Dear Ms. DiSalvo:
I represent Ms. Joni Spencer, the owner of above referenced Premises. It has come to our attention
that a certain Certificate of Compliance No 0153C issued September 8, 2006 pertains solely to the
bulkhead located at the Premises in accordance with Permit #4787, dated September 4, 1997. It
also appears that a permit was issued in 1999 for the stairs and landing accessing the bulkhead but
an inspection was not conducted so as topermit the Certificate of Compliance to be amended to
include the stairs and landing.
Accordingly, Ms. Spencer requests that an inspection be conducted by the Trustees in order to
confirm that the stairs and landing conform to all of the requirements and- conditions of the
applicable law. In,that regard, I am enclosing an authorization to enter the Premises signed by.Ms.
Spencer and a check for$50.00 representing the Board's fee for such inspection.
Upon successful completion of the inspection, please issue an Amended Certificate of Compliance
covering the bulkhead, stairs and landing to Joni Spencer. For your convenience I am enclosing a
self-addressed stamped return envelope--for-the Amended-Certificate In-the-event you have any

that the bulkheading on the above referenced lots are in need of
repair. My intention is to repair them to the exact like and
kind as was originally constructed on lot 111-9-6.2 & 6.3 . In
addition, I have also enclosed a copy of a survey dated May 23,
1962 indicating the existence of the bulkhead at that time. In
the event any information in addition to this letter is required,
please advise. I have scheduled the work to commence the week of

Department of Environmental Conservation has determined that.:
The portion of property which is located landward of the functional
bulkhead in excess of 100 feet which was constructed prior to
August 1977 and shown on the survey by Otto Van Tuyl dated May 7.3 ,
1962 is beyond the jurisdiction of Article 25 (Tidal Wetlands) .
Therefore, in accordance with the current Tidal Wetlands band Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands jurisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15 ' to 20 ' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
