Dear Mr. Anderson:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1999 regarding
the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of
RUTH E. MILLER applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town
of Southold, application dated October 1, 1999, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
RUTH E. MILLER to construct a 7'X 22' deck addition, including a
7'X 9' gazebo, and repair/replace existing wood deck and stairs
in kind.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed, Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

In reference to Ruth Miller SCTM# 1000-86-07-2.2
I contacted the trustees' office by phone and was told to write a letter, concerning the
adjacent property's proposal to continue modification and construction - adding a deck,
adding a gazebo, and repairing and replacing existing deck and stairs. My feeling is,
naturally you need to repair existing stairs and deck. That is not a problem. That is
keeping your property up.
However, enough is enough. For two years the Miller property has been under
construction, ripping through the Indian Neck Lane woods, destroying the character of
the Indian Neck Lane neighborhood, while killing trees on our property line. We
petitioned when the Millers asked for a variance to build closer to our property line __
because of the obstruction of our views and intrusion into our space. This intrusion was
more than j ust the physical building looming over our yard and private beach, for we now
can see our neighbors and their vehicles and we can constantly hear them. While they
have been building, the constant machinery noise has been devastating, not to mention
the effluence from the workers, blowing across our yard.
The character of Indian Neck lane is at stake. It is no longer a quiet, wooded
neighborhood. At times, we rent our beach house. Renters have complained about the
noise level over the past two years of the construction machinery, and of course the
garbage blowing across the yard. We approached Ruth Miller before the construction
began; she promised that the initial variance was all she was planning on doing. Two
years later she continues the modifications and has turned a secluded beach area into a
suburban neighborhood.
I am upset and have a feeling of helplessness because there seems to be no way to stop it.
Because of broken promises, we feel that each year she'll ask for more.

1999, the following recommendation was made:
Moved by Scott Hilary, seconded by William McDermott, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of RUTH E. MILLER 86-7-2.2 to construct a TX 22' deck
addition, including a TX 9' gazebo, and repair/replace existing wood deck and stairs in kind.
