The property is improved with a single-family, two-story frame house, accessory sheds, barn, and horse stable, as shown on the April 9, 2004 site plan, amended June 24, 2004 by Thomas C. Wolpert, P.E. APPLICANT'S REQUEST/BASIS OF APPLICATION: A Special Exception is requested under 100-316(12) for a proposed riding academy/stable-for-hire in this R-80 Residential Zone District. Parking and screening shall be as determined under the Zoning Code site plan provisions, considered under separate jurisdiction determined by the Southold Town Planning Board. STANDARDS/REASONS FOR BOARD ACTION: After review of the requirements set forth pursuant to Chapter 100 governing a horse riding academy uses by Special Exception review, and on the basis of testimony presented and personal inspection, the Board finds: The owners plan to board and stable horses for-hire, to breed, to offer riding lessons, to provide a viewing room and indoor riding rink inside the barn for riding shows, clinics and educational programs. Most of these activities will be conducted inside the stable (barn) and the indoor space will provide a safe and comfortable area for the exercising of the horses and learning to ride. 1. In this review the Board determines that this proposed use is in harmony with the zoning ordinance and will not adversely affect the neighborhood when meeting the code requirements. A horse riding academy is permitted in this Agricultural-Conservation (AC) Zone District under Section 100-316(12) of the Town Zoning Code, subject to special exception authorization of the Zoning Board of Appeals. The property contains 51.75 acres and consists of open land with the owners' house and existing barns. The nearest street is 160 feet north of the new riding rink/horse barn with 4,143 sq. ft. addition. The building will be at least 92 feet from any other property or adjacent residence. In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and finds that: (A) The proposed use will be primarily conducted inside the barn and will not interfere with the orderly and reasonable use of the other uses in the district. The parcel is over 50-acres, improved with a house that will continue to be occupied as a residence. Even if the house were separated in the future from the riding academy, there will be a minimum land area of 10 acres applied to this use, and both parcels will be in the control of the same owner. The barn for this use is located more than 160 feet from Old Main Road. No evidence was submitted to indicate that the proposed riding academy will prevent the orderly and reasonable use of other uses in the district. (B) This use will not prevent orderly and reasonable use of permitted or legally established uses in this zone district or adjacent use district. C) The safety, health, welfare, comfort, convenience, and the order of the town will not be adversely affected by the proposed use and its location. D) The use will be in harmony with and will promote the general purposes and intent of the code. E) The use is compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regarding to visibility, scale and overall appearance. F) The structures, equipment and material will be accessible for emergency protection. G) The proposed commercial use as proposed with the barn are not significantly different than other commercial horse farms that exist in the town. Generally, other horse farms offer the boarding of horses for income purposes, horse riding lessons, and other equestrian-related activities which are similar to the use proposed by the applicant. In making this determination, the Board has also reviewed other matters under Section 100-264, and finds that no adverse conditions will result from this authorization: A. There will be no adverse change in the character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of such permitted uses. A horse riding academy is a code-authorized use in this R-80 Zone District, with a Special Exception determination from the Board of Appeals, site plan approval from the Planning Board, and approvals from the Building Department. C. The location of the use, as requested, will not cause traffic congestion on public streets, highways and sidewalks. D. There is availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent (whether liquid, solid, gaseous or otherwise) as a result of this use. E. The use or the materials incidental thereto will not give off obnoxious gases, odors, smoke or soot. The applicant assures that there will be no stockpiling, and that there will be no outside storage of manure that would be adverse to nearby adjacent properties. F. The use will not cause disturbing emissions of electrical discharges, dust, light, vibration or noise. G. The operations as a riding academy will not cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, existing or proposed by the town or by other competent governmental agencies. H. Off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate is subject to review and approval of the Southold Town Planning Board under the site plan regulations. I. There is no evidence to show that there will be any hazard to life, limb or property because of fire, flood, erosion or panic by reason of or as a result of the use or by the building to be used, or by the accessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus. There will not be undue concentration or assemblage of persons upon such plot in the operations as a riding academy and related activities. J. The use and the building location will not cause an overcrowding of land or undue concentration of population. K. The plot area has been deemed sufficient, appropriate and adequate for this use. L. The use is not unreasonably near a school, theater, recreational area or other place of public assembly. Page 4—August 2,2004 ZBA SE No.5552—S. Lomangino 122-7-8.6 at Mattituck M. The site is suitable for a riding academy and stable and related accessory uses considering its size and the character of the neighborhood. N. Concerns with respect to outside storage of debris has been addressed as a condition of this Special Exception. No other evidence has been presented to show that there would be any detrimental impact to adjacent properties and land uses. O. Adequate provision has been made for the collection and disposal of storm-water runoff, sewage, refuse, solid, and liquid waste. There will be no gaseous waste generated from this project. P. The natural characteristics of the site are such that the proposed use may be introduced without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Goehringer, and duly carried, to GRANT the Special Exception, as applied for and shown on the April 9, 2004 site plan, amended June 24, 2004 by Thomas C. Wolpert, P.E., SUBJECT TO THE FOLLOWING CONDITIONS: 1. No stockpiling of manure within 75 feet of the boundary (area near Bray Avenue.) 2. If the property is divided in the future which will result in placement of the existing house separately from this use, the use granted with this Special Exception (riding academy use) must be on a parcel containing at least 10 acres in size. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. THAT THE USE WILL NOT PREVENT THE ORDERLY AND REASONABLE FUSE OF ADJACENT PROPERTIES OR OF PROPERTIES IN ADJACENT USE DISTRICTS: The property contains 51.75 acres; consisting of open land with the owner's house and existing smaller barns. The new barn(Stable and Riding rink) fronts Old Main Road and is located more than 160 feet off of the road. The property is surrounded by preserved lands to the south. The owner maintains her residence on the property and is in the process of relocating full time to the house on the parcel. The riding stable/barn was originally constructed for the owner's personal use, however, local horse owners and riders have requested access to the barns to exercise their horses, to stable their horses in a beautiful spacious building, and to enjoy the 51 acres of open lands for riding. The Boarding of horses and the customary uses associated with boarding are agricultural uses protected in the Ag &Markets Law. The uses proposed in this Special Permit are standard practices in most of the larger horse farms in the Town of Southold and else ware, the.building department had threatened prosecution of the zoning code if the owner rented the barn to other equestrian owners despite boarding of horses is a customary and accessory commercial use to a horse farm. As a"riding academy and stable"in addition to the ordinary and customary practices of a horse farm, the owner will conduct riding clinics and educational programs. For example, the owner has investigated riding programs for handicap individuals. Similar to Hedgewood Farm (Mattituck), and Bittner's Farm (Southold) the owner will encourage private riding lessons, and educational clinics. Horse Boarding will be conducted on the premises and is a specifically authorized agricultural use. Along with horse boarding, the horses will be exercised and trained in the indoor riding rink. Due to the liability of an equestrian center, the owner wishes to reserve the right to set - off the stable and riding academy from the residence ( subject to Planning Board review and approval) at some.later date. The decision on the Special Permit should not preclude this option. �5, B. THAT THE USE WILL NOT PREVENT THE ORDERLY AND REASONABLE USE OF PERMITTED OR LEGALLY ESTABLISHED USES IN THE DISTRICT WHEREIN THE PROPOSED USE IS TO BE LOCATED OR ADJACENT USE DISTRICTS: The indoor Riding Rink inside the barn provides a safe and comfortable space for exercising the horse and learning to ride. A viewing room is proposed for the family of the riders to sit,protected from the horses,while viewing the riders. The proposed use will be primarily conducted inside the barn and will not interfere with the orderly and reasonable use of other uses in the district. The parcel is over 50 acres and , even if split off from the house parcel, will be in the control of thesameowner. All the uses intended for this barn are customary and accessory uses of a horse farm, of which there are many in the Town of Southold, and all the planned activities are consistent with the agricultural use. Therefore, the proposed"riding academy"will not prevent the orderly and reasonable use of other uses in the district. C. THAT THE SAFETY, THE HEALTH, THE WELFARE, THE COMFORT, THE CONVENIENCE OR THE ORDER OF THE TOWN WILL NOT BE ADVERSELY AFFECTED BYrTHE PROPOSED USE AND ITS LOCATION This community wishes to preserve agriculture of which a Horse Farm is specifically recognized underthe Agriculture& Markets Law: The proposed"commercial use"of the barn is not significantly different than the other horse farms in existence throughout the town. Moreover, the other horse farms offer boarding for pay, horse riding lessons, and do all other manner of equestrian activities which are similarly proposed by the applicant. D. THAT THE USE WILL BE IN HARMONY WITH AND PROMOTE THE GENERAL PURPOSES AND INTENT OF THIS CHAPTER As was previously stated, the horse farm and equestrian stable &riding rink proposed encourages and promotes agriculture. The Equestrian community is a significant segment of the agricultural community and deserving of promotion and support. The proposed riding academy is a private facility which promotes an agricultural use. E. THAT THE USE WILL BE COMPATIBLE WITH ITS SURROUNDINGS AND WITH THE CHARACTER OF THE NEIGHBORHOOD AND OF THE COMMUNITY IN GENERAL, PARTICULARLY WITH REGARD TO VISIBILITY, SCALE AND OVERALL APPEARANCE The appearance of the structure and the use will not change as a result of the Special Permit approval. An agricultural use is intended to make money- all the local horse farms board horses, give lessons, breed horses and conduct periodic educational clinics. The building inspector has directed the owner to obtain a Special Permit. The Riding Academy is private,not open to the general public, and limited to equestrian activities: private horse shows and educational clinics. All these uses are no different then Vineyards selling from Wineries, and farmers selling at'stands throughout the season. F. THAT ALL PROPOSED STRUCTURES, EQUIPMENT AND MATERIAL SHALL BE READILY ACCESSIBLE FOR FIRE & POLICE PROTECTION The barn is designed with consideration for easy emergency access. The site plan will be reviewed and approved by the Planning Board.
