ZBA File 5553 — FISHERS ISLAND CLUB Property Location: South Side of East End Road, Fishers Island CTM 4-6-9 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's parcel is improved with an existing maintenance building, adjacent to the Fishers Island Golf Club facility on this 12.3+- acre parcel. BASIS OF APPLICATION: Zoning Code Section 100-316(7) which states that a Special Exception is required for: Beach clubs, tennis clubs, country clubs, golf clubs and annual membership clubs and accessory playgrounds, beaches, swimming pools, tennis courts, recreational buildings and maintenance - buildings catering exclusively to members and their guests, subject to the following requirements: (a) No building or part thereof or any parking or loading area shall be located within 100 feet of any street line or within 50 feet of any lot line. (b) The total area covered by principal and accessory buildings shall not exceed 20% of the area of the lot. (c) No such use shall occupy a lot with an area of less than three acres. The applicant proposes new construction of a tennis pavilion and related structures (pro shop with office, bathroom, screened porch area, tennis court, and related) for private use by members of the Fishers Island Golf/Beach/Tennis Club on this 12.3+- acre parcel, as shown on the January 14, 2004 map prepared by CME Engineering Land Surveying and Architecture, PLLC, revised May 25, 2004. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: Page 2—September 7, 2004 _ Appl.,No. 55532—Fishers Island Club 4-6-9 1) The applicant seeks approval to build tennis club structures for private use by members of the Fishers Island Club. It is the determination of this board that the operation as a tennis club facility will not in any way alter the character of the neighborhood or district. 2) Section 100-31 B(7) authorizes tennis clubs catering exclusively to members and their guests, subject to the following requirements: (a) No building or part thereof or any parking or loading area shall be located within 100 feet of any street line or within 50 feet of any lot line. (b) The total area covered by principal and accessory buildings shall not exceed 20% of the area of the lot. (c) No such use shall occupy a lot with an area of less than three acres. 3) In addition, the Board has reviewed the General Standards governing Special Exception uses set forth in Section 100-263 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed fitness facility use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection.
