The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon,the premises where such operations are being conducted to
make such inspections as the Town n'iay deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially: .
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. . Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or,the natural habitat thereof.

E. Increase the danger of flood acid storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the•course of any channel or the natural movement or flow of any waters.
H., Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health,'safety and general he
of the people of the town.

NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section _
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Enconsultants, Inc. , on behalf of Katherine Farr,
for a Wetland Permit to construct timber bulkhead, install float
in front of proposed bulkhead, and dredge in front of the bulkhead
and place spoil on adjacent upland -as backfill for the bulkhead,
on Sterling Creek, on the west side of Manhanset Avenue, Greenport ,
New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment .
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.

SUPERVISOR MURPHY: This is the hearing on, the wetland application'of,
Enconsultants, on behalf of Katherine Farr. The notice will be read by
Councilman Schondebare.
COUNCILMAN SCHONDEBARE: - "Notice is' hereby given that a public hearing
will be held by the Town Board of the Town, of Southold at the Southold Town
Hall, Main Road, Southold, New York, at 3:00 P.M., Tuesday, May 8, 1984, in
the matter of the application of Enconsultants, I.nc., on behalf of Katherine Farr,
for a permit under the provisions of the Wetland Ordinance of the Town of
Southold to construct timber bulkheading, install float in front of proposed
bulkhead,. dredge in front'of the bulkhead and place spoil on adjacent upland
as backfill' for the bulkhead, on the west side of Manhanset Avenue, Sterling
Creek, Greenport, New York. All persons interested in' said'matters shall
appear at the time and pl,ace"above specified and will ' be given an opportunity
to be heard. Dated'; April '24, '1984. Judith T. Terry, Southold Town Clerk."

An affidavit 'of publication from The Suffolk Times. An affidavit from the' Town
Clerk indicating the notice was affixed to the Town' Clerk's Bulletin Board.
We have a report from the Southold Town Conservation Advisory Council,
dated September 29, 1983. "Resolved to recommend to the Southold Town Board`
approval of the wetland application #159 submitted by Enconsultants, Inc., on
behalf of Katherine Farr to construct bulkhead, floats and dredge. Greenport.'!
have a report from 'the Board of Town Trustees,, dated September 16,
1983. "Resolved to recommend to the Southold Town Board approval of the Wet-
application No. ,, 159, submitted by Enconsultants, Inc. , Inc. , on behalf of
Katherine Farr, as per application."
TOWN CLERK TERRY: There's just one more thing. We asked for an opinion ,
from the Highway Superintendent.

COUNCILMAN SCHONDEBARE: We have a report from the Superintendent of
Highways, dated April 17, 1984, which states gas follows: "In regards to the
application of Enconsultants Inc. for a Wetland Permit 'on behalf of, Katherine
Farr, I recommend that no type of obstruction be placed on the Town right-
of-way on Town highway Manhanset Avenue. Also 1 recommend establishing
a no parking area along the proposed bulkheading on Town highway Manhanset
Avenue. Very truly yours, Raymond C. Dean, Superintendent of Highways."
SUPERVISOR MURPHY: Okay, you've heard the reading of the official -notice.
Is there anyone here would like to speak on behalf of the application of En-
consultants, on behalf of Katherine Farr?
MR. ROY HAJE, President, Enconsultants, Inc. : The application requests
permission to install a bulkhead, etc.., and it,.'is.',to better utilize an area which
is now really unusable to the applicants.' It has broken. concrete and other
debris along the shoreline which has eroded, especially since that storm. This
would seek to straighten out that area and make it usable for tieing up a boat,
etc. and generally improve'the property. The DEC has approved the project
and l would request your favorable approval.
COUNCILMAN STOUTENBURGH: Could we ask you a question, Roy?
MR. HAJE: Yes.
COUNCILMAN STOUTENBURGH: What is 'your, concern about this-'letter that
the Highway Superintendent has put in' here.
MR. HAJE; That's the first I've heard of it. Could I see it? Maybe you could
explain'this to me® Now-, you recommend no type of obstruction be placed on
the Town right-of-way.'
SUPERINTENDENT OF ,HIGHWAYS DEAN: Because it's such a busy road in
the summertime with. cars and people walking, 1 want no parking on the Town
right-of-way there, no parking there, so you're going to park on your own
property. In essence, don't use the shoulder for a parking lot.
COUNCILMAN STOUTENBURGH: Does that apply to the whole road then?
SUPERINTENDENT OF HIGHWAYS DEAN: In' that area, because it's very vital,
because it's very narrow and, as you know, up the other end there's an awful
lot of--well, it's wider ,, and you have an awful lot of traffic walking, up, you have
bicycles, you have people walking from the marina, and they start putting cars'
on the shoulder there, somebody's going to get killed in that area, and that's
one of my jobs.
MR. HAJE: Could 1 just try to contact them? Because something that they
would really have to respond to, and since I haven't had a chance.
SUPERINTENDENT OF HIGHWAYS DEAN: Oh, it wouldn't be you.
COUNCILMAN STOUTENBURGH: No,, he was representing them, that was my
only point. I thought he might have some input.

MR. HAJE: Let me see if T can reach them by phone now, I might be able to
get back to you in five minutes.
COUNCILMAN' STOUTENBURGH: Sure, we can move on to something. Can't we
just hold it?
TOWN CLERK TERRY: You can recess the hearing.
COUNCILMAN TOWNSEND: What exactly does that have to do with the wetlands?
SUPERINTENDENT OF HIGHWAYS, DEAN: I just have an obligation of the right-
of-way.
COUNCILMAN TOWNSEND: Right, but that's a site--1 would not think that would
be involved in' the wetlands permit.' What does it 'have to do with the wetlands ?
SUPERINTENDENT OF HIGHWAYS DEAN: I don't know. Something come across
the office and I just write back how I feel. I think it 'is•'critical there.
COUNCILMAN TOWNSEND : No, you're point is well taken, I think. And I think
that a lot of points have been raised about this operation in' the past hearings
and so forth.
MR. HAJE: You're right, it might be part of the site plan--more appropriate.
COUNCILMAN STOUTENBURGH: Well, let's pass the wetlands and take care of
the other later on, but dont• put the two together then.
SUPERINTENDENT OF HIGHWAYS DEAN: And I• can just see somebody parking
out there on the Town highway, and what's going to happen, you've got about
30 feet there of the road area, and somebody walking up and down that road
or on a bicycle can get wiped out very easily.
COUNCILMAN SCHONDEBARE: But' that has nothing to do with the wetlands
itself.
COUNCILMAN STOUTENBURGH: Can we act, Frank, on the wetlands application
and okay it or deny it and then just---
SUPERVISOR MURPHY: Yes, I don't see what one has to do with the other myself.
COUNCILMAN STOUTENBURGH: I don't want to get this mixed up with the two

SUPERVISOR MURPHY. : Is there any connection with the two?
TOWN ATTORNEY TASKER: One of them has to do with parking.
COUNCILMAN STOUTENBURGH: Okay, so that really doesn't even interfere with
our--that shouldn't be in our hearing then?
COUNCILMAN TOWNSEND: Bob, what are you saying, what has to do with the
parking?
TOWN ATTORNEY TASKER: Well, he's talking about restricting parking on the
Town highway.

COUNCILMAN TOWNSEND: We're not talking about that, we're talking about
wetlands.
TOWN ATTORNEY TASKER: That's what he's ,talking about.
COUNCILMAN STOUTENBURGH: I want this restricted from the hearing, then,
because this has nothing to do with the hearing. We're just taking care of the
wetlands application. If you're going to put this with it; then I think we should
-act on it.
COUNCILMAN TOWNSEND: Does it relate to anything else on the wetlands?
SUPERVISOR MURPHY: What are they doing there, Roy?
MR. HAJE: They're going to tie a boat to the float in front of the bulkhead.
COUNCILMAN TOWNSEND: A boat, or--three boats?
MR. HAJE: Well, it's a rental operation. Just how many are going to go in front
of this particular one, I don't know. They're sailboats and I don't know what
size sailboats.
SUPERVISOR MURPHY: Are they going to fill in behind the bulkhead onto the
shoulder of the road?
MR. HAJE: Well, they're going to level it off. They're going to backfill, and I
would assume make it probably about level to the shoulder, yes.
SUPERVISOR MURPHY: So I do think Ray's, comments. certainly would come in.
TOWN ATTORNEY TASKER: If you look at the plan here, all the structures are
being installed outside of the highway right-of-way, including the shoulder. His '
complaint apparently is 'that they might park out here in the road. That's
independent of the wetland application. I mean, there's no structure going in
the right-of-way.
COUNCILMAN TOWNSEND: I recall, and I don't think it's part of this file, but
there was a letter that came--copy of a letter to Senator LaValle, State Senator
LaValle, regarding the difficulty that Mrs. Farr has had in getting permits. Do
you recall seeing a copy of that letter?
SUPERVISOR MURPHY: Just came, we just got it.
COUNCILMAN TOWNSEND: I got it about a month ago.
MR. HAJE: Could I see it? I haven't seen it.'
TOWN CLERK TERRY: I think that was more directed toward the Planning Board.
COUNCILMAN TOWNSEND: Yes, because they didn't get permission to put in
buildings or telephone lines and things like that.
TOWN CLERK TERRY: Maybe, but it wasn't Town Board.
COUNCILMAN TOWNSEND: That doesn't have anything to do with this?

SUPERVISOR MURPHY: No. This wetland hearing has been going for what?
Since last year.
COUNCILMAN TOWNSEND: Last year? This is a new hearing, though, is it
not?
SUPERVISOR MURPHY: This is the first hearing.
COUNCILMAN TOWNSEND: The other one was turned down.
MR. HAJE: No.
SUPERVISOR MURPHY: No.
MR. HAJE: No, it 'was just a resumption, really. I think it was held and
tabled, wasn't it?
SUPERVISOR MURPHY: There was another one before this. There were two.
TOWN CLERK TERRY: This application is dated August 25th, 1983.
MR. HAJE: There was one that was approved about two years ago.
COUNCILMAN STOUTENBURGH: That was for something else though.
TOWN CLERK TERRY: Right.
MR. HAJE: Right, that was for the--
SUPERVISOR MURPHY: This is 'for her extension now.
MR. HAJE: Right, this,'is adding another piece of bulkheading on to the one
that was previously approved two years ago.
SUPERVISOR MURPHY: Going down towards that, culvert.
MR. HAJE: That's right.
SUPERVISOR MURPHY; That's one of the reasons it was held up because of the
possible damage to the, culvert and all of this.
MR. HAJE: Well, I don't .know why it was 'held up, but it was.
SUPERVISOR MURPHY: Do you have any other questions for Roy? (No response.)
Is there anyone else would like to speak in favor of this applicatoin? (No response.)
Anyone like to speak in opposition to it? (No response.) Anyone like to make any
other comments? Any Town Board members?
COUNCILMAN STOUTENBURGH: I would merely say that I would think that this
would be the kind of thing that we would encourage in this Town, only in the
sense that we have a rental boat kind of thing that goes along with that kind of
operation in this Town. I would think so, anyway.
SUPERVISOR MURPHY: Anyone else have any comments? (No response.) If not,

or what have you.

Dear Ms. Chytalo:
Following a discussion with the owner, I find it is necessary to amend
our application so that the proposed 33� ft bulkhead will attach to the
corner of the existing bulkhead to the south and be in line with it. The float
will remain in front of the proposed bulkhead but the area to be dredged
will be reduced to 33' x 10' . The spoil to be removed will now be approximately
20 cu yds.

The change is necessitated by several factors. You will note that there
is much concrete and other debris along the shoreline. Bulkhead installation
here would be very difficult due to the obstruction this material poses.
As now proposed, the concrete can simply be backfilled.
' h
Another problem with the original location is that it would leave no
room on the north end for access. The road is immediately behind and therefore
a danger to those embarking or disembarking from boats.
The original comfiguration would be impractical for maneuvering and i
tying boats. The angle in the bulkhead would present an obstacle to easy
access. ;I;
Your inspection of the site will reveal old pilings which have been
in place in excess of 20 years. They are further waterward than the proposed {
bulkhead and marked the location of a previous structure. We do not presently
propose to go as far as that old structure but feel the location shown
is required.
As these modifications are minor, I trust you will be able to modify our
existing application. The site has been flagged for your inspection and
photos are enclosed herewith.
By copies of this letter and work plan, I am requesting the Town of
Southold and Corps of Engineers to amend their applications as well.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the,Pilot Plan may be made by a copy machine and attached
to the Permit Application.)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional- Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request�,�f applicant for a permit, may waive in whole or in part,
the provisions- of Article ll, Section{{ subdivisions A and ("'where it finds that nature of the
proposed operations are such that 'the requirements of such provisions are not necessary for a-
proper consideration of a permit application.,
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
Fermit shall be available for inspection at any time, upon request.
