Dear Mr. Taggert,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on May 26, 1999, regarding the
above matter:
WHEREAS,
Trustees
Ordinance
1999 and,
SUSAN & PHILIP BACON, applied to the Southold Town
for a permit under the provisions of the Wetland
of the Town of Southold, application dated March 19,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 26, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
SUSAN & PHILIP BACON to construct a set of beach stairs with
plantings of beach grass and rosa rugosa below the bluff line
with 150 c.y. of topsoil placed at areas of erosion with erosion
control jute mattings. Existing black pines along bluff to be
cut down and planted with beach grass and beach rose. At top of
bluff 3 rows of shore juniper to be planted along bluff line.
Catch basin with leaching pool 8' in diameter 8 ft. high placed
landward of bluff line as shown on drawing #1 - site plan
revised date 5/7/99. Grade to be pitched to catch basin to
catch rain water runoff and leach into ground.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete proiect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Al the meeting of the Southold Town Conservation Advisory Council held Thursday, April 15,
1999 the following recommendation was made:
Moved by Richard Smith, seconded by Melvyn Moms, it was
RESOL VED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application of SUSAN & PHILIP BACON 111-09-02 to construct a set of
beach stairs.
3335 Nassau Point Rd., Cutchogue
The CAC recommends Approval provided that the Trustees approve the dimensions of the stairs,
which were unavailable to the CAe.
