Geideman 355 osprey Nest Road East Marion NY 11939 Re: NORMAN TAYLOR SCTM #38-2-35 Dear Mr. Geideman, The following action was taken by the Board of Town Trustees during its Regular Meeting held on November 18, 1997, regarding the above matter: WHEREAS, NORMAN TAYLOR, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated April 3, 1997 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 18, 1997, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and" WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, r . . NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of NORMAN TAYLOR to construct 1- 40' low profile groin that will begin at the highest vertical point which is at the whaler of the bulkhead and no pre-filling. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. ' Permit to construct and complete project will expire two years' from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. NY 11790 Re: S-97-Q35/036/037/038 Taylor/Edler IN apol itanorr ommas ini Construction of Groins Town of Southold, Gardiners Bay Dear Ms. Gerbino: Thank you for sending the Department of State (DOS) copies of the Coastal Assessment Form (CAF) and supporting information regarding the proposed groin construction activities in the Town of Southold. We have reviewed the submitted information as well as information on file at this office. The following comments and enclosures are provided for your consideration. In accordance with Executive Law Article 42 and implementing regulations in 19 NYCRR Part 600.3 (c)., (copy attached), when the Secretary has identified State agency actions which are likely to affect the coastal area, those State agency actions are required to be undertaken in a manner consistent to the maximum extent practicable with the coastal management program (or approved Local Waterfront Revitalization Program). Pursuant to 6 NYCRR Part 617.14(f)(10)(i), when an action is not in an approved local waterfront revitalization program area. an identification of the applicable coastal policies of Executive Law, Article 42 as contained in 19 NYCRR 600.5, and a discussion of the effects of the proposed action on. and their consistency with such policies, must be produced. Since permits from the New York State Department of Environmental Conservation (NYSDEC) may be required for various portions of this project, NYSDEC must make its own determination regarding the consistency of its action with the policies and purposes of the stare's coastal management program. Ms. Darlene Gerbino Page 2 The following items should be addressed within your policy analysis. Questions and comments are listed with regard to each of the appl icable pol icies of 19 NYCRR 600.5. Rooding and Erosion Hazard Policies: (l) Whenever possible. use of nonstructural measures to minimize damage to natural resources and property from flooding and erosion. Such measures shall include: (i) the setback of buildings and structures; (ii) the planting of vegetation and the installation of sand fencing and drainage systems; (iii) the reshaping of bluffs; and (iv) the t100d-proofing of buildings or their elevation above the base flood level. (2) Mining. excavation or dredging in coastal waters shall not significantly interfere with the narural coastal processes which supply beach material to land adjacent to such waters and shall be undertaken in a manner which will not cause an increase in erosion of such land. (4) Activities or development in the coastal area will be undertaken so as to minimize damage to natural resources and property from flooding and erosion by protecting natural protective features, including beaches. . .. (5) Activities and development, including the construction or reconstruction of erosion protection strucrures, shall be undertaken so that there will be no measurable increase in erosion or flooding at the site of such activities or development or at other locations. Our comments are included within the attached copy of correspondence from Fred Anders of our office to Albert Krupski Jr. of the Town of Southold. In his letter. Mr. Anders discusses a variety of issues pertaining to construction of groins within this area of Gardiners Bay. The letter also contains alternatives to construction of the groins which if implemented, may provide protection that results in fewer detrimental impacts to the existing natural protective features. Please consider these suggestions in your evaluation of the proposed groin projects with respect to the goals and objectives of the New York State Coastal Management Program. We hope that this information will assist you in your review of this proposed project. Movement of sand. When wind blows from east. sand movement is toward west. When wind from west, sand moves east. When wind blows from south. sand moves toward shore. 2. Amount of material In net (cell between inlets) - 7000 cu. yds. 3. Zone of transport. Mi,ed shoal - rocks, clav, little grass. Rolling surf. No Breaker Zone. No Swish Swash or Sand Splašh area. 4 Percentage of sand altered. [I' groins not filled 900 cu. yds of 7000 cu. yds (13%) If groins filled 49 cu. yds. of 7000 cu. ;-ds (.007%) 5. Anticipated down drift. Predominantly East to West. In last 2 years properties lost 1083 cu. yds toward west. At present Oyster Co. Inlet clogged by approximately 2000 cu. yds of sand. There is another aproximately 667 cu yds of sand on the shore from last year's dredging. Some of it obviously from our properties. 6. Overall objective - to restore Swish Swash (Sand Splash) area that e,isted for 34 yrs until 1995. 7. Fill - with owner's permiSSion. from Oyster Co. land pile and inlet, which is sand that actually drifted from our properties.
