The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. DESCRIPTION OF ACTION Application of Norman C. Boos for a wetland permit . Permission is requested to dredge and bulkhead on west side of existing marina located at Broadwaters Cove off Bay Avenue - Skunk Lane, Cutchogue, New York. The project has been determined not to have a significant effect on the environment for the following reasons : r An environmental assessment has been submitted which indicated that no significant adverse to the environment are likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the New York State Department of Environmental .Conservation, it is assumed that there is no objection nor comments by that agency. Boos Wetlands application #59 Gentlemen: I have received a plot plan from Mr. Boos showing area in red, behind proposed bulkhead that is to be filled. The cross sectional drawing shows that filling will be done between the bulk- head and previously filled land and will be retained on the south end of the bulkhead. This drawing will be satisfactory, since it deals with the proposed construc- tion and filling in a specific manner. While the cross sectional drawing does not show it, I would expect construc- tion to include dead men and tie rods as standard bulkhead construction. Yobs truly, Edward F. Boos Wetlands application #59 Gentlemen: I have read Mr. Boos' application for a wetlands permit . He is asking for permission to fill behind the bulkhead with 100 yards of material. From the information given as to the size of the proposed work, it is not clear as to how far the filling behind the bulkhead will extend. The land to the west of this proposed work, owned by D. P. Brickley, and I would guess, a portion owned by the applicant, is all wetlands . In view of this, I would like to see a more detailed description of the proposed filling in the area so as to protect the wet- lands mentioned. As enforcing officers of the Town Wetlands Ordinance, it would be our responsibility to check on the work under a wetlands permit. Over the last 20 years , I ' ve seen this marina grow. a little bit here , a little bit there , and I think it ' s time to stop it. There ' s nothing we can do about the nonconforming use that ' s there . We want to keep it the way it is without any growth , without any , I call it , nudging size of growth--a little bit here , a little bit there , has been going on for the last 10 or 15 years . I think we all know that. We feel very strongly on Nassau Point , some of our members use it and want to keep it the way it is , without any growth , without any more activity there . We have a letter from the Town Board of Appeals which rigidly defines the use of that marina , and believe me we on Nassau Point will watch that very closely to the extent that we can . Another point that I feel I don ' t really have an answer for it now , this is a business in a residential area , and today it was brought home to me when I received the tax bill to my property . I know businesses are taxed on maybe a different assessment value than private properties , and few of us plan to look into the assessed value of this property with all the many thousands of dollars that have been put in over the last five years . _ And we will probably have more on that . He does not wish to extend this any more than the 38 boats he can put . He is serving our community , on Nassau Point . And we approve everything he has done , and we are just opposite him and all his immediate neighbors do too . That' s all I ' ve got to say . SUPERVISOR PELL : Thank you , Mrs . Petrucci . I have watched the progress since Mr. Boos has taken over this property , and I think it ' s a definite credit to the area , and me as a boat owner , I plan on putting a second boat over there. HENRY STEINBRECKER : My name is Henry_ Steinbrecker , and I live on Nassau Point . I understood Mr . Murdock to say that he had an application to bulkhead this property and to dredge it . Now on my way to the point , on my out of the point , for several weeks there was dredging going on the north side of the marina , and there was dredging being done on the west side , and the permit hasn ' t been granted yet , then I say the whole thing is illegal . The Town told me I need the State permit , I need the Army Engineers permit . It took me one year to get those permits . After I received those permits , I came down to the Town , I brought them copies of all my permits . I asked , "What else do I need? " I was told , "Nothing . " From there I proceeded with the work. I worked for one year until I got stopped . And that ' s why I ' m here . The only reason I didn ' t have the permit was because I was told I did not need it. SUPERVISOR PELL : Thank you , Mr . PAINE : And he has built the bulkhead that I understand had filling behind it to increase and enlarge that property . SUPERVISOR PELL : I 'm sure if he was the Building Department would have known . The Building Department will issue and enforce , and make sure he stays in with whatever regulations he has . MR . PAINE : Have you seen that property? SUPERVISOR PELL : Personally myself? MR . My brother and I are in business together , and a few years ago he came out and bought this piece of property and so expressed desire to move out here permanently . He has a boat which everyone knows is moored at the property , for like 10 years . He had it in another marina in the area and he has been coming out here for , I ' d say , a good 12 years and he fully intends using this as a supplemental income and he intends building his house right next door. Now I 'm sure that , anyone at least stop and think about it , he ' s not going to have a boatyard there with five million boats during the winter and live next door when no one else wants to . It is not only a safe anchorage, but a significant convenience to those in the area who use its 'facilities.r-,,Dur'#ig the past year or so since Mr. Boos has owned the premises very significant constructive changes have been made by the building of improved and more extensive floating docks, bulkheads, ramps, etc. , which have not only proven more convenient to those who keep their boats there, but have also improved the appearance of the area. Although one might point out that I have a special interest in the improvements of this property because they serve me as a boating enthusiast, it appears -reasonable to call attention to the fact that in all probability a significant part of the incomeofthe area around about can be attributed directly or indirectly to boaters and those who enjoy the waters of the North Fork. I am eminently aware of the critical importance of our remaining wet- lands in the ecology in general and specifically as they relate to marine and other wild life. Of recent years it appears that their capacity cannot keep up with the attrition of fish and their food chain brought about by- stationery nets and seiners who drag nets -, In the waters of Peconic Bay. I am also aware of the fact that maintenance of -the wetlands is indispensable to the maintenance of the beauty and character of our area. However, I discussed with Mr. Boos this fall his future projects. , He explained to me his intention of extending the bulkhead and ramps' on the western aspect of his lagoon southward from those structures already completed parallel to Skunk Lane to a distance similar to - ' those structures on the eastern aspect. At that time he called my I - A attention to the fact that the grade of the area of his projected construction is already significantly above that of the surrounding meadows and thus could no longer be considered as wetland. Truly, the area involved could not provide sustenance to marine or other wild- life. It appears, in view of this fact, that there cannot reasonably be any ecological objection to his extenblon,;`,of theanticipated structures to the full extent of this elevated area. Were he to request the privilege to fill in more land, I would ,in all probability be one of the first to join in objection. In view of the above statements, I urge that Mr. Boos be allowed to continue his project to the extent described above. I do not believe that in doing so he is violating wetlands. If permit is being sought for a more sizeable excavation than the construction of a private single dock or jetty, then this application must be accompanied by a survey and topographical map certified by a registered land survey or Professional Engineer. The horizontal control of survey shall be based upon an approval lbca,l coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and Geodetic Survey and/or United' States Geological Survey datum. F. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revoked or suspended by a governmental agency.
