NEGATIVE DECLARATION
NOTICE OF NO SIGNIFICANT EFFECT ON THE ENVIRONMENT
Dated: April 11, 1984
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section _
617. 10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted will not have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Helen B. Case for a wetland permit . Permission
is requested for approval of construction of bulkhead consisting of
broken concrete on West Creek off south side of New Suffolk Avenue,
Cutchogue, New York.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment.
Because there has been no response in the allotted time from the
New York State Department of Environmental_ Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.
Further information can be obtained by contacting Mrs. Judith T.

PUBLIC HEARING
SOUTHOLD TOWN BOARD
APRIL 10, 1984
3:00 P.M.
IN THE MATTER OF APPLICATION NO. 182 BY HELEN B. CASE FOR A
WETLAND PERMIT.
Present: Supervisor Francis J. Murphy
Councilman Joseph L. Townsend, Jr.
Justice Raymond W. Edwards
Councilman Paul Stoutenburgh
Councilman James A. Schondebare
SUPERVISOR MURPHY: This is a hearing on the application of Helen Case
for a wetland permit. The notice will be read by Councilman Stoutenburgh.
COUNCILMAN STOUTENBURGH: "Notice is hereby given that public hearings
will be held by the Town Board of the Town of Southold! at the Southold Town
Hall, Main Road, Southold, New York, on Tuesday, April 10; 1984, on the
following application for a permit under the provisions of the Wetland Ordinance
of the Town of Southold: 3:00 P.M. - In the matter of the application of Helen
B. Cse for permission to construct bulkhead, consisting of broken concrete on
West Creek, off south side of New Suffolk Avenue, Cutchogue, New York. All
persons interested in said matters shall appear at the time and place above
specified and will be given an opportunity to be heard. Dated: March 27,
1984, Judith T. Terry, Southold Town Clerk."
I have proof of publication in the Long Island Traveler-Watchman, The
Suffolk Times, and Judy Terry has posted it on the Bulletin Board outside.
I have a letter from Henry Smith, President of the Trustees: "Resolved
to recommend to the Southold Town Board approval of the Wetland Application
#182 submitted by Helen B. Case to place broken concrete above high water
on property at West Creek, Cutchogue."
have one from the Conservation Advisory Council, also, dated March
21st: "Resolved to recommend to the Southold Town Board approval of the
wetland application #182 submitted by Helen B. Case to place broken concrete
from "first" bridge above high water mark, New Suffolk."
SUPERVISOR MURPHY: Thank you, Paul. You've heard -the read. Is there
anyone here to speak in favor? (No response.) Anyone to speak in opposition
on this? (No response.) Paul?
Page 2 - Wetland App, ;tion - Helen B. Case
COUNCILMAN STOUTENBURGH: I would like to speak only because John
Wickham was here to speak for Helen Case and he told me he got a call and
he had.to go right out and, couldn't stay here. I am -acquainted with it and
anyone who knows the area, it's just to the east of the bridge in West Creek
in New Suffolk. It's where Kimogenor Point sticks out and the road. There's
only an area of about six feet between the road,'and the Creek and this has
washed away tremendously and what they're doing is 'taking the rubble from
the broken bridges and putting it along that edge and they've had more
erosion since the last storm and it's quite imperative that this be done. And
I, as a past Trustee, would recommend that it be done.
SUPERVISOR MURPHY: Any other comments on this? (No response. ) If not,
we'll close the hearing.
