1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP becau~
There is a large swamp area on th~s lot~ and it will be impossibel
to locate the dwelling with a required 3gft setback without being
partialy in the pond.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because: Other lots do not have any'
swamp area to contend with.
3. The Variance would obse~e the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because: Thi~ lot i~ of ample size in demention~
and the house location would not interfere with any neighboring ,dwellings.
The developer gave special deed restriction variances with this lot
as it was recognized by all authorities at the time of filing the map
that' this, swampy condition existed.

INSTRUCTIONS
a. This application must be completely filled in by typewriter or in ink and submitted in duplicate to the Building
Inspector.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drown on the diagram which is part of this location.
c. The work coYered by this application may not be commenced before issu.ance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue o Building Permit to the applicant. Such
permit shall be kept on the premises available for inspection throughout the progress of the work.
e. No building shall be occupied or used in whole or in p art for any pui'pose whatever until .a Certificate of Occupancy
shall hove been granted by the Building Inspector.
