SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 25,700 sq. ft. parcel has frontage along Camp Mineola Road and Kraus Road and is improved with a single-family dwelling as shown on the May 7, 1974 amended survey prepared by Roderick VanTuyl, P.C. BASIS OF APPLICATION: Building Department's August 18, 2004 Notice of Disapproval, citing Section 100-244B, in its denial of a building permit to construct additions, with alterations, to the existing dwelling at less than 50 feet from the rear lot line, as shown on the plans dated 8/19/04 prepared by F. Uellendahl, Architect. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a second floor alteration and addition, after demolishing the existing breezeway and garage for additional living space and garage/storage areas with a setback at 15 feet from the westerly lot line as shown on Option A, architectural plans dated 8/19/04. APPLICANTS' REQUEST FOR OPTION B; ADDITIONAL INFORMATION: During the October 21, 2004 public hearing, the applicants discussed design options, and during the hearing, the applicants offered a revised plan (referred as Option B, with highlighted changes in red), prepared by Penny Lumber, moving floor space for the family's living area above the garage addition, thereby reducing the overall footprint of the addition. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 2—November 4, 2004 0 411/ ZBA Ref. 5594—W. and S. Connell CTM Id: 122-4-38 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants' property does not contain a defined side yard under the zoning code definition because of its frontages and three front yards. The code requirements for front yard setbacks are standard at 40 feet and the construction meets or exceeds this minimum setback requirement. The remaining yard gives the appearances of a side yard, however, the code defines this westerly line as a rear lot line. The standard requirement for a rear setback is 50 feet, and a side yard minimum is standard at 15 feet, requested by the applicant in this westerly yard. The addition which is the subject of this variance involves more living and storage space, which can only be located along the west side of the home due to the definition of yard areas and layout of the existing home. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's home is a cape cod style, and expansion is better achieved for expansion along the west side of the home, rather than expanding into the front areas of the home facing a traveled road. 3. The variance granted herein is substantial. The code requires a minimum of 50 feet from the rear yard line, and this westerly addition is a 35 ft. reduction, resulting in total side yards of 22+-feet. 4. The difficulty was self-created. Although the addition was designed with a plan that does not meet the setback requirement of the code, the difficulty is related to the need for space within the home by their family members. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Tortora, and duly carried, to GRANT the variance as applied for. Since the property is relatively flat and features a variety of large trees the character of the neighborhood will not be adversely affected.The proposed construction will not block neighbors'views. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance, because: Due to the location of the property at the crossroads of two public roads and a right of way in the back of the lot,the zoning dictates three front yards at 40 feet each and one rear yard at 50 feet.The proposed addition of a living room and attached garage with bonus room can only be located in the rear yard section of the lot which requires a setback variance. A 15 foot setback from the property line can be guaranteed. We have followed the proper process, adhered to your stringent , guidelines, satisfied your requests and spent a considerable amount of time and money to prepare for expanding our home to make it our permanent residence. We look forward to working with you to grant our request for this variance in a timely manner before the weather becomes an obstacle in our plans for our family. At the hearing there was one particular point made by one of the board members that is absolutely key on granting our family the variance that is being requested. We live on a corner lot at 550 Kraus Road. Unfortunately for us,because of a right of way behind us, (which we have rights to) we have three front yards. The zoning board has determined that the fourth yard is a back yard and that severely limits our options for expansion. If you look at the facts, our address is 550 Kraus Road and that is where our driveway and garage are. Further, our driveway is parallel to the Murphy's (next store) driveway. The yard that abuts our property on the Murphy's side is the Murphy's SIDE yard. It seems that logic would indicate that our backyard should be a SIDE yard. (CONSISTENT with Murphy's Property) If this were true, we would not require a zoning variance in order to submit our plans to the Building department and be able to move forward. This should be key information taken into consideration when making your decision regarding our request. With the regards to our neighbors that attended the hearing, on Saturday morning October `x° 23 I personally took the time to meet with the Kenny's and the Murphy's to review our plans. The Kenny's never picked up their certified letter and the Murphy's had lost theirs. We provided them with the materials that were sent to them and a drawing that made it easy for them to see the addition we were planning and where it was going. We also mentioned that we looked at expanding towards the Kenny's but that would not allow us to put on a garage and presented privacy issues for all three parties. We definitely need a garage for our cars as well as bikes, lawnmowers etc. It was clear at the hearing that the Kenny's misunderstood what we were attempting to do with the addition to our home. When we met with Phyllis Kenny, she made it clear that the primary reason for her objections stemmed from a 5-year-old grudge she was carrying regarding an encounter we had when their Rottweiler attacked our children and the Southold police had to get involved. The Kenny's issue regarding our addition is not about what we need to do to make our home more comfortable for our family,but about issues that we have had with their dog in the past. In all fairness to our family,the Kenny's'should not be allowed to delay our plans any longer. The bottom line here is that the Murphy's do not have an issue with our plans and said they would write a letter to the Zoning Board indicating their approval of our addition. As for the Kenny's, the addition will be no closer to their property than our home is now and it will have no impact on their views. When all is said and done, I guess somebody might say well why not sell your home and move. Well, I grew up in this neighborhood, babysat in this home and my elderly parents still live on Ole Jule Lane and quite frankly as the oldest of eight children I feel somewhat responsible for helping them as they go through the aging process. So to be perfectly honest with the board,moving because this has become such a huge ordeal is not an option for us. We want to be here and as taxpayers we should be able to make our home be big enough that we can live comfortably with our four children. The board should welcome all families that want to come back to live,work and enjoy this beautiful area. Our children are well situated in the schools and local sports programs and are excited abput the plans for a comfortable home. We urge you all to consider this request and do not delay the process any longer, as the time for breaking ground is critical in our plans. Please vote yes for granting this variance.
