No. 5601 —WILLIAM and DONNA GOGGINS Property Location: 1780 Jackson and Fifth Streets, New Suffolk; Parcel 117-10-14.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 41,206 sq. ft. parcel is improved with a two-story wood frame dwelling, garage (under construction) and swimming pool (under construction), as shown on the survey prepared by Stanley J. Isaksen, Jr. dated October 21, 2002. The property combined the parcels as CTM 14.1, previously shown as 13 and 14 on the Suffolk County Tax Map to form a single lot. (For the record it is noted that the former Accessory Bed and Breakfast was removed and is no longer in effect.) BASIS OF APPLICATION: This application is based on the Building Department's August 30, 2004 Notice of Disapproval concerning additions with alterations to the existing dwelling. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 21, 2004 at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. RELIEF REQUESTED: Applicants request variances under Zoning Code Sections 100-30A.3 Bulk Schedule and 100-242A, concerning a building permit application for additions/ alterations, as built, to applicant's home. The permit was denied by the Building Department for the following reasons: (1) the dwelling is nonconforming with a 5.9 ft. front yard setback and the addition will maintain that setback, constituting an increase in the degree of nonconformance of the code required 50 ft. front yard setback, and (2) the code limits a dwelling to 21/2 stories, and the construction constitutes a third story. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the neighborhood or a detriment to nearby properties. The applicants' home was built about 50 years ago. The restoration of the home commenced in or about September 2003, after issuance of a building permit (29726Z) for construction of a covered porch and roof repair. During restoration, • structural problems were found, and based on the advice of the engineer, additional work Page 2—November 4,2 - -,--`` Appl. No. 5601 —W.and D. Goggins 117-10-14.1 at New Suffolk 2 was necessary for structural supports. In the restoration, work was undertaken to modify the height of the ceiling in the attic. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue. During the last couple of years, similar third story variance relief has been considered. The relief requested is for a modified ceiling/attic roof area, and the proposed restoration included the existing third floor. The applicants in this request indicated that they are not planning to use the upper third level for habitable or living area. 3. The variance is not substantial. A third-story living or habitable area does not exist and will not be created. The requested increase of nonconformance is related to the a third level, above 2-1/2 story height, and not the code restricted 35 ft. maximum building height. The roof addition is within the footprint of the building, maintaining the same setback without creating any new nonconformance in height or setbacks. 4. No evidence was submitted during the hearing or in the written record to indicate that this variance will have an adverse impact on the neighborhood or district. 5. Grant of the variance is the minimum action necessary and adequate to enable applicants to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Chairwoman Oliva, and duly carried,to GRANT the variance as applied for and described in the applicant's August 18,2004 architectural diagrams, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The third-story shall be non-habitable space, 2. The Board reserves the right to inspect in the future. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer Tortora, Orlando, and Dinizio. This Resolution was duly adop (5-0). '\h1\^\`11' ...al.;\;C:i._ Ruth D. Dated: September 21, 2004. BOARD OF APPEALS RUTH D. OLIVA, CHAIRWOMAN By Linda Kowalski /l l' 9-\ ' O FORM NO. 3 ` NOTICE OF DISAPPROVAL DATE: August 30, 2004 TO: William Goggins 8755 New Suffolk Road -576i New Suffolk,NY 11956 GOGGINS,WILLIAM & DONNA 5601 JD Please take notice that your application August 26, 20041 AS BLT ADDNS/ALTS FYSB & +2.5 STYS , 1780 JACKSON & 5TH N SUFF 117-10-14.1 For permit for"as built" additions and alterations to an existing single family dwelling at Location of property: 8755 New Suffolk Road,New Suffolk County Tax Map No. 1000 - Section 117 Block 10 Lot 14.1 Is returned herewith and disapproved on the following grounds: The "as built" construction, on this 42,688 square foot parcel, with two front yards, located in the R-40 zone, is not permitted pursuant to Article XXIV Section 100-242A, which states. "Nothing in this article shall be deemed to prevent the remodeling, reconstruction or enlargement of a non-conforming building containing a conforming use, provided that such action does not create any new non-conformance or increase the degree of non-conformance with regard to the regulations pertaining to such buildings." The existing single family dwelling notes a 5.9 foot front yard setback(Fifth Street). Following the proposed construction, the dwelling will maintain that setback. Pursuant to the ZBA's interpretation in Walz (#5309), such construction will thus constitute an increase in the degree of non-conformance. Therefore, the "as built" construction is not permitted pursuant to Article IIIA, 100-30A.3, which states; "No building or premises shall be used and no building or part thereof shall be erected or altered in the Low-Density Residential R-40 District unless the same conforms to the requirements of the Bulk Schedule and of the Parking Schedule, with the same force and effect as if such regulations were set forth herein in full." Bulk schedule requires a front yard setback of 50 feet. In addition, the"as built" addition constitutes a third story, which is not permitted pursuant to Article IIIA 100-30 A.3. •.at:Ze:edule states that such buildin.s are limited to 2 %2 stories. A copy is enclosed. Subsequently, the prior owner converted the premises into a bed and breakfast. When we purchased the premises, we gave up the bed and breakfast use, which resulted in a relation back to the use issued in 1990. Since our ownership, we have continued the two family use, The two family use is as follows: One use on the first and second floor, and one use on the lower level below the first floor. The seasonal use was abandoned. The permit applied for was for renovations to the existing dwelling: The area on the plans designated as basement was to show new structural items to support the house. That area of the house has not changed, except for the structural work and the removal of walls and sheetrock because of recent damages caused by rain. However, we are unable to approve the amendments, as proposed, without the following information: 1.) Wetlands Permits. Because the scope and nature of your project has changed and you are conducting activity within 100 and 300 feet of water or wetlands, respectively, Southold Town Trustee and New York State Department of Environmental Conservation approval is required. 2.) Approval from the Southold Town Zoning Board of Appeals. Although you were issued a variance from the ZBA, that variance was based on an application to construct a porch addition and to make roof repairs. Since the scope and nature of your project has changed, you must re-apply for a Notice of Disapproval from this office and re-apply for a variance from the ZBA, for setback and third story relief. The 4 entire project will have to meet NYS code requirements. 3.) Certification of"basement area." It appears that the basement area of your home may meet the definition of a story. Please have your design professional certify that it does not constitute a story pursuant to the New York State Building Code. If not, certification from the ZBA will be required. 4.) Septic Certification. Because the scope and nature of your project has changed, septic certification is required from your design professional. 5.) Energy Calculations. Your design professional must submit energy calculations for this project. Because you have gone beyond the scope and nature of your original permit approval, a stop work order has been issued requiring the cessation of all construction until you have / addressed the above referenced issues and have obtained a valid building permit for same. If you have any questions, please feel free to call this office at (631) 765-1802 between the hours of 8:00 a.m. and 4:00 p.m. Respectfully Yours, ,.., K- .
