The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, November 18, 2009:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #60 to allow for the existing 4'x19.3' wood walkway, 4'xl 19.2' open-
grate catwalk, 2.6'x30' aluminum ramp, and 8'x40' floating dock, with the condition that
the fixed dock's decking is to be maintained as an open-grated material, and as
depicted on the revised survey prepared by Angle of Attack Land Surveying, LLC last
dated December 8, 2009, and stamped approved on December 11, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

MILDRED COWAN requests an Amendment to Permit #60 to allow for the existing 4'X 19.3'
wood walkway, 4'X 119.2' open-grate catwalk, 2.6'X 30' aluminum ramp, and 8'X 40' floating
dock. Located: 800 Fox Hollow Rd., Mattituck. SCTM#113-6-21
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the Policy Standards and
therefore is INCONSISTENT with the LWRP.
Poficy 6. Protect and restore the quafity and function of the Town of Southold's ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other/ands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
In 1958 a permit was issued for a dock totaling 36' in length. The current dock totals
176.5' in length. The current dock structure does not conform to permit conditions. It is
recommended that the proposed dock structure be re-constructed to comply with permit
requirements. Additionally, to further Policy 5.; Protect and improve water quality and supply in
the Town of Southold and Policy 6. Protect and restore the quality and function of the Town of
Southold's ecosystem it is recommended that the Board require mitigation to reduce the
impacts of the build-out, including reducing the float size to conforming dimensions.

The applicant fails to prove that the action meets the following requirements § 275-11
Construction and operation standards C. 2 (d) of the Southold Tow Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic
or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, she#fishing, waterskiing and other water-dependant
activities;
[3] Whether the dock will unduly interfere with transit by the public along the public
beaches or foreshore;
[4] Whether the dock will significantly impair the use or value of waterfront property
adjacent to or near the dock;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish
and wildlife habitats;
[7] Whether the dock will result in the destruction of or prevent the growth of vegetated
wetlands, seagrasses including eelgrass (Zostera marina) and widgeon grass (Ruppia
maritima) or shellfish;
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[9] Whether the dock will be safe when constructed;
[10/. Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
[11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

This office is representing Mildred Cowan in the sale of the above referenced

I am enclosing a copy of a Wetlands Permit (#60) which was issued by your office on
October 2,1981 to Mrs. Cowan's husband, Fred (now deceased) for the construction of a
floating dock, catwalk ralnp and a piling dock. At that time, l understand the Trustees did
not issue a Certificate of Compliance, but that your office has been doing so for the last 7 or
8 years.
I alii writing you now to request that you issue a Certificate of Compliance for the
items enumerated in the aforesaid permit. As I understand you will only issue the original
C.C. to the owner, would you kindly forward same to Mrs. Cowan at 107 Thompson

The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk,of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the-acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from'any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees. ,
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

Cowan by Costello Marine. Application No. 76. This hearing was
also held on November 5th and we recessed it until today. Does
anybody wish to speak on this application?
TRUSTEE PAUL STOUTENBURGH: I was under the impression that Mrs .
Hataier took care of that. Do you have any comments from her on
that one? (Nothing in writing. )
COUNCILMAN NICKLES: The question was whether the building was
on the dock. The contractor said that it wasn' t on the dock -
the boat shed. But it turns out now that it is on the dock.
TOWN CLERK TERRY: There is something Costello sent to me which
you will find right on the top of the file.
SUPERVISOR PELL: What did Costello say?
COUNCILMAN DRUM: The future shed will be constructed on the deck
at the upland end of the catwalk adjoining the existing lawn.
SUPERVISOR PELL: The problem we had last time when Mrs. Hataier
was here and the man who was going to construct this did resolve
some it I think. Before we rule on this we will contact Mrs.
Hataier and make sure the problem the Trustees have will be discussed
by the Town Board to make sure it is resolved before we rule on this.
Anybody else wish to comment on the application? (No response. ) If
not I will declare this hearing closed.

I have a letter from the Board of Trustees: "The following
action was taken by the Board of Southold Town Trustees at a regular
meeting held November 4, 1981: Resolved to recommend to the Southold
Town Board to hold in abeyance decision on the wetland application,
#76, of Fred Cowan, as the Trustees need more information on the
application. "
Letter from Frank Cichanowicz of the Conservation Advisory
Council: "The following action has been taken by the Southold Town
Conservation Advisory Council at a regular meeting held October 27,
1981: Application #76 of Fred Cowan, submitted by Costello Marine
Contracting Corporation. It is the recommendation of the Conservation
Advisory Council that the application show the location of where the
boat shed will be. Also, it is the recommendation of the Council
that the catwalk be no greater than 4' in width over the grass area. -

applicant? ' Mr. John Costello, Costello Marine.
JOHN COSTELLO: Well, I-'=d just like to clarify a couple of points.
The boat shed, and I don't know if it says boat shed on there, but
I believe it is a dock storage shed, upland about 50 ft . above high
water mark, just so he can store his outboard without carrying it
up a cliff. The other question of reducing it down to a 4 ft .
width. A lot of times there is the possibility of ice which causes
more damage on a 4 ft—dock than a 5 ft. dock because you need two
inside pilings on it and it is a lot easier to construct 5 ft. Now
there are docks in the area that range from 6 ft. to 52 to 4 ft.

I recommend that the dock should be 5 ft. ,, but the catwalk, above
the high tide mark, could be reduced to 4 ft . If there are any other
questions or objections I would like to clarify them.
SUPERVISOR PELL: John, the problem is the Trustees asked us to wait
on this. We have the Chairman of the Trustees here, Mrs. Hataier.

SUPERVISOR PELL: John, let me ask you this. The Trustees asked us
to wait on this. The Town Board meeting--the next one is the 10th,
which is next Tuesday. No problem if we wait until the 24th? Okay.
Then I will recess this hearing, after I get done, to the 24th and
that will give you time to get ahold of the Trustees and answer what-
ever problems they have. Then we can rule on the 24th.

make it 5 feet, but the DEC is going to recommend 4 ft.
MRS. OLIVA: Then you are going to have to have 4 ft. The problem
came up last night at the Trustees too and I agree with them about
the boat storage. They -thought it was going to be at the end of the
dock. That was the problem.
MR. COSTELLO: It is way upland of the catwalk.
'MRS. COSTELLO: If he meets these conditions I see no objection at all.
SUPERVISOR PELL: I will ask that this be recessed until 11/24 at
3:40 P.M. in the afternoon and Mrs . Hataier, there are three 'applica-
tions here that we recessed. - We hope you can have your questions
answered and to us by that date so we can act upon them. In other

Dear Mrs. Hataier:
The Southold Town Board, at a special meeting held on
November 5, 1981, discussed the request of the Board of Southold
Town Trustees to become lead agency in the matter of the application
of Enconsultants, Inc. for Wunneweta Lagoon Association.
The Board was advised by Town Attorney Tasker that the Trustees
may not declare themselves lead agency with regard to a Wetland
Application before the Town Board. This does not preclude the
Trustees from declaring themselves lead agency in the matter of
a permit by Wunneweta Lagoon Association that is presently before
the Trustees.
The Town Board held a public hearing on the matter of the
application for a wetland permit by Wunneweta Lagoon Association
on November 5th at 3: 30 P.M. This public hearing was recessed
until 3: 30 P.M. , November 24th, to give the Trustees ample time
to present the Town Board with their findings and recommendations.
The Board also recessed the public hearing on the wetland
application of Charles DeLuca to 3: 35 P.M. , November 24th, and

3: 40 P.M. on November 24th to again give the Trustees ample time
to present the Town Board with their findings and recommendations.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by written permission from the owner of the property if not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by ,a copy machine and attached
to the Permit Application)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon reque t the applicant for a permit, may waive in whole or in part,
the provisions of Article II, Secti r� , subdivisions & and Q where it finds that nature of the
proposed operations are such that 'the requirements of such provisions are not necessary for a
proper consideration of a permit application.
