Dear Ms. Thompson,
The Southold Town Board of Trustees reviewed the survey dated
and received in our office on January 5, 1999, a.nd determined
that your proposal to demolish an existing garage ~ and to add
an addition to existing house, to be out of the Trustee Wetland
jurisdiction, under Chapter 97, and the Coastal Erosion Hazard
Area under Chapter 37 of the Town Code.
However, any activity within 75' of the Wetland line, or any
project seaward of the Coastal Erosion Hazard Line would require
permits from this office.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to
call.

for the area landward of the top of the bluff. A letter of non-jurisdiction was issued to Barbara

believe that the condition upon which the determination was based (i..c., bulkhead) has significantly

Based on t, he information you have submitted, the New York State
Department of Environmental Conserve=ion bas determined that:
· the property landward of the bulkhead greater than 100 ft.,
constructed prior to September 1977 as ~how~ on the sul-vey prepared
by Van Tuyl & Son dated 3/13/68 azld last amended 12/19/68 is beyond
the jurisdiction of Article 25 Tidal Wetlands.
Therefore, in accordance with t_he current Tidal Wetlands Land Use
Regulations (6NYC~R Par~ 661) no p~it is reguired uru~er the Tidal
Wetlands AC= . Please bm advised, however, that no construction,
sedimentation, or disturbance of ~ny kind may take place seaward of
=he tidal wetlands Jurisdictional bo~/~dary, as indicated above,
wi=bout a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area be=ween the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erecting a
temporary fence, barrier, or hay bale berm.
Please be further advised that t_his let=er does no= relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies.
