ORIENT ASSOCIATION . � ROCEIVED Box 44,RD# 1 Orient(Long Island), N.Y. 11957 AUG 1984 Town Clerk Southold August 8, 1984 Southold Town Board Southold New York 11971 Re : RICHARD CANTWELL APPLICATION - CEDAR BIRCH ROAD, ORIENT (south of Rt . 25) Dear Members of the Town Board: We ask you to deny Richard Cantwell 's application to join two existing "irrigation ditches" together on his property on Cedar Birch Road, Orient, because of, the fragile fresh water supply in that area. His request to join these two "irrigation ditches " together is a very ambitious creating one pond or lake approximately 775 feet long _ with an average width of 120 feet, 160 feet maximum. His application states 18, 600 yards are to be excavated. Many years ago when Edwin H. King farmed this land, he used the northernmost irrigation ditch to irrigate his land. ' He had to abandon this irrigation ditch because he pulled salt water. Persons presently living on Cedar Birch Road are witness to the fact that during extremely high tides, the water overflows the banks of this irrigation ditch.' The southern "irrigation ditch" is actually a pond dug by Mr. King for his own pleasure . It was never used for irrigation. The water in it is brackish. The fresh water in this area is very fragile, and there is considerable concern that further cutting into the fresh water lens to form such a large pond or lake could very possibly cause salt water, intrusion that would affect the drinking water of all the people living on Cedar Birch Road. Terry: I made an inspection of the subject premises under this application today. It would appear that a wetlands permit from the Town of Southold would be r'equired ;1_',,this is based on the following. The existing ponds contain saltwater . Mr . Cantwell stated that he had a test made which confirmed this . The northerly pond was originally made by Ed King as an irrigation pond for his farming operation but was abandoned due to saltwater intru- sion . I have been informed that the- water f-n both ponds will fluctuate with the tides . In the area of the ponds there is spartina growth . In view of the above , a wetlands permit would be required under Wetlands Ordinance Chapter 97 , Art . II , Sec . 97-20 , since conditions exist as defined under Art . Cantwell to dredge approximately 18, 600 cu. yds. to enlarge and connect two existing irrigation ponds, Main Road Orient. The Trustees recommend disapproval of this application because of the irreversible damage to the spartina ring around the pond. They felt that a project of such size would puncture and possibly irreversibly damage the water supply. The project directly faces a number of residential homes along Cedar Birch Drive and could directly affect the water supply.
