SUPERVISOR MARTOCGHIA: I will now call the hearing to
order on application of Clifford C. Cornell. Justice Demarest
will read the legal notice of hearing concerning premises at
325 Willow Point Road, Southold, New York.
Justice Demarest read the legal notice of hearing and proof
of .publication in the official newspaper, The Long Island Traveler-
Mattituck Watchman, signed by C. Whitney Booth, Publisher.
Justice Demarest also read a report from the Board of Town
Trustees, signed by Alvah B. Goldsmith, Chairman, addressed to
the Southold Town Board, dated April 10, 1972, as follows:
'The Board of Town Trustees waive objection to the applications
of George K. Dornauer and Clifford C. Cornell for a Wetlands permit
on the grounds that the property was filled to several feet above
the highest high tide a number of years prior to the' passage of
the Wetlands Ordinance. All of this property was excavated from
private land, and none of it is now, nor ever was under the
jurisdiction of the Town Trustees.
The Board of Town Trustees feel the proposals of George K.
Dornauer and Clifford C. Cornell do not conflict with, nor have
any detrimental affect on any Wetland Ordinance provisions'
Justice Demarest also read a -report from the Southold Town
Envoronmental Advisory Council dated April 19, 1972:
41We believe a permit may be granted to erect a bulkhead.
We do.not believe such action would be detrimental to the

SUPERVISOR MARTOCCHIA: You have heard the legal notice of
hearing and the proof of publication. You have also heard the
statements of the Town Trustees and -the Southold Town Environmental
Advisory Council who have no objections to the granting of this

Cornell. , I am his, father-in-law. He could not , be here
tonight. He is handing out ' cigars. today. My daughter had a
baby yesterday. He .has the, same problem that I have in retaining
land. He will be docking a 16 foot boat,

Mrs. Jean Tiedke, Pres. , League of Women Voters of Riverhead
presented the Board with the following statement:
11June 6, 1972. - Wetlands Applications Nos. and, 5: We
do not object- to these applications since the- damage has already
been done. We do hope, though, that such canals are completely
prohibited in the 'future.1i _

INSTRUCTIONS FOR PERMIT
r
A. This application is to -be completely filled in by typewriter or
ink and submitted to the Town Clerk in quadruplicate, accompanied by
k written permission from the owner of the property if not ''the same as
the applicant.
B. Pilot Plan must be drawn to scale on the reverse side , of this
application showing the location of property, the names and locations
of owners of adjoining properties, and a detailed description of
proposed project. (Note : Copies of the Pilot Plan may be made by
a copy machine and attached to the Permit Application. )
C. No operations shall- be initiated by the applicant until all
permits that are required are issued. ;
D. A detailed statement of the rehabilitation and proposed condition
of the premises after the work is completed must be given, including
a survey if required.
E. If permit is being sought for a more sizeable excavation than the
construction of a private single dock or jetty, then this :application
must be accompanied by a survey and topographical map certified by a
registered land survey or 'Professional Engineer. The horizontal
control of survey shall be based upon an approved local coordinate
system. The vertic,,pl control for elevation and soundings . shall be
based upon United States Coast and Geodetic , Survey and/or -United
States� Geological Survey datum.
F. A statement must accompany the application describing any known
prior operations conducted on the premises in question and whether
any prior licenses or permits have been issued 'to erect dtructure,s
or to dredge or deposit fill ' on said' premises and whether any such
permits or licenses were - ever revoked or suspended by ,a governmental
agency. 600
G. A filing fee of $25 . 00 shall'-,-,accompany the application. This
filing fee includes one inspection, -- there 'is a $5. 00 fee for each
additional inspection.
H. The, Town Board upon request of -the applicant for a permit, may
waive in whole •or impart, the provisions of, Article II, Section 210,
subdivisions (d) -and (g) where it finds that the nature of the
proposed operations are such- that the requirement's of such provisions
are not necessary for a proper coiisidertion of a permit application.
I. Upon approval of this app lication the Town Clerk will , issue a
permit to the applicant. Such permit shall be available for inspec0
tion at any time, upon, request.

The validity of this permit is or may be subject

other governmental or municipal' authorities. TheTown accepts no ;
" responsibility in applying for or obtaining' such approva'i. In the ;
event that such approval is necessary, the holder of thil permit
shall, not commence operations hereunder until such approval has been
obtained in writing. ' The failure to obtain such other approval- when
required shall subject this permit to immediate revocation by the
. 'Town Clerk upon receipt by, the Town Clerk of written` notice from such
• other -governmental or municipal authorities of ' its refusal or disapproval.
Th-e .applicant does by the acceptance of this, permit, assldme all
responsibility for operations undertaken pursuant tolthli permit,
and shall take all precautions for the prevention of injuries to
persons and property resulting from such operations. iBy such
acceptance, the applicant also, agrees to indemnify ana save harm-
less the •Town, and its -officers , agents. and employees fr8m,any and
all claims arising from 'o�erations under this permit and ;any and ,
all'•acts_ or omissions of applicant, his agent-and employees.
The applicant and, the owner and occupants of , the premises upon which
',the operations authorized by this permit are being conducted, do, '
by,-the acceptance of this permit, give consent to the Town, and its
'officers' and employees. to enter upon the premises, where, sluch opera-
tions are being conducted to make such , inspections as ,the _Town may , x
deem 'necessary to insure tAat such operations are being ,cpnducted
,in` conformity with this permit.
