly. I know a concern was that there. was an access along the
beach, so children could walk across and get to their premises. Mr. Fischetti
said he would install stairways.
COUNCILMAN STOUTENBURGH: He's required to.
MR. BOWMAN: 1 don't think the Trustee permit says it, maybe it should have.
There was to be a. condition of this permit before you.
COUNCILMAN TOWNSEND: One last question. It is a relatively fertile ground
for clamming and various forms of tidal life. Have you had any input into the
effect on that kind of operation, small boats in' that marina? Has there been any
attempt to---
MR. BOWMAN: Well, I wouldn't really characterize it as a marine. It seems as
though most of the neighbors have small boats and this is a use that would be
compatable with their 'use of the area. This is another reason why it wasn't
anticipated doing any dredging. We want to limit the size of the boats in there.

SUPERVISOR MURPHY: Anyone else out in the audience? Ruth?
MRS. RUTH OLIVA, President, North Fork Environmental Council:' The NFEC
would like to object to it for a couple reasons. Number one, although I think
Mr. Bowman's idea for one dock, one application, is a valid one, another thing
is added inducement to the advertisement for this, condominium units to say that
you. could have, and I'm sure some of the advertisements will say, "a marina"
included. Or boating facilities available, or docking available. And I think
it just adds to the value of this man's condominiums. I don't see why we should
give him added value before he has his condominiums built. Then let him come
in for the application. Number two, and this is in reference to what you had
said Joe, about the effect on the clams. There has been no studies done that
I know about. I spoke to Paul Flagg when he was in about this, but where this
is located is the extreme northern end of Arshamomaque. This is one of the
prime areas for the baymen to obtain littlenecks, which as you know is an
excellent money crop, and we're just going--I'm not saying this has reached
the point, but we are going to reach the point of how many boats are too many
boats as far as the oil film sinking down and polluting your, clams or killing the
spawn when there is spawning in the spring, and for the heavy metals. coming
out from the exhaust, and Flagg agreed with me. This is a study that should
have to be done, expecially where you do not have a tidal action up at that
northern end that you have, say, right by the bridge. As you know it's a
prime area for our experimental clam seeding program. And the same way with
Mattituck Inlet, how many boats are too many boats? I don't know, but I think
it is a valid' concern. Thank you.
SUPERVISOR MURPHY: Jean?
MRS. JEAN TIEDKE: Yes, I was wondering if it could say that it would have
to be limited to sailboats instead of motor boats.
MRS. OLIVA: The keel is too deep.
MRS. TIEDKE: Well, it depends on what kind of sailboat you have.
SUPERINTENDENT OF HIGHWAYS DEAN: Outboards give out more oil than
inboards.
SUPERVISOR MURPHY: Okay, hold it,' hold it. This is a public hearing for
input.
MRS. TIEDKE: This is something that should be considered. I don't know
which is worse.
SUPERVISOR MURPHY: We'd like just your comments, not to argue.
MRS. TIEDKE: But I think that somebody should find out.
SUPERVISOR MURPHY: Anyone else?
MRS. TIEDKE: And 1 also think that perhaps the idea that Mr. Fischetti, who
happens to be a neighbor of mine,, could wait until his condos are built, as you
said'.

SUPERVISOR MURPHY: Sir?
MR. ALEX BONDARCHUK, Richmond Road, Mill Colony, Southold: Concerning
the desire of the developer of the condominimum located on Mill Creek to build
a floating dock with multiple moorings, it 'is my opinion it should be denied.
To build and place such a floating dock in Mill Creek creates three important
problems that cannot be overlooked: Number one, it could prove to be a
navigational hazard. Number two, you will be depriving the local residents
and commercial baymen, of which I am, from access to the creek bottom. Number
three, and most important, you will be setting a precedent by allowing the
creation of mini-marinas. In reference to the decision of the "Trustees get
tough on docks," found in the April 5, 1984 issue The Suffolk Times, I fully
agree with the decision of the Trustess to deny any moorings that place "the
burden of effort to get along with the neighbors." In the future, if any
resident wishes to place a mooring in Southold Town, it should be an individual
one, and not a multiple one.
SUPERVISOR MURPHY: Thank you. Any other comments? Sir?
MR. MANFRED KERNER: I'm an adjoining neighbor and I'm opposed to it also.
I think it would set a precedent. We have a motel adjoining the proposed
condominiums. It will' set a precedent, they'll want to put out docks. How are
you going to limit this thing. You're talking about ten units. You're talking
about at least ten boats, perhaps more. The motel might want to get it and
they'll put boats out also. We're already getting swamped back there with
boats as it is.
SUPERVISOR MURPHY: Thank you. Anyone else like to speak on this?

COUNCILMAN SCHONDEBARE: I have a question. Mr. Bondarchuck, did you
say that your access back into the creek would be-blocked by this?
MR. BONDARCHUK: No, no, I didn't say that. I said it could prove to be
a navigational hazard.
SUPERVISOR MURPHY: Any other comments? (No response.) If not, I'll
move to close the hearing.

Council at a regular meeting held Tuesday, March 20th, 1984 .
RESOLVED to recommend to the Southold Town Board approval
of the wetland application #182 submitted by Helen B. Case to
place broken concrete from "first" bridge afore high water
mark. New Suffolk
RESOLVED to recommend to the Southold Town Board approval of
the wetland application #183 submitted by Joseph Fischetti to
install 55; of upland bulkhead, 15 ' return, fixed dock, ramp
and three float docks secured by , 6 spiles. Southold
RESOLVED to recommend to the Southold Town Board approval

INSTRLICTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if--not—
the same as the applicant. -
B. Pilot Plan must be drawn to scale on the reverse Fide of this application showing the location
of property, the names and locations of owners of adjoining properties, and a deteiled description
of proposed project. (Note: Copies of the Pilot Plan may be mode by a copy machine and attached
to the Permit Application.)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
• E. It permit is being sought for a more sizeable excavation 'than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizental control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses i
were ever revoked or suspended by a governmental agency.
G. A filing fee of $5g,,OOsholl accompany the application. This filing fee includes one inspection
there is a $5.00 fee for each additional inspection.

H. The Town Board upon request tie applicant for a
permit, may waive in whole or in part,
the provisions of Article 11, Section9..� ,' subdivisions (4) and tC-r where it finds that nature of the
proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
