I have filed the necessary applications for a DEC and the Corps of Engineers. Some time ago the DEC replied stating that because of their workload the DEC permit for the wetland would not be issued until some time this summer. Accordingly I respectfully request the permit which will expire at the end of May be extended for one full year so that we may accommodate the DEC workload. The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the Town Clerk of written notice from such other governmental or municipal authorities of its refusal or disapproval. COUNCILMAN TOWNSEND: "Notice is hereby given that public hearings will be held by the Town Board of the Town of Southold, at the Southold Town Hall, Main Road, Southold, New York, on May .24, 1983, as follows: 3:42 P.M. - in the matter of the application of James Bitses for a permit under the provisions of the Wetland Ordinance of the Town of Southold to construct a bulkhead, dock, and dredge at the south side of Main Bayview Road, on Corey Creek, Southold, New York. I have an affidavit from the Town Clerk Judith Terry that it was posted on the Town Clerk' s Bulletin Board. I have a letter from the Board of Town Trustees: "Resolved to recommend to -the Southold Town Board approval of the application #136 for a wetland permit submitted by James Bitses with the provision that the retaining wall is placed above the present MHW and that a catwalk goes across the meadow and there is to be no dredging. " I also have a letter from the Conservation Advisory Council : "Resolved to recommend to the Southold Town Board disapproval of the wetland application #136 submitted by James Bitses to erect bulkhead, attach dock and dredge. You've heard the reading of the public notice in the application of James Bitses. At this time does anybody wish to speak in favor of this application of James Bitses? MR. JAMES BITSES, Southold, New York: This is for permission to put a bulkhead on part of my property which has been eroded by the ebb and flow of the tides and I asked the Board of Trustees for permission to build a dock and to put a retaining wall to prevent further erosion and they approved my application and I have a copy of the approval here which I will now submit (Exhibit I) . SUPERVISOR PELL: Thank you. Does anybody else wish to speak in favor of this application of James Bitses? (No response. ) Anybody wish to speak in opposition to? Yes, sir? MR. RALPH CONDIT. Wells Road, Peconic, New York: I understand from the reading of the permit that the Board of Town Trustees approved it with reservations. The bulkhead be placed behind the present high water mark and no dredging. Now, if the Town Board intends to approved the permit in that manner I have no further objection. SUPERVISOR PELL: What you're saying is if we follow the Trustees recommendation? MR. CONDIT: Mr. Bitses is asking to place his bulkhead out into the water below the present high water mark. I question the determination of a survey which he had in his application, his permit application, which showed the high water mark to be at a different location than it actually is and I think it ' s a matter of incurrect survey rather than of erosion. SUPERVISOR PELL: Thank you. MR. BITSES: May I respond? SUPERVISOR PELL: Anybody else wish to speak in this application? MR. STUART HARVEY, Main Bayview Road, Southold, New York: The permit the way it shows on the drawing from the wetlands, is of the proposed one, not what you will actually get and rather than have a lot of questions arise, I think there ought to be an up-to-date in there of what actually is going to happen, not what he has proposed. Because there has been several proposals for bulkheads in this area now. I don' t think we tie anything down there, There ' s a letter, but as this other gentleman says, with the survey a little doubtful I think if it was a drawing to scale with what is actually going in would be a lot clearer. SUPERVISOR PELL: Thank you, Mr. Harvey. Anybody else? Mrs. Oliva? MRS. RUTH OLIVA, President , North Fork Environmental Council : We would agree with the Trustees recommendation for a bulkhead to be placed behind mean high water and no dredging, with a catwalk going across the wetlands. I do believe, being as I was at the Trustees ' meeting, there was a bit of discrepancy about where the mean high Page 3 - Public Hee ig - James Bitses Wetland '�-application water line lies. Mr. Bitses has one survey, but the gentlemen of the Trustees believe that the spot is further away from the one that he has proposed, so I think there should be something done by the Board that somehow--by a survey or something that the mean high water as it now exists should be exactly specified so that bulkhead or retaining wall is definitely placed upland rather than sitting in the water someplace. Thank you. SUPERVISOR PELL: Thank you. Anybody else wish to speak on this? Mr. Bitses. MR. BITSES: There are two accurate surveys by a licensed surveyor, Van Tuyl. The first was made in 1979 and shows one line, the second was made in 1983 and shows considerable erosion, of which I was totally unaware. The Trustees took all this into consideration during the hearings and their recommendations, I believe, are fairly emminent and just and I would ask that the recommendations of the Board of Trustees be read into the record so that the people here who apparently are not aware of these recommendations are apprised of them. Thank you. SUPERVISOR PELL: Thank you. Councilman Nickles will read them. COUNCILMAN NICKLES: "Approved with the provision that the retaining wall does not go into the wetlands and that the dock will be a catwalk over the top of the wetlands, out into the water, there is to be no dredging. Should the dock go further out into the water than the 15 ' shown on the diagram, a fee of . 25 will be levied per sq. ft. , if additional pilings are used a fee of $5. 00 per additional piling will be levied also.
