Roy Haje 1329 North Sea Road Southampton NY 11968 Re: JOHN XIKIS SCTM #44-1-13 Dear Mr. Heje, The following action was taken by the Board of Town Trustees during its regular meeting held on May 25, 1995 regarding the above matter: WHEREAS, En-Consultants Inc., on behalf of JOHN XIKIS applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southo1d, application dated March 20, 1995, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 25, 1995, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, which will be listed on a separate page, and, . . . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of En-Consultants Inc., on behalf of JOHN XIKIS, to construct a 10' X 200+' wood deck between existing gabion wall and timber retaining wall. Located: 44485 North Road, Southold. Permit to construct project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. No. 1258 Moved by Robert Keith, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees the following for the Grandfather Permit and Wetland Application of LORRAINE WENDT 115-12-1~ to Grandfather 31'2" x ~, catwalk with associated pilings and a permit to add a 3' x 12' ramp and 6' x 20' float in an "L". The CAC recommends APPROVAL OF THE PERMIT FOR THE RAMP AND FLOAT. The CAC recommends APPROVAL OF THE GRANDFATHER PERMIT FOR THE CATWALK IF THE CATWALK IS RAISED TO ~' WHEN IT NEEDS TO BE REPLACED. 980 Deep Hole Drive, Mattituck Vote of Council: Ayes: All Motion carried. No. 1259 Moved by Allan Connell, seconded by Stephen Angell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of RUSSELL E. MANN 70-~-~ to restore sand to spoil area. In 1987 sand was dredged from the north side of the dock and deposited in the spoil area. I n recent years storms have washed sand from the spoil area to the north side of the dock. The CAC recommends disapproval because no need is shown. If soundings are done to prove there is a need for the dredging the CAC recommends a minimum of dredging to a ~, depth at low tide. 1775 Calves Neck Road, Southold Vote of Council: Ayes: All Motion carried. No. 1260 Moved by Stephen Angell, seconded by Allan Connell, it was RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the Wetland Application of JOHN XIKIS ~-1-13 to construct 1 10' x 200 +/-' wood walk between existing gabion wall and timber retaining wall. The CAC recommends disapproval because decking of this magnitude is not in keeping with the spirit of the non-turf, vegetative buffer requirement. It is extremely important for you to have your property and home inspected for exposure of septic system, eroded land, damage to home, exposed electric or fuel lines, etc. If there is a need for repairs or replacement you must notify these departments for proper permits before you make any repairs, or replacements. We are working in conjunction with these departments to help you and your neighbors make these repairs or replacements as quickly as possible before any more damage is done, but we need you to inspect your property and contact the necessary agents immediately. NY 11968 RE: John Xikis #1_4738-00392/00002-0 Dear M:-, Haje: We have carefully reviewed your proposal, referenced above. and have made the following determinations: Based on our analysis and a recent field investigation. we have found that your proposal to raise the height of ¡he existing bulk.'1ead an additional 4 feet does not meet the. standards for permit issuance pursuant to 6NYCRR Part 661.9(c)(3). Specifically. it will have an undue adverse impact on the present and potential values of the adjacent tidal wetlands. This proposal will also have an undue adverse impact upon the adjacent properties to the .:ast and west by accelerating and exace:-bating erosion of those properties. Your project plans also appear to be inaccurate. Your plans depict rock toe armor at the seaward side of the bulkhead but theœ is no record of authorization for the rock. You requested a permit amendme:J.t on December 6. 1988, for the inclusion of rock armor, however, you withdrew that request on MarÒ 1.:1.. 1989. The recent site inspection did not reveal any toe armor. Since your proposal does not conform to the requirements of Part 661 (Tidal Wetlands Land Use regulations). the permit is hereby denied. This permit denial is made without prejudice and is based on the current proposal and conditions at your site. you may resubmit your application in the future. and it will be reconsidered if conditions at the site have changed. Please be advised that 6NYCRR Section 621.7(f) proYides that an applicant may - request a public hearing if thetnnit is denied or contains CDr:di[ions IjCh are umc2~ptable to them. Any such request must be made within 30 calendar days of the date of the mailing of the notice of denial and should be addressed to the Regional Pennit Administrator at the above address.
