PROPERTY FACTS/DESCRIPTION: The applicants' 29,142 sq. ft. parcel has 90 ft. along Clearview Avenue and 337.85 feet along Gagen's Landing Road in Southold. The property is improved with a single-family dwelling with garage, under construction (building permit#30219-Z). BASIS OF APPLICATION: Building Department's August 5, 2004 Notice of Disapproval, amended August 26, 2004, citing Section 100-244B in its denial of a building permit request for a proposed addition with a front yard setback at less than 40 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to add four feet to the existing four ft. porch, resulting in a 36' setback from the westerly property line, as shown on the February 21, 2001 survey, amended August 24, 2004, by Joseph A. Ingegno, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The new dwelling was elevated to meet the requirements of the Flood Elevation Management Law. The property is a corner lot with frontage along two streets and restricted to building in other areas due to established wetlands. The existing setback is 40 feet, and the 4 ft. 3 in. setback reduction relative to the raised open deck, and upper level deck with roof, would result in a 36+- ft. setback. The parcel is 90 feet wide and 337 feet long. Page 2—November 4, 2004 File No. 5602—James and Eileen Buglion CTM Id: 70-10-29.1 There is no other design or yard area available that would allow an 8 ft. wide open porch/deck by adding a 4 ft. 3" extension. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The benefit to the property owner is not available in any other design or location and is related to safety reasons and appearance. 3. The variance granted herein is the maximum the board would approve. The request is for a 4 ft. 3 in. reduction as an addition to the 4 ft. wide open porch. The relief granted is 10.7% less than the 40 ft. minimum code requirement. 4. The difficulty was not self-created and is related to the 90 ft. width of the lot and limited building area. 5. No evidence has been submitted to suggest that a minor variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a small open porch/deck extension, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the February 21, 2001 survey, amended August 24, 2004, by Joseph A. Ingegno, SUBJECT TO THE FOLLOWING CONDITION: That the raised 40' x 18' (40' + 12') open porch/deck area shall remain open on three sides and not be enclosed (the upper deck covered with a roof), as shown on the applicant's sketch of the south side view porch elevation. • This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Gentle- men, lasically what happened here is my client entered into a contract to purchase this property. The Contract, the des- cription of which was one that was basically north by Clear- view, west by Bagen's Landing, east by Gagen, and south by Goose Creek, it was upon, the time he entered into the con- tract he thought he was purchasing a piece, of property of approximately 119 feet in width along wit . a 119 feet of waterfront.. _ It was only after the survey came forth that he learned aboutAheHgtgefof the property, and it' s based upon that he. always had in mind to retire out here and-to build a house, and the house he has in mind happens to be 55 feet ,3 wide. He ..wants to be able to sit it on the property and ;be o able to look out at the water which is the logi6A1 place to put it. Because,..this_..ls.:,a. :co.rsaer lot and its size and the ,c width of the lot, he would be required to have on Gagen' s Landing Road a 35-foot setback, or a 40-foot wide house. My clients request that he be able to have a 55-foot wick house, and ask the Board under the circumstances the natur.e of the o beast here? sort of speak, the lot that was created many many years ago, with the division of' property prior to zoning, that the application be granted. This is not a filed map, H it is something that has been cut up here and there throughout the years. MR. DOUGLASS : These two lots were granted. by the Board of Appeals on May 9, 1957 . MR. BRUER: Right, just about zoning. MR. DOUGLASS: At the start of Zoning. MR. BRUER: Right, MR. TUTHILL: You might be able to have a house that wide if you-- MR. BRUER: I mean, back at that time you only required a quarter of an acre for a lot. And . this was certainly much more than was necessary at that time; however, it doesn't come up to. standards today. In all due respect to Mr. Bruer' s appeal, we checked, and these lots were set up on May 9, 1957 by the Zoning Board of Appeals on special exception back then, on a variance back then, because back then they required a 100-feet, 125 .feet of frontage, and so they were set up way back there, We have another lot adjoining this one that's identical in width but is not a corner lot, so it is definitely going to be influenced by what happens on this lot: We felt after .checking it over that there is not sufficient hardship in the amount of land that he has to, that he has to establish this type of setback;if he changes his swing of his house or his style of his house, he will be able to get .the setback that he needs. And under those circumstances., if anybody would care to make a motion that it be disallowed with the suggestion that he change the position of his house. MR. TUTHILL: _ Well, I. can_.symphathiz.e with the man. Think- ing he bought one thing and getting something else, I guess that could have been prevented but he wound up with it, and it seems,.to me he' s got to tailor his house to the lot rather than try to tailor lot to the house, and I 'll have to move that it bet-disallowed. z O After investigation and inspection, the Board finds that the applicant is requesting a variance for insufficient front- b yard setback of 20 feet. This seems impractical due to the 'c reason that a house of the same proposed size could be built on this parcel without requiring a variance. The 20-foot set- back would not be within the pattern established within the neighborhood. N The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hard- ship; the hardship created is not .unique and would not be shared by all the properties alike in the immediate vicinity of the property and in the same use district; and the variance will change the character of the neighborhood and will not observe the , spirit of the Ordinance. Mr. Chairman, . Members of the Board, as you can see from the survey, does everybody have a survey there? MR:. DOUGLASS: No, we only have one. MR. BRUER: What we basically would like is a variance of the 50-foot setback requirement on Gagen's Landing Road to 35 feet. The house., the proposed house would be situated in such a way that it would have to be pretty much up where it is due to the elevations of this particular lot, and the problems that the lot has other than this problem. We are required to sit back 50 feet from Clearview Avenue and we would like the Board to grant us a variance of the 50 foot requirement on Gagen's Landing Road., pointing out that the lot is approximately 90 feet wide and to put a house in this area on this particular lot, on waterfront there, not that you should give a great deal of consideration for waterfront, but the value of the type of houses and the value of lots there. If you want to put up a nice house.; and I think in all fairness to the applican 7. we would respectfully request a 35-foot sideyard requirement on Gagen' s Landing from the required 50. Frontyard, excuse me. It's two front yards and that' s why it' s unique. The property adjoining it, I guess, to the east is 90 foot wide, I think and would not be bothered by this burden because it',s not on the road.
