The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Town Clerk upon receipt by the
Town Clerk of written notice from such other governmental or municipal authorities of its refusal or
disapproval.-
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

SUPERVISOR PELL: This is a hearing on the application of Enconsultants, '
Inc. on behalf of John Bertani for a wetland permit. It will be read
by Councilman Nickles.
COUNCILMAN NICKLES: "Notice is hereby given that public hearings will
be held by the Town Board of the Town of Southold, at the Southold Town
Hall, Main Road, Southold, New York, on October 4 , 1983 , as follows :
3 : 05 P .M. - in the matter of the application of Enconsultants, Inc. ,
on behalf of John Bertani for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, to fll lot with clean sand
and loam to raise homesite to required flood plain elevation, construct
one-family dwelling, pool, decks, drive, sanitary system, timber retain-
ing way plus returns, timber dock consisting of fixed elevated catwalk,
hinged ramp and float, at Oakwood Drive, on Goose Creek, Southold, New
York. -- All persons interested in said matters shall appear at the time
and place above specified and will be given an opportunity to be heard.

We have a letter from Frank Cichanowicz , Chairman of the
Conservation Advisory Council. "Dear Mrs. Terry: Resolved to
recommend to the Southold Town Board approval of Wetland application
#158 submitted by Enconsultants, Inc. , on behalf of John Bertani, to
construct a retaining wall, timber dock and catwalk, Southold.

We have a letter from the Southold Town Board of Trustees to
the Town Clerk, "Dear Mrs. Terry: Transmitted herewith is the
] action taken by the Board of Town- Trustees at a regular meeting
held on September 13 , 1983 : Resolved to recommend to the Southold
Town Board approval of Wetland Application #158 submitted by En-
consultants, Inc. , on behalf of John Bertani, to construct a bulk-
head and dock in Goose Creek, with the provision that the north end
of the bulkhead is placed back 5 ft. and that the dock is placed 40
ft. from the bulkhead. "
That concludes the reading of the public notice.
SUPERVISOR PELL: Thank you. Does anybody wish to speak in favor
of this application of John Bertani? (No response. ) Does anybody
wish to speak in favor of? (No response. ) Does anybody wish to
speak in opposition to this application?
MR. ADAM ZAVESKI, Southold: I have no opposition, I just want to
know if this application is on the new revision or still the old
application, because they were supposed to be set back the bulkhead
and the dock was supposed to be cut back 20 feet.
COUNCILMAN NICKLES : Same application.
TOWN CLERK TERRY: The only one we ever received.
COUNCILMAN NICKLES : I believe it' s the same application. I think
you're referring to probably a Trustees ' meeting where the Trustees
made a recommendation which you just heard me read that certain
requirements that they directed be followed through, which is now
a recommendation to the Town Board and we can either take their
recommendation or not take it.
MR. ZAVESKI : The reason I speak about it because on the old applica-
tion if the dock is extended 60 feet to what the man asks for, that
will cover the channel so the boats the other side of that dock will
not be able to get out because the dock would run almost across the
channel to a flat bar. I notice he had on there that the creek was
270 feet wide, but, gentlemen, we don't have but about 30 ft. of
channel down there. The rest is all flats. At low water we don't
have over 6 inches of water down there. And even at real low water
you have no water on the flats at all, it' s all mud. I don't want
to be cut off so I can' t get out to the Bay.
COUNCILMAN NICKLES : The Trustees recommendation was to set it back
40 feet, which doesn' t---
SUPERVISOR PELL: You want 40 ft. off the 60?
TOWN TRUSTEE PAUL STOUTENBURGH: 40 feet off the bulkhead and move
the bulkhead back on the north end five feet.
SUPERVISOR PELL: Thank you. The Board will consider it. Does
anybody else wish to speak in opposition?

MRS. MARY STIMMEL, Southold: I want to know when they built up the
land, what are they going to do about drainage. Is it going to affect
the land on either side?
SUPERVISOR PELL: I cannot answer that question. Larry?
COUNCILMAN MURDOCK: I think by law they have to retain the drainage
on their own property. I don' t think you're allowed to have water
run off of your property onto your neighborh' s property. Similar to
what the Town must control road run-off, we can't just run water off
of the roads onto your property, so I don't think your neighbor can
either.
SUPERVISOR PELL: Anybody else wish to be heard in opposition to this?

just like to go along with the recommendations proposed by the Trustees.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section _
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that the Southold Town Board, as lead agency for
the action described below, has determined that the project , which
is unlisted- will not have a significant effect on the environment .
DESCRIPTION OF ACTION
Application of Enconsultants, Inc. , on behalf of John Bertani,
for a Wetland Permit to fill lot with clean sand and loam to raise
homesite to required flood plain elevation, construct one-family
dwelling, pool, decks, drive, sanitary system, timber retaining
wall plus returns, timber dock consisting of fixed elevated cat-
walk, hinged ramp and float , at Oakwood Drive, on Goose Creek,
SoutYld Nein York.
e 'project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which indicated
that no significant adverse effect to the environment are likely to
occur should the project be implemented as planned.
Because there has been a response from the Board of Southold
Town Trustees and Southold Town Conservation Advisory Council indicating
that this project would not have a significant effect to the environment.
Because there has been no response in the allotted time from the
New York State Department of Environmental Conservation and the Southold
Town Building Department , it is assumed that there are no objections nor
comments from those agencies.

A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be_ drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.')
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon reques��i� applicant fora permit, may waive in whole or in part,
the provisions of Article II, Sectio subdivisions A and ('where it finds that nature of the
proposed operations are such that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
