SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 15,805 sq. ft. parcel has 71.50 lin. ft. along Sound Avenue (a/k/a North Road) in Mattituck. The property is improved with an existing barn and one-story concrete block garage, as shown on the March 17, 2004 survey prepared by Anthony Abruzzo, L.S. BASIS OF APPLICATION: Request for a Variance and/or Interpretation of Section 100-242A, reversal of the Building Inspector's June 17, 2004 Notice of Disapproval, concerning a proposed dwelling at 35'from an unimproved dirt road (referred to as Old Neck Road or Shirly Road), adding a breezeway addition to the existing one-story garage construction. The breezeway addition will be greater than 35 feet from any front line, and no new construction is proposed less than 35 feet from either front yard property line, although the existing garage building has a nonconforming setback 33'9"from the westerly lot line (front yard along the unimproved dirt right-of-way). The reason stated in the Building Inspector's Notice of Disapproval is that the proposed construction indicates a front yard setback of approximately 34 feet, instead of the code requirement of 35 feet, and that this corner lot requires two front yards. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 19, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a new dwelling with breezeway addition to the existing garage. The new construction is proposed at 35 feet from the westerly front yard and 53'3" from the southerly front yard, as shown on the site plan prepared by Jeffrey T. Butler, P.E. (with a July 12, 2004 ZBA date stamp). Ci• Page 2—August 19,2004 ZBA No.5574—E.and M.Kavanagh(Interpretation) CTM 141-3-6.3 1) The proposed dwelling is shown to be 35 feet at its closest point to any front yard line. The new breezeway addition (attaching the existing building to the new dwelling) will be at least 35 feet from any front yard property line. 2) The code-required minimum front yard setback for new construction on this 15,804.67 sq. ft. parcel is 35 feet. The existing degree of nonconformance is noted as follows: 1) The property contains an existing garage building, 33'9" from the westerly property line, and the code required set back is 35 feet; the existing nonconformity is 1'3". The applicant does not propose any new construction within this building, and therefore there is no increase in the degree of nonconformance and no new degree of nonconformance is being created. 2) The proposed new construction is a minimum of 35 feet (some areas greater than 35 feet from the front yard lines), and the code required setback is 35 feet. There is no degree of nonconformity found relative to the new construction areas. 3) The Building Inspector's reasons stated in the Notice of Disapproval are that: "...The addition to a non-conforming garage, on a non-conforming 15,805 square foot parcel in the Residential R-40 District, is not permitted pursuant to Article XXIV, Section 100-242A, which states. § 100-242. Nonconforming buildings with conforming uses. A. Nothing in this Article shall be deemed to prevent the remodeling, reconstruction or enlargement of a nonconforming building containing a conforming use, provided that such action does not create any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings. Pursuant to the ZBA's interpretation in Walz #5039, such addition will constitute an increase in the degree of nonconformance The Board disagrees with the Building Inspector's reasons. REASONS FOR DETERMINATION: The Building Inspector's method of choosing the nonconforming of an existing garage as the area of new construction is flawed because it creates more extreme, nonconformities on the property than is proposed. To clarify, the building inspector's determination to use the existing 33'9" setback of the garage instead of the proposed setback of the new construction was incorrectly applied. RESOLUTION OF THE BOARD: In accordance with 267-B of Town Law which states: The Board of Appeals may reverse or affirm, wholly or partly, or may modify the order, requirement, decision, interpretation or determination appealed from and shall make such order, requirement, decision, interpretation or determination as in its opinion ought to have been made ... I NOW, ON MOTION BY MEMBER TORTORA, seconded by Member Dinizio, be it RESOLVED, that the Board of Appeals INTERPRETS, Town-Wide, Article XXIV, Sections 100-242A, to mean that: In the Residential Zone Districts R-40, R-80, R120, R200, new construction (new dwelling with addition to an existing nonconforming building) is permitted when the setbacks for the new construction areas conform to the code's minimum required front yards for corner lots, because there is no new nonconformance or increase of existing nonconformance in the new construction, and be it further RESOLVED, that the Building Inspector's June 17, 2004 Notice of Disapproval is REVERSED, and that the building permit application be reviewed for issuance as soon as possible.
