PROPERTY FACTS/DESCRIPTION: The applicant's 18,905 sq. ft. parcel has 50 ft. frontage along the east side of Bay Shore Road, 322.18 ft. along the northerly side line, 344.03 feet along the south side line, and 54.57 feet along Pipes Cove. The property is improved with an one-story, single- family dwelling with deck as shown on the September 18, 2002 survey prepared by Joseph A. Ingegno, L.S. The existing dwelling is 52 feet to the bulkhead and has side yards at 8.9 feet and total side yard of 17.9 feet. BASIS OF APPLICATION: Building Department's March 4, 2004 Notice of Disapproval, amended March 25, 2004, citing Section 100-242A, in its denial of a building permit to construct a new single- family dwelling, after removal of the existing dwelling. The reasons stated in the Notice of Disapproval are that the dwelling will be less than 75 feet from the existing wood bulkhead, less than 10 feet in a single side yard, less than 15 feet on the opposite side, and for a total side yard area at less than 25 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time the Architect for the applicants requested an adjournment for submission of information relative to roof and elevation of the new dwelling. The September 14, 2004 reconvened, at which time • written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to demolish the existing dwelling. On the 2/26/04 revised architectural site plan, applicants propose to remove the existing home, and replace it with a new single-family, one and one-half story dwelling, adding an 8 ft. wood deck at the rear of the dwelling and adjusting the angles of the foundation. In applicant's original request shown on the 3/22/04 schematic diagram, the proposed height was proposed at 30'7" to the top of the ridge, and 24-4'/2 ft. to the mid-point of the roof viewing the south elevation. Page 2—November 4,2004 File No 5516—John and Marion Branavold CTM Id: 53-4-10 ADDITIONAL INFORMATION/AMENDED RELIEF: On July 19, 2004, the applicants submitted three schematic designs of the north, east and west elevations and partial site plan with first and second floor living areas. During the September 14, 2004 public hearing, the architect furnished a cardboard model of the proposed building for visualization and discussion. The height was lowered as revised and shown on the 7/13/04 schematic diagram to 28 feet to the ridge. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties. The applicant's house is one of few single-story houses left among the larger two-story house in the neighborhood along Bay Shore Road in Greenport. The proposed new 1-1/2 story dwelling construction measures 60 feet x 27.9 feet with a 28 ft. height to the ridge, as shown on construction diagrams prepared 7/13/04 schematic diagram, prepared by Meryl Kramer, Architect. After adjusting the angles of the foundation, the pre-existing side yard from the north property line, plus small deck, at nine feet will be maintained, and the pre-existing side yard from the south property line at 8.9 feet will remain the same. Also the pre-existing 44.5 feet from the bulkhead will remain the same after construction, as noted on the July 13, 2004 site plan prepared by Meryl Kramer Architect. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicants to pursue, other than an area variance. Thislot is particularly long and narrow, which leaves the side yard with little or no room for expansion. The construction proposed is reasonable and logical. 3. The requested area variances are substantial and represent a 30.5 ft. reduction from the current code requirement of 75 feet from the bulkhead. The side yard variances are not substantial and represent minimal change from the pre-existing location of the dwelling and applicant's plan to keep the foundation in place and adjust the angles to square off the dwelling to the property. 4. The difficulty was self-created. While the difficulties are related to the nonconforming size of the property and location of the existing foundation, the plan does not conform to the current Town Code requirements and is designed to meet the owners' needs for additional living floor areas. 5. No evidence has been submitted to suggest that the variance will have an adverse impact on the physical condition of the neighborhood. 6. There is no evidence that the grant of the variances will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. q . This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Article XXIV, Section 100-244, states that, on non-conforming lots less than 20,000 square feet in total size, are required to have a minimum single side yard setback of 10 feet and a total side yard setback of 25 feet. The existing single-family dwelling has a single side yard setback of 8.9 feet and a total side yard setback of 17.9, which will be matched by the new construction. Pursuant to the ZBA's interpretation in Walz (#939), such additions and alterations will thus constitute an increase in the degree of nonconformance. 5 03 9 In addition, the proposed construction is not permitted pursuant to Article XXIII, Section 100- 239.4.B., which states, "All buildings located on lots upon which a bulkhead, concrete wall, riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back no less than 75 feet from the bulkhead." The existing single family dwelling notes a setback of 52 feet from the existing wood bulkhead. 'Following the proposed construction, the setback will be+/- 44 feet. Total lot coverage, following construction, will be+/- 11 percent. The existing construction is yen, substandard. In + 25 order to bring the building up to code, energy ._ode, structural codes, we made a decision to. September 14 , 2004 i 31 1 2 rebuild the entire house; The owner is trying to stay within the existing setback violations, which 3 is 13 . 5 and nine feet , so we' re just trying tr straighten out and go parallel to the property 4 lines to maximize the square footage. So the deck and the two side yards we' re not encroaching any 5 farther than the property already is as it stands now. c.. We have designed the house so that the second floor consists of dormers so as to minimize 7 the height on the side yard so we have a nine fOot plate height on this first floor, then the roof 8' slopes up and the second floor spaces are just dormers sitting on that, so you don' t have a full 9 two-story wall anywhere along the side . CHAIRWOMAN OLIVA: You' re not demolishing 10 the house? MS . KRAMER: We' re keeping the foundation 11 as much as' possible, but anything that can be saved will, but a lot of times the contractor 12 will , by the time they' re finished taking down what ' s not needed, you might as well start over 13 gain. CHAIRWOMAN OLIVA: Jerry? 14 BOARD MEMBER GOEHRINGER: I have been to the site, I understand what you' re doing, I really 15 don' t know how to evaluate this one . I have to tell you again, this is not a sarcastic statement , 16 ' but I think again, we' re going to have to require renderings of these paper mache models because we 17 are just unable to visualize, Meryl, the impact of what these houses are going to do on these lots, 19 particularly these smaller lots . Either that or some sort of physical view, either done b1 camera 19 computer, because it is very, ery difficult to imagine what this house looks like; I know what it 20 looks like now, but in its future sense . I do applaud the fact that you' re not changing the ,21 footprint of— the house in any way, but the impact , and I do appreciate the dormer aspect rather than raising the roof to a full two and a half stories, so to speak, but the impact is very difficult to 2.3 visualiz '. • MS. KRAMER: Is it the hip roofs that are 24 posing a problem in terms of visualizing in three dimension's? 25 BOARD MEMBER GOEHRINGEP.: I think it ' s the ability to see what the height on the existing September 14 ; 2004 32 1 2 structure is going to look like, and how it may impact not only the two neighbors on either side but -•isual impact from the road. This appears to he a relatively modest plan that you' re doing from 4 the outset , but I' m certainly going to qo back after you' ve done it , and you' tr= done many of 5 these plans, and we kid around with you calling you the Bay Shore Road Gal, well, architect , , 6 because you are the Bay Shore Road gal, there' s no question about it , but in general , it ' s difficult 7 to show the impact . It really is . MS . KRAMER: Okay. 8 BOARD MEMBER GOEHRINGER: That ' s not a ' . criticism of you or your work. .� MS . KRAMER: I understand it' s complicated with the idea of the hip roof and then adding 10 dormers to that in order to minimize the impact _ BOARD MEMBER GOEHRINGER: Even a roof line 11 .cut down would be interesting to see because then we would be able to notice that .. 12 MS . KRAMER: Do you mean building sections? 13 BOARD MEMBER GOEHRINGER: No. From a cardboard rendering? 14 MS . KRAMER: We can do either a model or maybe a little 3 -D. I don' t know how to do a 3 -D 15 rendering, but the woman who works with me does . So I ' ll talk to her and see if we can get that , 'so 16 one or the` other. CHAIRWOMAN OLIVA: I do agree it ' s 17 difficult to imagine what it' s going to look like . 18 BOARD MEMBER GOEHRINGER: We sit here in a room and superimplant in our mind what we had 19 seen, and it ' s a very nice piece of property. It' s not a terribly large piece of property, but 20 that ' s the nature of that area, there' s no question about it , but it ' s just very difficult . 21 MS . KRAMER: Okay. I think we can do that . And maybe what I could also do is look 22 around at some other similar roof configurations in the areas because it is a basic hip with some 23 _dormers on top, so I ' ll take some pictures so that might help you too to visualize that from the 24 road. BOARD MEMBER GOEHRINGER: We had a 25 tremendous problem with a similar application except the roof line appeared to be much higher on September 14 , 2004 ` - •. 33 - 1 2 F:uch Lane , and we had some great, great opposition on that one, and it was unfortunate, we had 3 - ffered an alternate plan and the people actually became so upset with the neighbors' concerns that 4 they withdrew the application and that is not the intent, my intent . 5 MS. KRAMER: We still have a letter from one of the adjacent property owners in favor pf G the project . BOARD MEMBER GOEHRINGER: That ' s never 7 been my intent to do that , to discourage . It ' s only been to add or possibly lessen the impact. 8 - But in this particular case, it' s difficult to visualize it . Again, it ' s no reflecticn on your 9 work because you do very, very nice things . It' s just the inability to- perceive it on how it' s 10 going to look. MS . I'm John Brandvold, and Meryl has worked with me very much, 10 ' and I just thought since I came to see .Jou, having served ten years on a zoning appeals board in my 11 village in Manhasset , Plandome Manor, I appreciate all the work you people do, and I know these 12 hearings take longer than you thought . I am always appalled at how much time it does take to 13 go through and how diligent you all are. I just wanted to comment . You commented 14 about how the house might look, and I ' ll have Meryl do a small model of the house, and George 15 Braun, my next door neighbor who wrote the letter, his house , he received a variance I think about ' 16 fsui years ago and if you visited the lot that very, very tall house , and I don' t know who 17 approved that, but that' s kind of strange , but we' re ver_;, very close friends, I ' m close friends 18 with all the neighbors . I tried to minimize the plan working with Meryl, and we' re looking for a 19 cottage design. We' re hoping to eventually move •_ut here permanently and we wanted to have enough _ 20 space so the grandchildren can come out . It ' s been a hardship . I looked at trying to build onto 21 the existing structure, and I ' m in construction. The construction that was used in the ' 40s , all of 22 the timber is undersized. The floor joists are undersized; there ' s nothing in the house that 23 could support any addition going up the second floor; that was what brought me back. I had 24 ' originally wanted 30 feet across and realized ' after speaking to the Building Department , I said 25 the easiest way is to just lea-_ the setbacks the wa- they are, which was only asking for a foot and ,, September 14 , 2004 • ` • 36 1 a half on the south side and one foot on the north side . So I ' m trying to comply as much as I can to make this an easy situation for you to hopefully appro-:e,' but I ' 11 have Meryl do the little box 4 plan . But I was going to mention that there is a house on Bay Shore Road that just sold not too S long ago. It ' s 1385 Eay Shore Road. If you drive down Eay Shore Road and look at 1385 , it is nearly 6 the identical plan that we chose . We didn' t chose it - - I happened to notice after we did our wdrk 7 that this house is almost identical . So that house is very representative of having a garage on K ' the left and dormers On the south and the north side, and the width of the house is the same as mine would be with the exception that the garage is offset . So it gives the appearance of a 10 slightly wider house . But it gives the same appearance in terms of the hip roof , there is a 11 little hip dormer facing the road, and there is a small dormer on both sides north and south . - And I 12 thought I ' d mention,, if you drive down that ' s a brick house, I 'm not going to build brick . It ' s 13 almost identical in the design, and it ' s a house that you can see angular, you can see it from both 14 sides . So you can kind of see how those dormers would look . 15 CHAIRWOMAN OLIVA: Is there anyone else that would like to speak? 16 MS. PECORARO : My name is Louise Pecoraro. I was dust curious, is there a height requirement 17 that is allowable? CHAIRWOMAN OLIVA: Yes, maximum height is 18 35 to the ridge when it meets code . As you can see from the application, the 11 Cowans did design a house, and got permits for house that met all the code criteria, all the 12 criteria of all the regulatory agencies . They had the foundation poured pursuant to the building • 13 permit. And when the building inspector came out • to inspect it, he determined for the first time 14 that he thought there might be a problem with the flood plain, and so the Cowans hired an 15 environmental consultant, who, in addressing the flood plain question, had another surveyor, 15 Mr. Ingegno, prepare a survey on the flood plain issues. Well, it turned out that the flood plain 17 was not a problem and-Mr. Anderson has since ' gotten a FEMA determination on that. However, 18 we' re here because 'it showed the eight and-a-half feet at the rear corner as insufficient . 19 We compute that approximately as 4.8 to 50 • square feet on each floor as over the line, and 20 it' s about 1:4 percent of the total volume of the house . It was certainly inadvertent . There is no 21 one that would rather not be here than the Cowans, and we did try to contact the neighbors before the 22 hearing just to make sure 'they .didn' t have any questions or concerns, and some he was able to 23 reach and some he wasn' t.
