Price : Thank you for your letter of August 12 , 1982 and the - enclosures relating to the above party . However , I am not quite sure of what you are trying to tell me . If you are trying to tell me the Farr ' s are actually engaged , and are running a charter business operation from the premises in question , then you merely need to have a competant person sign an affidavit as to the precise business conducted , with a date and time . If I am to proceed with a criminal procedure I am required to prove the case ( operation of charter boat business ) beyond a reasonable doubt . Through my investigation , I have not been able to establish that Mr . & Mrs . Farr are presently engaged in conducting the operation you state they have at this location . The Building Department does not have the financial resources to have a man conduct a full investigation , which would mean watching the property and the activities thereon on a continual basis in order to gather this first hand knowledge . I have visited the site and spoke to Mr . Farr , who claims that they are not engaged in a commercial operation. ( Zoned C Light Industrial ) Dear Ms . Farr : Pursuant to our conversation Thursday, I am outlining the following steps you must take to make use of this prop- erty as a marina . At present you have a vacant lot and you must apply for a Certificate of Occupancy for use as a marina . Mr . Stanley Corwin was in Friday and picked up the application to submit to our department . Since use of premises as a marina requires a Special Exception from the Board of Appeals your application for the Certificate of Occupancy will be denied and you may then make your appeal for Special Exception to the Zoning Board of Appeals . Mr . Corwin has picked up the forms for this purpose . The following sections of the statute set forth the above mentioned requirements under Chapter 100 of the Zoning Ordi- nance , Town of Southold , N . Y . : Art . XIV , Sec . 100-144 A ( 2 ) & B ( Certificates of Occupancy) Art . VIII , Sec . 100-80 B ( 9 ) uses ( C Light Industrial District ) . The validity of your Wetlands Permit #70 is subject to the Zoning requirements for the intended use for the district in which this property is situated . It is my understanding Katherine Farr is the owner of cer- tain property on the westerly side of Manhanset Avenue bordering on Sterling Creek or Basin, by deed dated December 11, 1981 and recorded in the Suffolk County Clerk `s Office on March 10, 1982 in Liber 9152 , page 392 , and further, that Sterling Creek or Basin are tidal waters. The application before the Town Board is to dredge an area of Sterling Creek adjacent to Katherine Farr' s property and to install a bulkhead and floating dock for the purpose of mooring sailboats. Generally, when a person holds a deed bounded by tidal waters they own to the ordinary high water and no further. What- ever right they have below this line is in the nature of an ease- ment. Therefore , to install bulkheads and to conduct any dredging below the high water mark, the owner must obtain a permit from the governmental agency exercising jurisdiction over the area, In this particular application the Town Board has concurrent juris- diction with the New York State Department of Environmental Con- servation (DEC)_ by virtue of ; Wetlands Ordinance of the Town of Southold (_Code of the Town of Southold, Chapter 971 and Article 25 of the Environmental Conservation Law, A DEC Permit is required because pursuant to Article 25 of the Environmental Conservation Law this agency has jurisdiction over the land contemplated by the work in the application. A permit is also required from the Town Board under the Wetlands Ordinance of the Town of Southold because the operations being conducted are in tidal waters bordering the Town of Southold. Preston, decided by Special Term of the Supreme Court of Suffolk County on January 5 , 1931 and subsequently affirmed by the Appellate Division, Second Department -- 252 N.Y.S . 357{:,mot for lv to app den 253 N.Y.S. 1002 (case not officially reportedl , wherein the Court determined the south boundary of �the Town of Southold at Greenport to be the high water mark of Greenport Harbor, More particularly, Sterling Basin constitutes a part of Greenport Harbor, Greenport Harbor is a part of Peconic Bay being the arm of the sea referred to in the Andros Patents and Sterling Basin is not within the boundaries of the property con- veyed by the Andros Patent, Therefore , it is x4y conclusion and opinion that the Sterling Basin and more particularly the land under water adjacent to the property owned by Katherine Farr is not within the land conveyed by the Andros Patentg and therefore the Trustees of the Town of Southold have no jurisdiction to issue any permit to the appli- cant for the proposed work, This is consistent with what has taken place over the years, for it is my understanding there are numerous grants by the State of New York to private individuals of land under Sterling Creek. Under the provisions of X9_7. 24 of the Code of the Town of Southold the Town Trustees are authorized to review the wetlands permit application upon referral by the Town Board and to file a written report of the effect, if any, on the wetlands and tidal waters of' the Town. of Souttold, The same applies to the Conser- vation Advisory Council, It is my understanding both of these agencies have reported to the Town Board, The Wetlands Ordinance of the Town of Southold sets forth nine standards in Section 9.7-28 which. the Town Board will have to take into consideration before granting or denying a permit, Further, any permit issued by the Town Board can impose appropriate conditions on the proposed operations encompassed by the application (_§97--25) . Bob Tasker represented Mrs. Farr in taking title to this property and offered to withdraw from advising the Town Board in this matter, although it probably is not necessary. As you will note, it seems Van Tuyl made an erroneous survey of the property in question, which confused the location of the existing bulkheads and part of the land. Irving L. Price, Jr, appeared at the public hearing on behalf of Sterling Harbor Shipyard & Marina, Inc, , adjacent property owners, in opposition to granting a wetland permit (I will probably have the minutes of the hearing available for your review sometime next week) . There is a further problem being that the Town Trustees did not believe this to be within their jurisdiction and told Mrs . Farr a permit from their Board would not be necessary. This hearing was held on April 20th at which time Kathrine Farr amended her application before this Board and the hearing was held on the amended application. At that time we recessed it until today to give adequate time for anybody who would like to make comment on the amended application. At this time I will ask for any comments on behalf of the amended applica- tion, in favor of the applications. Roy Haje on behalf of Kathrine Farr. ROY HAJE, President, Enconsultants, Inc. , for the applicant : The purpose of the project is the construction of various sections of timber bulkhead to be connected to the existing bulkhead which primarily has encompassed the area as of now. We propose to finish the bulkheading to prevent further erosion of the upland into the creek. We also propose to place various floating docks offshore of the bulkhead and conduct maintenance dredging to remove that material which has eroded into the waterway. The New York State D.E. C. has recently issued their permit for the project and I can offer you a copy of that here today. We believe the project to be in keeping with the surrounding usage and would urge your approval of it . SUPERVISOR PELL: Is the permit the D.E.C. issued, is that on the amended application or the original application? MR. HAJE: It is on the amended application. The only difference being various lot lines placed on there by the surveyor. When he ♦ f 1 � Page 2 - Kathrine Farr - Wetland Application went back he found some of the lot lines had to be changed. That had nothing to do with the work in the water of which we are proposing here. Copies of the amended drawing, which again only changed insofar as the lot lines were sent to all regulatory agencies. Not only the Town Board but also the State D.E.C. and the Corps of Engineers. So they had that prior to their approval and are aware of it. SUPERVISOR PELL: Correct me please. The amended application also removed the building that was planned on it . The D.E.C. had to rule on anything within 300 feet of the shoreline? So it does ' t include the building? MR. HAJE: No, they didn' t have to include that in theirs, and the reason I believe being that property which is bulkheaded in excess of 100 feet and is in existence prior to September 1977 is exempt from their jurisdiction landward of the bulkhead. SUPERVISOR PELL: So they don ' t have to determine on that then? MR. HAJE: That is my interpretation, right. SUPERVISOR PELL: Will you submit a copy of the D.E.C. permit please? MR. HAJE: Sure. SUPERVISOR PELL: Anybody else wish to address the application before the Board of Kathrine Farr at this time in favor of? (No response. ) Anybody wish to address the amended application in opposition to? (No response. ) Does anybody wish to be heard at all on this applica- tion? (No response. ) Any questions from the Town Board? Councilman Townsend. COUNCILMAN TOWNSEND: Yes, I ' d like to ask the applicant if they care to comment on the presentation of the attorney for the adjoining piece of property, I don' t remember the name of it, would it be the Sterling Harbor Marina, Inc . ? He made some statements that were relatively negative on your application, and I was wondering if you have any comment on that? MR. HAJE: I was not present when he was offering those statements but I had heard from the Farr ' s some of the things which were commented upon. I also received a copy of the letter from Mr . Price, attorney for the person in opposition. Many of those arguments did not touch to the relevant issue which you are to decide here today, which is the environmental impact of the bulkheading; dredging and the docks . The project as we have described it to you is not detrimental. I think all of the other issues are peripheral and really are not subject to the Board' s consideration in this particular forum. SUPERVISOR PELL: Mr. Haje, did the Army Engineers--do they have to rule on this? MR. HAJE: Yes, they do. SUPERVISOR PELL: Have you heard from them from the amended applica- tion at this time? 4 , Page 3 - Kathrine Far - Wetland Application MR. HAJE: No, I have not yet. As you know, they wait until the State D.E.C. issues their permit . I '-ve only very recently received this State permit. They have to receive a copy of it- as well before they will issue their approval. I would expect that possibly in two or three weeks, or there abouts. A copy of Mr . Price' s letter has gone to them and I responded to his comments to the Corps of Engineers as well. SUPERVISOR PELL: Thank you. Counsel have anything we should ask? SPECIAL ATTORNEY LARK: I just have one question. Does your amended application--you weren 't responsive to the Supervisor--does it or does it not include the proposed building, accessory building, on the premises? Your amended application. There' s some confusion in the record as to whether it ' s to be or not to be. MR. HAJE: The application to who? SPECIAL ATTORNEY LARK: The Town Board. I think they're entitled to know whether or not you are going to want to place a building on the premises. MR. HAJE: The application to the Town Board here does not include the construction of the building. SPECIAL ATTORNEY LARK: It ' s only for the bulkh6ading you indicate in the application, the dredging and the floating docks, is that correct? MR. HAJE: That' s right . SPECIAL ATTORNEY LARK: And is it also my understanding that the spoil that you would get as a result of the dredging will be placed on the property behind the existing bulkhead or the bulkhead to be built? MR. HAJE: That ' s right, for backfill. SPECIAL ATTORNEY LARK: And is there enough to that or would you have to bring in additional backfill or are you going to have too much and are going to have to truck it off, the excess? MR. HAJE: We may have to bring in some additional. SPECIAL ATTORNEY LARK: In other words there won' t be enough from the dredging itself to completely backfill as you envision it today? MR. HAJE: It is difficult to say exactly because the bottom undulates so we don' t know exactly how much is going to come out of there, but it will be close---possibly a little bit additional will have to be brought in, not much. SUPERVISOR PELL: So the building before the Town Board is removed from the application, amended application, the building's off. Any other questions, Counsel? Page 4 - Kathrine Farms - Wetland Application r JUSTICE EDWARDS: I have one question. How wide is the creek at this particular point? MR. HAJE: I could scale that off. I did show it to scale--- JUSTICE EDWARDS: What I 'm getting at is if you're going to have a float against the bulkhead, you'-re going to have two boats rafted together out there, because you haven' t got enough property to get all these boats in one line along these floats, so you're going to have these boats rafted together--- MRS . KATHRINE FARR: There is no request in the application to the Town Board for the rafting of boats. JUSTICE EDWARDS: No , but what I 'm getting at is what Mr. Price was saying that it is going to add to the confusion of the creek, and if you do put the boats out there in the middle of the creek, I,',m just wondering how much room there is. MRS . FARR: The work to be done--I'm quoting from a letter from our attorney Mr. Stanley Corwin which he suggested I read to you if you had any questions--the work to be done in this dredging permit is within the standards of the ordinance of the Town of Southold. JUSTICE EDWARDS: Well, I 'm just getting at the final results, thank you. SPECIAL ATTORNEY LARK: You going to submit that letter to the Town? MRS . FARR: No. MR. HAJE: Judge Edwards, if I could respond to your previous question. The width of the creek at that point varies somewhat but it' s roughly 80 to 90 feet wide. That ' s from bulkheads existing to the opposite shore. SPECIAL ATTORNEY LARK: What direction did you measure your 90 to 90 feet? MR. HAJE: Generally east-west. SUPERVISOR PELL: Councilman Murdock has a question. COUNCILMAN MURDOCK: My problem stems from the tanks onboard the boats. I 'm concerned about lack of pumping facilities. I don 't want to see those tanks emptied out either into the Bay as soon as they get out of the inlet or in the waterway itself. You are going to have four boats there that are available for charter . People operating the boats I assume will not be master shipmen, they will not think about emptying those tanks until they come in and turn the boat back in and in order for you to get the boat ready to be rented out again those tanks are going to have to be serviced and I 'm concerned about the lack of facilities to service those tanks. I just don' t want to see that dumped into the creek or into the Bay. Page 5 - Kathrine Fa__ - Wetland Application MRS . FARR: I say to you gentlemen, the work to be done on this premises and the request that we are making before this Board does not concern tanks, it concerns a wetland ordinance. The Wetlands Ordinance of the Town of Southold is designed so that everyone who applies must conform equally and fairly to the application of the Ordinance of the Town. The only request that we are making of this Board is a Wetland Ordinance and I repeat to you that we are in full compliance within the standards of the Ordinance. We are in full compliance within the standards of the Ordinance. The subject of tanks--by the way, our boats don't have holding tanks--the subject of tanks is not the proper discussion of this Board as concerns this application. SPECIAL ATTORNEY LARK: In your opinion,, isn-' t--that right? MRS . FARR: In the opinion of Attorney Stanley Corwin, sir. SPECIAL ATTORNEY LARK: I ask -you again, are you going to submit Mr. Corwin' s memorandum? MRS. FARR: No, sir . SPECIAL ATTORNEY LARK: I think Councilman Murdock was trying to ask you what provision, if any, after you have your work completed if the Board grants you a permit, what provisions that you are going to take to prevent any affluent or how you are going to control the affluent that might or might not be emitted from the boats that were tied up, the sailboats that were tied up at this dock, or what provisions are going to be made. And I think he was asking that question relevant to if any affluent were adversely effect the fish or other marine life in that area. I think that ' s where he was coming from when he asked the question. Just what provisions, if any, were- going to be provided for. MRS . FARR: The vessels which we own and charter, all of them, comply with the latest Coast Guard standards. We are obliged to comply with the federal regulations. The federal government standards supersede the standards of the state, as they supersede the standards of the town. We are in compliance, in full compliance, with the Coast Guard regulations regarding affluents and flow through. The affluents that flow through the systems which we have is a very expensive system, but what issued forward after the use of the system is an inert material, harmless to the environment . It contains no--there is a word for it-- the chemical that is usually put into holding tanks.--' When' this is used we .are- in full compliance, gentlemen, we are in full compliance with Coast"Guard requirements. We must comply with Coast Guard requirements. They supersede the requirements of the state and they supersede the requirements of the town. SPECIAL ATTORNEY LARK: Do you have a copy of the requirements of the United States Coast Guard? MRS. FARR: I didn' t bring one with me. SPECIAL ATTORNEY LARK: Would you submit one to the Board and could you also submit simultaneously to the Board how your particular boats _ Page 6 - Kathrine Fa_ _ - Wetland Application �p that you are going to be operating from this area would be in compliance therewith and that the affluent that is emitted from them is harmless? Because I believe that ' s what you said, it ' s a harmless affluent . MRS. FARR: It is a Coast Guard Type 2 Flow-Thru Treatment System and it' s called a Lectra/San Type 2 Flow-Thru Treatment System. That should be sufficient for you gentlemen. It is Coast Guard approved. SPECIAL ATTORNEY LARK: You didn' t answer my question. Will you--- MRS . FARR: Are you going to postpone this hearing for another two weeks while I go back and get a copy of this certification? SPECIAL ATTORNEY LARK: I'm just asking if you have one available to submit to the Board. MRS. FARR: I said I don' t have it here today. I 'm asking you, are you going to postpone this hearing for another two weeks on that basis? SUPERVISOR PELL: The Board will make that decision when it comes time. SPECIAL ATTORNEY LARK: How long will it take you to get a copy of these standards to the Board? COUNCILMAN NICKLES: I ' d like to ask the attorney a question while we' re here, if -the contention `of the-'applicant ':that we-'•re only considering the Wetland Ordinance and that work that pertains to what they' re applying for rather than what use the boats involved, what' s going to happen to the affluent . SPECIAL ATTORNEY LARK: That ' s partially correct. The Ordinance sets forth as indicated by Mr. Haje standards that the Board has to consider and the question that Mr . Murdock asked is relevant to him when he' s making his determination along with the rest of the Board members to determine whether there would be any adverse effect on the marine life in there, because the ordinance also provides for the Board to impose such conditions on the manner and the extent of the proposed operation if it deems appropriate and one of the more widely standards is the catch-all, is if the operation would otherwise effect the health, safety and general welfare of the people of the Town of Southold. You don' t have to be limited purely to what the dredging itself is going to do or the fill or the bulk- head itself. You' re also concerned with what ' s going to be happening with the property if you grant the permit . No doubt the D.E.C. and the Corps of Engineers also take these things into consideration as part of their standards, so I thought that the question that he asked was relevant or germain to the overall situation and if they can, within a reasonable period of time, submit these things I think that would be appropriate for you in making your determination, to take this into consideration.. This application before the Town Board, I would like to ask if there is any information that you would like to present to the Board at this time? KATHRINE FARR: Yes, there is. There was a technical error made on the survey. SUPERVISOR PELL: We picked it up, yes, we know there is a technical error made on the survey. That is why we are not going to close this hearing today,. we are going to recess it . MRS. FARR: What I have--what I ' ve made up is copies of the application and the original survey based on which we bought the property and I also have made copies of the corrected survey and I 've also brought copies of the corrected application. What happened here is that the survey line on the southwest corner of the property--I have extra copies so everybody can have a look--the survey line on the southwest corner of the property was listed correctly and the boundary lines that are shown on the survey are correct but the picture is wrong. So that ' s what you have and that ' s the original. What I have today to present as additional information, I was able to get the application redrawn and the survey corrected. This is a copy of the corrected survey. It ' s a copy of Mr . Van Tuyl' s explanation of the error and this is a resubmitted application. Now, Mr . Tasker , Bob Tasker , was out attorney in this and he made a recommendation to us that since our business begins working actually on May 3rd and we need a base from which to operate it and are in very serious trouble here, that we had a proposed little storeroom to be put on the property which we dropped from this amended application because we haven' t had time to go through with setbacks and everything else like that , so we're just going to take that away from the application and leave only the wetlands portion of it on the survey. I have copies of this for everybody too. SUPERVISOR PELL: Now, my problem is with this is the Town Board made a determination a month ago so this will not have a negative effect- on the environment . Now you are changing your application, amending it , dropping the building, giving us the correct lines on it . Are we in our legal rights to not require another one? We ruled on misinformation. The drawings were wrong when we ruled and now they have amended it and changed the building, dropped the building from the original request. Now, how can we--- TOWN ATTORNEY TASKER: Well , if you made a determination--- SUPERVISOR PELL: We did make a determination. TOWN ATTORNEY TASKER: That it was not going to affect the environ- ment and showed the building on it and they're taking the building off, I think the affect on the environment would be a lot less. So, therefore, I don' t think it would affect your first determination. MRS. FARR: If I might also point out, the error in the survey is not in error in the boundary line. The error in the survey is a mis- drawn picture. The original survey which is incorrect is drawn in red lines on this. It ' s a tracing and the correct survey is in black lines. Page 3 - Public He__ ing - Kathrine Farr SUPERVISOR PELL: I personally looked at this land many years ago to buy it for myself so I 'm a little bit familiar with it and when I found out how small it was I backed off and then when I seen your survey here I said, hey that don' t quite meet up with what I had when I looked at it . There was no jagged line here. MRS. FARR: That ' s right . That was the error in the drawing. SUPERVISOR PELL: All right, this is what I have here submitted by Van Tuyl. MRS . FARR: You've got a copy of that there now too along with his explanation. SUPERVISOR PELL: No, this was submitted at another time. This is October 7, 1981 and it shows a straight line. Then in going through the files I have this one here that was submitted by you. I just drew a line here through the middle of your building. MRS. FARR: Okay, I have a copy of the surveys from Van Tuyl. SUPERVISOR PELL: Now, my question is. that with these changes from what was presented to the Town Board and presented to the Corps of Engineers or whoever you present them to, now you are amending these. Is that correct? Changing the lines--- MRS. FARR: No, the lines are not changed, the lines are identical. SUPERVISOR PELL: What you submitted was correct or incorrect? MRS. FARR: What we submitted in terms of the lines of the perimeters of the property are listed on the survey as 23 degrees, 48 minutes, 10 degrees west . SUPERVISOR PELL: Where did you submit this to? MRS. FARR: I submitted it to you and to the Environment and Corps of Engineers. SUPERVISOR PELL: And where else? MRS . FARR: And D.E.C. SUPERVISOR PELL: Then my problem is you submitted this which was incorrect, this is incorrect. MRS. FARR: Van Tuyl made a mistake in the survey. SUPERVISOR PELL: You submitted this which is incorrect to the Town Board of Southold, D.E.C. and Army Engineers. All this had been mailed out to everybody incorrectly. Now, are you going to notify them with the correction? MRS . FARR: Yes. We were not notified of this error in the survey until April 9th. Page 4 - Public Heai-ing - Kathrine Farr SUPERVISOR PELL: Bob addressed this to the Board this morning and that is why I said we're not going to adjourn this. We will listen to the testimony and then we' ll recess- it. MRS. FARR: What we did was I was able to get ahold of the fellow who was handling the D.E.C. filing for me yesterday and he redrew the map and is in the process of filing the correction. He spoke to them and in a phone conversation, since there is no change in the wetlands application, no change in the amount of material to be removed and no change in the bulkhead or anything like that , they didn' t seem to think there was going to be any problem, any changes in what they were considering. What is basically wrong is the draw- ing, the picture, not the actual boundaries or the amount of material to be removed or the length of the docks or the length of the bulkheads or anything like that . I ',m really sorry, it is such a small piece of property to create-- SUPERVISOR PELL: What you are telling us today then is you have amended and you are amending right now your original application to omit the building and change the boundary picture? MRS. FARR: Change the picture, that ' s right . SUPERVISOR PELL: The drawing that was submitted . And you're saying that the drawing submitted was incorrect. MRS . FARR: That ' s right . SUPERVISOR PELL: Then we have to conduct the hearing today on the amended application which if anybody was in the Town Clerk' s Office when this was publicly posted, put on notice and had come in and examined misinformation. So therefore we will not close today, we will hold this, recess, and reopen this hearing at another Town Board meeting to give anybody in the public a chance to appear before the Town Board on your amended application which will be on file with the Town Clerk. MRS. FARR: I understand that . I can only respectfully request that since we operate a very small seasonal business and we do need to have space in which to operate that we ask that you consider it at the earliest feasible time. COUNCILMAN MURPHY: What is the business? MRS. FARR: Sailboat charters . We now own four sailboats. We' ve been operating a sailboat charter business in Greenport since 1976 . We now own four sailboats and a small power boat, a little work boat . We have been using marina facilities in Greenport that really was very generous to us to let us use their facilities for these years until we were able to find a piece of property that would work for us which we feel this will, although it is not a very big piece, it ' s big enough for our operation which is quite small. SUPERVISOR PELL: Now, back to the hearing. I presume- you want to speak in favor of, and you just amended your application. Do you wish to make any other statements? Ing - Kathrine Farr Page 5 - Public Hc-- MRS . FARR: No, but I ' ll answer any questions you have. Our business is a small business but we desperately need a piece of waterfront from which to operate our and a safe place to park them. One of the things that this small piece of land represents is a very safe harbor. It ' s a real hurricane hole and it was one of the reasons why we considered it inspite of its small size. We just beg that you favorably consider our request because without it we are really up the creek without a paddle. SUPERVISOR PELL: Anybody else wish to speak in favor of the applica= tion? (No response. ) Anybody wish to speak in opposition to the application? IRVING L. PRICE, JR. , 828 Front Street , Greenport: In light of the developments today I 'm not quite sure how I should proceed, but can you tell me who the applicant is? SUPERVISOR PELL: That is in the name of Kathrine Farr I believe. MR. PRICE: Who is the applicant? TOWN CLERK TERRY: Kathrine Farr. MR. PRICE: Does she classify herself as owner? TOWN CLERK TERRY: As a matter of fact Enconsultants applied on her behalf. MR. PRICE: Maybe it would be expeditious if I asked Mrs. Farr or someone asked Mrs . Farr if she' s the owner. SUPERVISOR PELL: Mrs. Farr, are you the owner of the property? MRS . FARR: Yes, that ' s correct . I'm the owner of the property. MR. PRICE: You-',re not the contract vendee, you just don' t have a contract? MRS. FARR: I own it . MR. PRICE: In the event that she did not own it, the owner' s consent to this application would have to be endorsed on the application. So in the event that title has not changed I raise that objection. Under 97-21 in the Southold Code under Wetlands the procedure for applica- tions on permits J. requires documentary proof that all other necessary ,permits and approvals have been obtained, and I submit that under Section 32-10, Chapter 32, Article I of the Town ordinances the Town Board -of Trustees is required to give permission for docks and bulk- heads. I don 't see this permit. I didn' t see it in the original application. Under the standards to be considered by the Town Board before-•they give a Wetlands Permit, they have to satisfy themselves that it does not adversely affect the wetlands of the Town. It is our position -- I represent , if I did,-,not say it , I represent Sterling Harbor Shipyard and Marina, Inc. , who are the tenants of the property to the south of this- parcel and their landlord leased all of the property that they own except this parcel which it conveyed to Robert Page 6 - Public Hc-. ing - Kathrine Farr H. Preston, the predecessor in title to whoever is the present owner. It' s our position that such an installation with five sailboats and only this limited dockage will adversely affect the wetlands of the Town in that there will be sewerage and parking. There is not enough room there, in our opinion for any off-street -parking for five auto- mobiles. And since this is in light business it requires certain amounts of parking as decided by the Planning Board and I don' t see any decision by the Planning Board as to the site for this commercial installation. 'Also, under the standards which your Board is to con- sider , is whether or not it changes the course of any channel or the natural movement or flow of any water. It is our position that it does change the course of any channel and the actual flow of water, and whether or it not it would otherwise adversely affect the health, safety, general welfare of the people of the Town. We see no provision for a pump-out station for this facility. And if there were a pump-out st.atioh -there' s no sewer in which to get rid of the pumped-out material and there' s not room for a cesspool on 'these premises under the Suffolk County Board of Health guidelines. So to that extent we do believe that it would adversely affect the health, safety and general welfare of the people ixri the Town. It' s obvious that they made an application to the Corps of Engineers for permission and my client has entered an objection to that application. That permit is not here. If there is to be any kind of a structure such as docks to be erected if it is not to be permitted by the Town Trustees as being on land under water in the Town then it would have to be by permit from the Building Department. I ' ve just checked with the Building Department and there is no applica- tion for a building permit on file, so if it isn' t one it is the other and there is no permit for the erection of any installation. The applicant , Kathrine Farr, applied to the Village of Greenport to install a water service and the Village of Greenport has installed a water service. When I telephoned the Village Office today to ask who had applied I was informed that it was Kathrine Farr and the clerk, Nathalie Rackett, asked me if there was any problem and I said, yes, I had a problem. . She said, well if it ' s the fact that it ' s on the property of Sterling Harbor Shipyard and Marina, we know that and we are going to change that so that it' s on the property of the applicant. They have installed a telephone line--ran telephone wire-- from the pole to one of the spiles, an extension of the spile and there' s a jack on the stringer of the bulkhead. All without any building permit. And it' s our position that this application is fatal in that it ' s premature and doesn' t meet your own requirements for an application. Therefore there is nothing to recess because it should be dismissed. Thank you for your attention. SUPERVISOR PELL: Anybody else wish to speak in opposition to? (No response. ) Any Councilman have any questions? Counsel Price— MR. PRICE: Mr. Supervisor, if this recessed hearing is reopened I reserve my rights to speak at that time also. SUPERVISOR PELL: Councilman Townsend. COUNCILMAN TOWNSEND: I have no questions of Counsel Price I just want to discuss another issue. We have our Town Attorney who would normally advise us in this situation. I believe he has some affiliation with the applicant and I just wanted to find out how Page, 7 - Public Hc-- ing - Kathrine Farr that ' s going to effect his function. There seems to be some issue. SUPERVISOR PELL: I would recommend to the Board that we consult private counsel on this particular, matter. Any objections to the Board? COUNCILMAN TOWNSEND: I just wanted to confirm that fact •' I ' d like to confirm it before we---if he ' s representing the applicant--- SUPERVISOR PELL: He' s not representing her. He did handle the action of sale. TOWN ATTORNEY TASKER: I represented Mr. and Mrs. Farr when they bought this property. That is the extent of my representation to them• However, if this Board feels that because of that activity on my part , I 'm perfectly willing to disqualify myself from giving you any advice on this and you can seek-tither counsel . I would be more comfortable if you did, but I made it clear to them that I was only handling their title. COUNCILMAN TOWNSEND: Okay, I just wanted to find that out. If you feel there is no conflict--if there is no conflict=-- TOWN ATTORNEY TASKER: I would be just as happy if you consulted someone else. if you feel that my participation in representing them when they bought the property is going to affect my opinions to you then I would suggest that you seek other counsel . We have a couple that we retain. SUPERVISOR PELL: If the Board does not object I will get one of the other two counsels that we use to advise the Board on this then there will be no question in anybody' s mind and everybody will be happier. Any problem? Does anybody have any opposition? MR. PRICE: Mr. Supervisor, there is no objection on the part of the objector to Mr. Tasker handling it. Whichever he wishes but we have all the faith in the world in him. SUPERVISOR PELL: Counsel I dof-to,.i, I have been dealing with Bob for many years very closely, but if there is going to be a tint of inference on anyone' s part and Bob has been very loyal to the Board and always will be, but I would prefer to have any even thought of anything on this. The Board will make a decision on that later. COUNCILMAN TOWNSEND: My question was basically if he is still involved in it. Since:°there is no involvement and since there ' s no conflict ,I have no objections to maintaining him rather than go to the extra expense of hiring other counsel. SUPERVISOR PELL: The Board will discuss which way it wants to go. Anybody else wish to speak in opposition to the amended application? (No response. ). FARR: We have a 26 foot, a 28 foot, a 33 foot and a 35 foot-- saiboats, and a- power boat of 28 feet ., JUSTICE EDWARDS: So you have four sailboats and a power boat? MRS. FARR: Yes. SUPERVISOR PELL: Any other questions on this"application? Anybody wish to be heard at all? COUNCILMAN TOWNSEND: Perhaps they would care to comment on- what the representative of Sterling Harbor Shipyard had to say? SUPERVISOR PELL: Does anybody wish to be heard at all? In other words do you have any comments you would like to make? MR. BILL FARR: I am husband of Kathrine. I am the operator of Fairwind Yachts and Charters which will operate from this dock. The only thing that I would like to point out in answer to the problem of sewerage is that our boats are all equipped with Coast Guard approved devices called lectrisands which discharge clarified affluent . However , we do instruct all of our people to not even use that until they are out in open water. But this is a Coast Guard approved device so I don' t think that the problem of sewerage is one that is going to be a difficulty there. MRS. FARR: I 've forgotten all the objections by the attorney here but in respect to the building, there is no building. In respect to the application, we have applied for all of the applications . All of the proper applications that we were advised to apply for including the Town Council, the Village Trustees who ruled that they did not have jurisdiction over that piece of property. We went through that hearing. So I don' t know what else we can do to be in compliance with the Town' s laws otherthan apply everywhere we were supposed to apply. If the people that we applied to haven' t answered yet , I don 't know what to tell you. SUPERVISOR PELL: Any other questions? JUSTICE EDWARDS : One last question. The telephone jack on the dock. Are you going to use one of the boats for an office in a sense? MRS . FARR: 'bmporari.ly, yes. JUSTICE EDWARDS : You do not plan to put a building on there? MRS. FARR: At this point, no. JUSTICE EDWARDS: Then to have an office you will have to use one of the boats. MRS . FARR: Well , not a sailboat but the work boat, the power boat , yes . MR. PRICE: As , to the application that the applicant made to the z Page 9 - Public H�.w_ ing - Kathrine Farr Town Board of Trustees, I was let to believe that they felt they had no jurisdiction because it was a federal matter and then when we objected to the Corps of Engineers on their hearing, we sent a copy to the Town Board of Trustees and Mr. Stoutenburgh who I under- stand is the Chairman of the Board of Trustees telephoned my office and I was out but left a message to the effect that the Village of Greenport Trustees were the ones that we should contact if we had any objections and I then wrote a letter to Mr_ Stoutenburgh pointing out that this property was well outside the Village of Greenport and that I believed that the Southold Town Board did have jurisdiction and I asked him in the- letter if I _was• correct would the matter then be reopened? The Code states that for an application for a Wetland Permit the applicant is to have all the necessary permits before the application is made. If they don' t have the necessary permits then the application is out of order. SUPERVISOR PELL: Councilman Murdock. COUNCILMAN MURDOCK: Counsel Price, I did read that we had a letter dated March 5th to Judith T. Terry, Town Clerk on behalf of the Town Trustees of Southold Town: "The following action was taken by the Board of Southold Town Trustees at a regular meeting held on' March 2nd, 1982: Resolved to recommend to the Town Board approval of the wetland application #88 of Kathrine Farr to construct two bulkheads, two floating docks and to dredge in Sterling Creek, Greenport, " }and then signed by Paul Stoutenburgh, President . MR. PRICE: That' s not a permit. The Town Board of Trustees has two functions. They and the Conservation Council are consulted and they have to give reports within ten days and that is one of their reports, but the provisions for your application for a Wetland Permit provides that you must have all the necessary permits and one of the permits you have to have to erect a bulkhead or a floating dock over Town water is a permit from the Town Board of Trustees and that ' s not here not is the Corps of Engineers permit , nor the Building Department permit. You can-';t have a C.O. and if it ' s going to have an office in a boat that ' s just as much of an 'office and~)a,-commercial use as- . though they had a building, and they need a C.O. in my opinion. The southeasterly line of the Farr parcel is and alwayqhas been tle extension of the one-and-only bulk- head line. The discovery of this fact does not, I believe, in any way affect the title to the Farr parcel, and in fact probably helps to clear up any nebulous area between the bulkhead and the old high- water mark. As indicated on one print (in red) , there is a water- service line extending onto the Marina property for a distance of 12 feet, possible presumed to be on the Farr property. This probably could be resolved through an "easement" arrangement with the Marina people. Let us hear from you if you have any comment.
