Property Location: 385 North Lane, East Marion ,o0hold d Town Clerk CTM Parcel Id: 31-7-10 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 2.34-acre lot is vacant, and has a width of 708.52 feet along North Lane and depths of 196.45 feet along the westerly lot line and 82.57 feet along the easterly line. BASIS OF APPLICATION: Building Department's March 29, 2004, Notice of Disapproval, amended April 12, 2004 citing Code Section 100-30A.3 in its denial of a building permit application concerning a proposed dwelling which will be less than 50 feet from the front property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 15, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new dwelling with a setback at 33 feet, measured from the carport to the front yard line, as shown on the 4/24/03 survey revised by Joseph Ingegno, L.S., and architectural plans prepared 5/6/04 by Robert James Higgins. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed dwelling will be located on small faction of a large, irregular-shaped, 2.34-acre lot. Although the lot contains over 707 feet of road frontage on North Lane, the dwelling and variance will only affect approximately 60 feet of road frontage, leaving a spacious amount of undisturbed woodlands and greater privacy than most of the lots in this community. �- ti `Page 2—August 2,2004 ZBA No.5551—Diana Fischer CTM 31-7-10 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than a variance. The building envelope is constricted in the rear yard by a 75-foot buffer zone to the wetlands and 10-foot non-disturbance area, leaving a building area depth of only 32 feet, Without the variance, a new dwelling would not be possible. 3. The variance granted herein is substantial and represent a 34 percent decrease in the 50-foot, code-required front yard setback. However, the benefits gained by preserving the wetland and wooded areas easily justify this code deviation. 4. The alleged difficulty has not been self-created and is due to the unusual shape of the lot and environmental constraints. 5. No evidence has been submitted to suggest that the relief granted will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character of the neighborhood and the heath, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all o the above and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Dinzio, and duly carried to GRANT the variance as applied for, as shown on the 4/24/03 revised survey prepared by Joseph Ingegno, L.S. and 5/6/04 plans prepared by Robert James Higgins, Architect. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Because many of these lots are significantly cleared along the road,the containment of the development of this parcel within a small area(+100' x+90') - albeit closer to the road than zoning allows—will provide a benefit to the character of the community that could not be as well achieved if the proposed development were spread more widely along the road, even at a greater distance therefrom. (2) Though the subject parcel is more than(2) acres in area,the maximum lot depth is less then 170 feet, and the combination of the 75' buffer adjacent to wetlands imposed by the DEC and the 50' front-yard setback required by zoning leave a building envelope approximately 42' deep. Given the need to allow at least 10 feet between the dwelling and the boundary of the non- disturbance buffer(to ensure compliance with the buffer during construction), the depth of the building envelope is approximately only 32 feet. Though the proposed dwelling is also modest in size— 1800 square feet on a 2.34 acre parcel—it's depth of approximately 47 feet renders obtaining an area variance necessary. (3) The amount of relief requested is 17 feet or 34 percent. Given the fact that the containment of the development of the site within the relatively small proposed area will allow nearly 2 acres of woodlands to remain undisturbed, the amount of relief requested is not substantial. (4) Granting of the variance will enable the house to be situated the most practicably desirable distance from the adjacent freshwater wetlands and a nearly 55,293 square foot protective buffer to be maintained adjacent to the wetlands. As described in nos. 1 and 3,nearly 2 acres of woodlands can then be maintained in their natural state, which is more beneficial to the physical and environmental condition of the neighborhood than if the development were designed to be spread more widely along the roadfront.
