The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. Is there anyone here would like to speak in favor of the application of, Enconsultants, on behalf of Lewis Edson? MR. ROY HAJE, President, Enconsultants: For the applicant, Lewis Edson. The project is a standard private dock consisting of catwalk, ramp and _float, for the use of the property owner. It will be elevated above the fringe marsh or spartina and will have no deleterious effect upon it. We would urge your approval of the application. SUPERVISOR MURPHY: Thank you, Roy. ANN BAYDALA: I live adjacent to this property and 1 have seen it all winter long completely under water. 1 made the comment to the Town Trustees. This doesn't seem fair to me to have somebody go buy a piece of property with 120 foot that is flooded. I know it probably is on clause, the map, the deed, but this has been filled-in land. It just seems unfair to me. 1 don't oppose it, I can't oppose it, but it just is not right. Thank you. SUPERVISOR MURPHY: Thank you for your comments. COUNCILMAN SCH014DEBARE: Can I ask a question? SUPERVISOR MURPHY: Yes,' Jay. COUNCILMAN SCHONDEBARE: What is your objection? MRS. BAYDALA: I'm fighting for the people that are going to buy that property, believe it or not. They come when that land is filled in, they won't know they're walking--they got bog underneath it. A catwalk would have to be put up for 120 feet? So that the people could get from their house to where they want to get in the water? You know, you people are fighting something over here on Horton with the erosion. This Goose Creek has enlarged itself tremendously, and in the spring and in the fall that 120 foot is completely under water. I just don't think the house should be put that close. I really don't. It's unfair to the people that are: going to buy it 'and Mr. Edson knows it. He's seen the piece of property. He told me there won't be any basement, great, fine, you couldn't put a basement down below. But you people of the Town of Southold— don't know--- SUPERVISOR MURPHY : Thank you. Any other questions?
