ARMSTRONG Property Location: 2-1-11.3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 3.15 acre parcel is located on the north side of Clay Point Road, on Fishers Island, and is improved with remains from a fire-damaged dwelling and two accessory structures (building and tennis court) as shown on the 2/21/04 survey prepared by Richard H. Strouse. BASIS OF APPLICATION: Building Department's March 19, 2004, Notice of Disapproval, amended May 14, 2004, citing Section 100-239.4A.1 in its denial of a building permit to construct a new dwelling, replacing the existing fire-damaged building, with a setback of less than 100 feet from the top of the bluff or bank landward of the sound. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new dwelling with new porch in the same footprint of the previous 1927 dwelling which was destroyed by fire. The new construction will be at least 79+- feet from the top of the bank and greater than 100 feet to the approximate high water of the Fishers Island Sound as shown on the 2/21/04 survey, updpted 5/17/04 to show additions, prepared by Richard H. Strouse. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new dwelling is virtually being located in the footprint of the fire-damaged dwelling that existed since 1927. It would be very costly Page 2—September 7, 26o-r • File No. 5577—Whitney Armstrong CTM Id:2-1-11.3 to relocate the extensive plantings or to move the location of the structure to meet the requirements of Section 100-239.4A.1. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The landscape is extensive with magnificent gardens, and the property's topography from the top of the bank is gently rolling with an elevation of approximately 22 feet above mean sea level. The applicant would not be requesting the variance if the previously nonconforming dwelling was not destroyed by fire. 3. The variance granted herein is not substantial. The location of the dwelling will remain the same as it has since 1927. 4. The difficulty was not self-created. The applicant needs to rebuild a dwelling that was fire- damaged, and deemed nonconforming in the same footprint under the current Town Code requirement pertaining to setbacks from the top of the Fishers Island Sound bank or bluff. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is extensively landscaped with gardens and gently rolling topography, and the new dwelling will be in the same location as the previous fire-damaged dwelling. Also, a Board of Town Trustees authorization was issued by letter dated July 12, 2004. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Orlando, and duly carried, to GRANT the variance as applied for, as shown on the 2/21/04 survey prepared by Richard H. Strouse, updated 5/17/04 to show additions, and site plan with construction diagrams prepared 4/2/03 by BD Design Inc., updated 6/14/04. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Since the proposed rebuilding is in virtually the same footprint there will be no undesirable change to the residential character of the neighborhood or a detriment to neighboring properties . (4) CONTINUED. erosion since the erection of the house in the 1927 time frame . As shown in the attached photographs the toe of the bank in the beach area is protected by large rocks and the bank rises gently to the lawn area in front of the former house. (6) CONTINUED. of the old house to the top of the bank is 79± feet . As previously stated the bank on the property which faces on Fishers Island Sound is relatively stable in that the top of the bank has remained virtually in the same position since the house was originally constructed in the 1927 era. The porch which was on the northwest corner of the house is 79+ feet from the top of the bank. On the northeasterly side the residence was 128± feet at the nearest point from the ordinary high water. The property consists of 3 . 15± acres and is generally described as gently rolling as it has an elevation of approximately 22 feet above mean sea level from the top of the bank. The northwesterly side of the property is slightly rolling ending up at Clay Point Road with an elevation of approximately 24 feet . On the northeasterly side of the property the top of the bank is approximately 14 feet above mean sea level and generally slopes upward to about 24 feet of elevation at the house foundation. On the easterly side it is generally rolling knolls and at Clay Point Road has an elevation of 23 . 9 feet . As seen from walking the property or looking at the photographs and survey which are attached hereto, the existing location of the house on the property is still the optimum spot as it was in 1927 . Due to the fact that the bank area is fairly stable and protected by boulders and vegetation there has been little erosion. The result being to relocate the rebuilt residence in the original footprint at 79± feet is reasonable because of the Southold Town Zoning Ordinance requirement of a 100 foot setback. Considering the balancing tests of Town Law 267 and the fact that the house was lost by the unfortunate fire, it is respectfully submitted the Board of Appeals grant a variance for the house to be built utilizing its present footprint which has existed since 1927 . Strouse last revised May 17, 2004 and determined the proposed reconstruction of the existing dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without a permit.
