Rerisi SCTM #1000-35-5-37 Permit #210 Dear Mr. Krupski: Southold Town Trustee permit #210 was issued in 1962 to construct the bulkhead that presently exists on Mr. Rerisi'sproperty. The permit was then amended in 1994 to allow floating docks to be installed outside of the bulkhead area. Enclosed for your convenience are copies of the Trustee approvals. The bulkhead is now approaching 40 years old and is in need of maintenance repairs. The enclosed project drawings show the proposed resheathing landward of the existing bulkhead (using vinyl sheathing) and installation of a new backing system It is my understanding that the Trustees will allow maintenance repairs of the bulkhead under permit #210 provided that we submit documentation to your office prior to undertaking the work. This is a request for a variance based upon the Building Inspector's March 15, 1994 Notice of Disapproval concerning a building permit application to locate a dwelling, the northerly portion of which will be within 75 feet of the bulkhead near Gull Pond; ref. Article XXIII, Section 100-239.46 of the Zoning Code. Location of Property: 88 Snug Harbor Road, Greenport/East Marion;, NY; also referred to as Lot No. 34 and Part of 33 on the Map of Section Two at Cleaves Point, County Parcel ID 1000-35-5-37. The subject premises is substandard and is located in the R-40 Zone District. WHEREAS, a public hearing was held on April 6, 1994, at which time all persons who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1 . For record purposes, it is also noted that in March 1985, the Town of Southold enacted "Local Law #4-1985" pertaining to building setbacks from water bodies, and on May 17, 1988, the Town Board enacted Local Law #15-1988 pertaining to setbacks from bulkheads (prev. Section 100-119.26). 5. Article XXIII, Section 100-239.46 (as re-numbered on January 10, 1989 under the Master Plan revisions) continues to require that all buildings and structures located on lots upon which a bulkhead, concrete wall, rip-rap or similar structure exists and .which are adjacent to tidal water bodies other than the Long Island Sound, to be set back not less than seventy-five (75) feet. 6. First, the berm must be installed prior to any construction activity. It should be broad based with a minimum front and back slope of five foot horizontal to one foot verticle to blend in with the surrounding landscape. It should be a minimum of two feet in height. The exact location of the berm will be depend- ant upon the existing slope of the land and the distance the back slope will extend to achieve a 5:1 slope. The location of the bulkhead will determine this. The south end of the berm must curve up slope so that the top elevation will equal the natural ground elevation at that point. This will prevent runoff from traveling around the end of the berm. All disturbed areas including the berm, should be seeded to a temporary cover of annual ryegrass at a rate of 1.0 lbs. per 1000 sq. ft. of area. Once final grading and landscaping takes place the permanent seed mixtures specified should be planted. The area directly behind the bulkhead shown as area one on the survey map is actively eroding. Sand is needed to fill in voids. A five foot wide buffer strip of Cape American Beachgrass should be planted to stabilize this area. Beach- grass is established vegetatively and must be planted while dormant, preferably in late March when the chance of severe storm activity has diminished. Plant at a rate of 3 culms or stems per planting hole. Culms should be spaced 12 inches on center in a staggered pattern. Apply one ounce of 5-10-10 osmocote slow release fertilizer per planting hole. Use a 35mm film canister for measure- ment purposes. One canister approximates one ounce of fertilizer. If timing does not allow beachgrass establishment, then the seed mixture specified under alternative two on the attached vegetative cover specification sheet may be used. Since the landowner expressed concern about having tall grasses within this area, due to the deer tick problem, I have recommended a low maintenance salt tolerant grass mixture that can be mowed. Osmocote 5-10-10 fertilizer should be broadcast at a rate of 10 lbs. per 1000 sq. ft. at seeding to stimulate growth. Fertilization of these grasses is not necessary on an annual basis. An application of 5 pounds of 10-10-10 fertilizer per 1000 square feet every two years will be adequate to maintain growth and vigor and prevent leaching of nitrates. Periodic scraping may be necessary to ensure that it functions pro- perly. An acceptable alternative would be to place crushed stone at the surface. This type of surface is more difficult to scrape but facilitates rapid infiltration. Gutters and downspouts outletting into underground drywells must be installed on the house to reduce the volume of runoff entering the drain. The size of the dry wells will be determined by the roof surface area contributing runoff to each downspout. Normally a plastic fifty five gallon drum is large enough to handle the volume. The key is to spread the roof runoff into multiple drains. I have included information concerning low maintenance lawns. The landowner should consider this approach for the lawn area east of the berm around his house. The soil on this lot is extremely sandy and will require grasses that are drought tolerant and that can survive under low fertility conditions. Uses : This grass is used as a turf for lawns , athletic fields, golf courses, and playgrounds . It is an excellent soil binder and used ex- tensively for stabilizing waterways , slopes, banks , cuts , and fills. It is also used as a cover crop in orchards. DNssccWion: Red fescue occurs n 0 ifirms , creeping and bunch-type. Creeping red fes- cue spreads by short under- ground stems that make a tight uniform sod. Chewings fescue is tufted and spreads by de - veloping new shoots. Leaves of red fescue are bright green, wiry, and narrow. They are pressed together in V shape and appear nearly round. Stems are usually bent at the reddish or purplish base and grow about 2 feet tall . Panicle seedhead is contracted or narrow. Varieties : Improved varieties i of re fescue in the Northeast region are Illahee and Pennlawn. Uncommon varieties are Rainier, Golfrood, Trinity, Clatsop (Oregon) , Duraturf (Canada) , Olds (Canada) , and Jamestown (Rhode Island). Pennlawn and Illahee are superior varieties for the Northeast. No improved varieties of Chewings fescue are on the market. Sources : The common varieties are readily available from com- mercial sources . Adams on: This grass is Red fescue hardy, wear - resistant, and shade tolerant. It is drought- resistant after establishment, and adapted to sandy and acid soils. It -2- prefers well-drained soils , but requires ample moisture for establish- ment. Its prime area of use in the Northeast is New York, Ohio, West Virginia, Pennsylvania, and the New England States. In the other states of the Northeast region, the grass is adapted to the cooler zones. In areas of high temperatures and humidity, the grass may turn brown or deteriorate during the summer. It will generally recover in the fall when temperature and moisture conditions are more favorable. Establishment: Red fescue is rarely seeded in pure stands. It is used, instead, with grasses and legumes for specific purposes , such as for lawns, erosion control , or recreational areas. Seedbed preparation, fertilizing, liming, rate and dates of seeding, and weed control re- quirements are generally governed by the companion grasses in the mix- ture. Foliage is eaten by geese, deer, and cottontailed rabbits. The plant also provides nesting and fall and winter cover for birds. Descri tion: Tall fescue is an introduction from Europe. It is a robust, ong- ive , deep-rooted, bunchy grass often with short rhizomes. Stems are 3 to 4 feet tall , erect, and smooth. Leaves are broad, flat, generally smooth on the underside, and ribbed on the upper side. Head is a nodding panicle from 4 to 12 inches long. Varieties : There are two well-known varieties -- Kentucky 31 and Alta. These are very similar and neither superior to the other except as affected by local environment. Kentucky 31 is -isually used as standard in the Northeast. Kenwell is a variety release from Kentucky promising more palatability and disease re - sistance than either Kentucky 31 or t Alta. Sources : Kentucky 31 and Alta varieties are readily availableC�- ) from commercial seed dealers . The supply of Kenwell is limited at the present time. Ada_ station : This plant is adapted ai t t—o—a—wi a—range of climatic condi tions. It is affected more by moisture than temperature. It pro- duces topgrowth when soil tempera ture is as low as 40°F. It tolerants a pH range of 3.0 to 8.0, p but does best at 6.0 to 7.0. It grows best on fine to medium tex - 3 _ tured soils. It will grow on shal- low and claypan soils if they are moist. Establishment: Drill at depths of about 3/4 inch on a well - prepared, weed- ree, 1rm seedbed. Hydraulic seeding or broadcasting may be necessary on -2- critical areas. Seeding rates vary from 10 to 15 pounds per acre for pasture and hay to 50 to 60 pounds per acre on critical areas. For lawns and recrea- tional areas , the seeding rates may be as high as 250 pounds per acre. Plant in early spring as soon as soil conditions permit or from middle of August to early September. In some areas, late September or October seedings may be satisfactory. Apply lime and fertilizer according to test for establishment. Legumes may be added for hay or pasture , but are difficult to maintain in tall fescue stands owing to the aggressive growth of this grass. Management: Maintain fertility by applying fertilizers based on soil tests. Graze in the spring when the plant is about 8 inches high or between the boot to early head stage. For hay or silage, cut between boot and early head stage. Later harvests give lower quality forage. On critical areas , mowing is desirable. Salt Tolerance: 'Fults' is one of the most salt-tolerant turf grasses available. it originated on a Colorado golf course, where it dominated salty areas of the fairways. It has been seeded In j roadside trials in Wisconsin, Iowa, and Illinois, and has shown excellent persistence In salty areas where even tail fescue has failed to survive. In California, 'Fults' has established a stand in is salty area of a city park where other turf grasses have failed to establish, despite repeated seedings. If your ideas about lawn care support- the theory that all lawns should be a perfect green carpet all year long, don't read any further. This has been prepared for the person, who, having a different value system, considers the excessive use of pesticides, fertilizers and water as undesirable and is prepared to face the consequences of terminating these practices on lawns. By following the directions given below, the homeowners may indeed find they are not consequences at all, but rather the development of an acceptable lawn having the appeal of the natural environment. How to Build a Low-Maintenance Lawn Good soil preparation becomes even more important because thq grass species required for this lawn do not tolerate wet soilp. If the soil test indicates the pH is above 5 .0 (6.0 usually suggested for other lawns) no lime is needed. If below pH 5.0, spread 50 lbs. of pulverized limestone per 1000 square feet (20' X 50' ) . When starting a new lawn, some fertilizer is required. Use about 10 pounds of 10-10-10 or equivalent per 1000 square feet in the seedbed, and with the final pass of the tiller, mix into the upper 2 to 4" of soil. Choose a seed mixture which has about 70% red fescues. These may be creeping types, chewing types or preferably both. About 20% of the mixture should contain perennial ryegrass, and the balance about 10% common Kentucky bluegrass. Buy a 5 lb. bag of this mixture for each 1000 square feet of Lawn area. The new lawn will survive best if pre- parations are completed in time to seed during late August or early September. . Make sure of uniform seed coverage. Spread a layer of loose straw over the seed at the rate of l bale per 1000 square feet. If possible, roll lightly to firm the straw and seed against the soil. Water the lawn for 15 minutes each day (when there is no rain) for three weeks. Red fescues are tolerant. of dry conditions and eventually go n dormat to survive long, dry periods. Only fertilize one time a year using one pound of actual nitrogen per 1000 square feet (same as seedbed recommendation) . The fertilizer r should be applied in early fall for efficient utilization. Even greater efficiency is obtained with two applications of one-half the above amount in early and mid -fall.. Use pesticides only when an ident-ified pest problem threatens total annihilation of the lawn. As red fescue begins to dominate the lawn, a noticeable change in texture will occur. The red fescues are very fine bladed grasses giving a more "t.hread-like" appearance than the bluegrasses. Red fescue establishes more rapidly from seed than does bluegrass , but does not establish rapidly by vegetative means. Therefore, bare spots in a lawn will not fill in as rapidly as can be expected from blueyrasses. Reseeding may become more necessary 1.11an before . Red Thread and leafspot ace the most severe diseases of red fescue. Browning and thinning of the lawn from these diseases may occur in the spring or fall, but recovery is usually quite good. Only in severe cases is it necessary to use a fungicide, providing that you are willing to accept some disco.loraLion for two weeks or so during a bad year. Red fescue is very drought hardy due to its special mechanism for conserving water. It has two rows of bulliform cells (thin-walled, easily-collapsible ceLls) down the leaf which close the upper leaf surface as soil moisture becomes limiting. During long dry periods , however, a second mechanism called summer dormancy, may result in a browning of the grass . For the most part it is not advisable to interrupt this natural mechanism of survival by irrigating , because other grasses and weeds would be highly competitive in high moisture conditions . Also, irregular or improper irrigation coulrl "confuse" the natural durmancy mechanism and result in complete kill of t:he grass.
