Dear Mr. Just,
The following action was taken by the Board of Town Trustees
during its regular meeting held on December 22, 1994 regarding
the above matter:
WHEREAS, J.M.O. Consulting, on behalf of LISA REALEapplied to
the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
October 3, 1994, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on Decermber 22, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
LISA REALE to construct a single family dwelling, sanitary
system, decking, and install a 12" culvert under existing drive,
install crushed stone drive, install and maintain a continuous
line of staked hay bales between areas of wetlands and
construction and to create a freshwater pond, and a non turf
area should be placed between the house and barn. The pond
shall be created by excavating the areas of the proposed pond
(approx. 6,000 s.f.) to -10' This will allow the pond to
fill from groundwater (see test hole) and the excavated
material, if suitable, shall be utilized for regrading around
proposed residence. Test hole also shows that there is no clay
present, therefore, this is not perched water. Any disturbed
areas shall be seeded with Wild Duck Millet (Japanese),
Echinoloa crusgalli. This plant is ideal for such an area
and serves as an excellent food source for waterfowl. Located
Crescent Ave., Fishers Island.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

a transfer of Permit #4392 from Ali Raridon to yourself.
The Trustees request that you re-apply for a full permit due to
the fact that this is a major project and an insufficient amount
of work has been done in order to justify this transfer. As of
April 1997 the Trustees adopted a policy that all work must be
done in two years.

applicants must submit a Federal Consistency Assessment Form (FCAF) and supporting
information to the U.S. Army Corps of Engineers/NY with a copy to Ms. Diana Boos at the
NYS Department of State.

is adequate to begin review of the proposed project for consistency with New York State's

To the Board:
Just a short letter to thank the Board staff for sending me a
copy of the recent permit application (Freshwater wetlands) of Lisa
Reale on Fishers Island (Suffolk Co. Tax map ?~o. 1000-006-6-20.5).
I have reviewed the material in the application as well as the site
map, and have the following observations:
1. The application seems in good order, and the site plan map
shows that there is indeed a valid house site on this lot.
2. The plan for a constructed pond in the midst of an existing wetland
does not meet with any opposition from this quarter. It should be
made clear, however, whether or not the entire disturbed wetland
will be excavated to make room for a pond, or whether the pond will
be carved out of the existing disturbed area like a hole in the
middle of a doughnut. I suspect the latter course is what Ms. Reale has
in mind, but it would be of some help to have this point cleared up.
This wetland has been a top mosquito breeding site for many years,
and it would be a fine idea if some open water could be created in
this area.
3. The primary objection of our land use committee, (an objection in
which I join) is that the planned dwelling is only 39 feet from
the edge of the proposed wetland/pond. Considering that_the
Tovm's wetland ordinance specifies 75 feet in such a case. I feel
that any permit granted by the Town authorities should at least
approximate that latter figure. The septic system is listed as being
a very sensible 100 feet away from the wetland shore. ~y can't the
sited house come at least close to this distance ? There is plenty
of room , as a glance at the site map will show. I would request
the Southold Board of Trustees to seriously consider this last point,
lest a dangerous and unfortunate precedent be started.

With regards to the above mentioned Lead Agency Coordination Request, please note that
the New York State Coastal Management Program does not object to Southold Town
