Pursuant to the provisions of Chapter 615 of the Laws of
the State of New York, 1893: and Chapter 404 of the Laws of the
State of New York 1952; and the Southold Town Ordinance en.

Resolution of The Board adopted at a meeting held on 9/24/97.

LEO OLSEN
of . Gxeepport . N. Y. and subject to the
Terms and Conditions listed on the reverse side hereof,
of South old Town Trustees authorizes and permits the following:
~ESOLveD, that the Board of Trustees approves the application of
LEO OLS£N to remove locust trees and replace with others,
place a 20' non-turf buffer along dock, remove top solI and fIll
with recycled concrete and top with stone or wooden walkway,
install driveways topped with stone, grade land, install a 6'
fence along rear of property, plant grass and landscape, install
new water line from main street to existing building, , repair in
retaining wall. Applicant will install a septic system, only
when Health Dept. approves location of septic system and places
on survey, and will repair catwalk only when he places
accurate dimensions of catwalk on survey along with dimensions !re-
of shed. Located: 3590 Main Road, Greenport. t

with a small storage building which the applicant confirms is

la97 reads as follows: under Article XXIV, Section
AREA VARIANCE RELIEI' REQUESTED BY APPLICANT: Request to
Reverse Decision of the Building Inspector, and in the alternative, a
Variance uuder Article XXIV, Section 100-243. based upon the
April 15, 19a7 Action of Disapproval issued by the Building
Inspector, in applicant's repair and new roof, and proposed
overhead door, for an existing accessory shed.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
(1) The gmnting of the area val'Îance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because it is based upon the limitations requested
by applicants to the requested size, repair and changes under this
variance application with a height of apPl'oximately 10 ft.
(2) The requested area variance is not substantial because the size
of the building will remain basically similar to the size which
exis ts .
(3) The proposed val'Îance will not have an adverse effect or impact
on the physical or environmental conditions in the neigllborhood or
district because the utility structure has existed fOl' 25 years.

(4) The situation has not been self-created because this building
was constructed under a building permit issucd in 1973.
(5) This action is the minimum that the Boal'd deems necessary and
adequate and at the same time preserves and lH'otects the character
of the neighborhood, and the health, safety, welfare of the
community.
(G) Upon physical inspection, an nnsecured shower stall was found
inside the building. Applicant indicates that he is going to apply
EoI' Suffolk County Health Department approval for a residential
sanitary system in which he inhmds to connect to this building (or
possibly a future building per codes). While this board does not
condone a sanitary system in accessory structures, it has upon
occasion allowed cabana use in conjunction with beach and boating
residential-type facilities.

shower and lavatory during the period of time that tills parcel lacks
a primary residence, only with the approval of the Suffolk County--
Health Department for the sanitary system. Upon applicants' receipt
of a building permit in the future to construct a residence, then at
the time of completion of the primary residential building,
applicants and/or their assigns shall remove sanitary facilities to
this Luildiug within ;;ix muuths of being granted a certificate of
occupancy for a dwelling, '
3, Applicants intend to use tills building as an accessory building
and therefore may nut use the same for sleeping quarters.

Trustees on Wednesday, July 21, 1999:
RESOLVED that the Southold Town Board of Trustees grant the
one-year extension to Permit *4800 to remove locust trees and
replace with others, place a 20' non-turf buffer along dock,
remove top soil and fill with recycled concrete and top with
stone or wooden walkway, install dirveways topped with stone,
grade land, install a 6' fence along rear of property, plant
grass and landscape, install new water line from main street to
existing building, repair retaining wall, and applicant will
install the septic system, ONLY when Health Dept, approved
location of the septic system and places on survey and will
repair catwalk ONLY when he places accurate dimensions of
catwalk on survey along with dimensions of shed,

The following action was taken by the Board of Town Trustees
during its Regular Meeting held on September 24, 1997, regarding
the above matter:
WHEREAS, LEO OLSEN, applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated May 7, 1997, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on September 24, 1997, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

of a building permit in the future to construct a residence, then at

this building within six months of being granted a certificate of
