Consistent with the Town of Southold Board of Trustees Policies, adopted by the Southold Town Trustees, and now accepted by your Department pursuant to the inter- agency agreement, the length of the Rumpler dock assembly was unaltered. As presently permitted by the Southold Town Trustees, the Rumpler dock assembly features "...a 4'X 8'platform; 4'x 12'ranip; an(l, 6'x 16'float.". A copy of the Southold Town Trustees Letter of Approval is attached herewith for easy reference. Subsequently, the water depth at the most seaward end of the authorized dock assembly would measure in excess of 3.0 feet, along the edge of the channel within Goose Creek, and acceptable within the standards of the Southold Trustees. As applied for,the proposed dock consists of a 4' x 8' platform (catwalk), a 4'x 12' hinged"ramp and a 6' x"16' floating dock. The catwalk extends from an existing platform that consists'of stairway leading to the bulkhead. At paragraph 1 of your correspondence, you indicate that DEC staff conducted a site inspection of this property on January 22, 1999 It would seem highly unlikely that DEC inspected this property on that date because the application for this dock assembly wasn't filed with your Department until July 26, 1999. Perhaps your letter of objection was written in connection with an entirely different project located elsewhere on Long Island. If so, I request you withdraw your objection and forward to this office the requested Tidal Wetland Permit for the dock assembly as applied for. At paragraph 2 of your correspondence, you note the proposed float will be located at a depth of only 3 feet. This is approximately correct in that the float is positioned on the sloping edge of a navigable channel such that the seaward face of the float is located at 40"of water whereas the landward face of the float is located at approximately 22"of water. The float is not in the channel. The float is oriented parallel to the shoreline and the channel to make this dock as short and visually unobtrusive as possible to avoid interference with the channel., You assertf that because of the shallow conditions of the:mooring area(presumably,in;the area of the floating dock)Any boat would sit on the bottom at low tide conditions. Please be advised that the purpose of this proposed dock assembly is to provide suitable docking for a 14 to 16' ' 2 i Boston Whaler powered by a 35 to 40 horse power outboard engine. The Boston Whaler will not draw more than 6"of water and, as you know,when docked,the outboard engines are tilted in the"up"position. Accordingly,the boat proposed to be docked at this location will not sit on the bottom during low tide conditions. DEC should not be overly concerned that a large cabin cruiser type vessel will eventually be moored at this facility because,the floating dock is quite small and because the Goose Creek Bridge located at the mouth of this creek as it connects Southold Bay is low. There are no such vessels moored or docked anywhere within Goose Creek. You assert that to gain access and/or leave the dock would result in prop dredging of bottom habitat. There is no expectation that prop dredging will occur at this site because the engine propeller will not come in contact with the bottom and because typical boat operations of such outboard engines occur with the engine partially tilted in upright fashion. The operation of any motorized vessel will cause some degree of sediment suspension whether depth is 2, 3,4 or 5 feet. As a practicing Environmental Consultant on Eastern Long Island, I am at a loss in accurately advising clients as to the appropriate water depth for any dock assembly. As you know,your Department has issued hundreds,perhaps even thousands of Tidal Wetland Permits authorizing the construction of docks since August of 1977(the effective date of the Tidal Wetlands Land Use Regulations). There has been no change to the Tidal Wetlands Land Use Regulations that address appropriate water depths for docking facilities. Your letter appears to reflect DEC's "policy du jour"concerning dock applications without any reference to the Tidal Wetlands Land Use Regulations or other regulations which also guide the construction and placement of docks,their appropriate lengths, depth of water and appropriate uses. Enclosed herewith for your review please find the following documents: Memorandum Decision and Order: United State District Court;Eastern District of New York,Docket#CV 98-3580(ADS): Burt H. Stutchin and Cheryl Stutchin,Plaintiffs against Town of Huntington and Incorporated Village of Lloyd Harbor,Defendants; • U.S. Army Corps of Engineers Permit Number 1999-09260 dated August 27, 1999; • Board of Town Trustees, Town of Southold Permit/Approval of this dock assembly as applied for. These documents reflect appropriate decision making standards regarding the lengths of docks and their uses. Mooring a vessel at a depth of 4 feet will not prevent this. I encourage you to read the Memorandum Decision and Order attached herewith because it provides all agencies with regulatory jurisdiction over the placement and construction of docks, valuable insight regarding the decision making process. Clearly,this decision directs all agencies to consider a wide variety of issues beyond those outlined in your correspondence to me. Clearly,this decision educates all agencies that they must undertake a balancing approach in the siting of docks that include navigational impacts, reasonable access, aesthetic impacts, protection of natural resources and the regulation of other agencies particularly local agencies such as the Southold Town Trustees. The attached Southold Town Trustee permit should be considered by your Department. I also encourage you to contact the Trustees in Southold regarding this application because during the public hearing held on'this application,the Trustees opined that this particular dock design was among the best dock designs they had ever reviewed. This explains of course why it was approved Similarly, U.S. Army Corps of Engineers granted a permit for this dock assembly as applied for because it would not result in significant navigational impacts. A longer dock would have a greater effect on navigation and public access, ad would result in greater overall effects over a larger area. I believe that the Trustees and Army Corps of Engineers exercised the proper regulatory discretion in the regulation of this project. At paragraph 2 of your correspondence,you assert that any vessels berthed at this location would cause adverse impacts to adjacent vegetated wetlands. A simple review of the application before you, including the photos of the shoreline adjacent to this dock assembly reveals no vegetated wetlands adjacent to the dock. Perhaps the vegetated wetlands that your Department is concerned with are located on the other side of the navigational channel. Thus, extending a dock further into the channel would bring the feared impacts related to the operation of a Boston Whaler closer to the vegetated wetlands your Department is charged to protect than the dock assembly applied for. For the reasons set forth above, I respectfully request that you reconsider your correspondence to me and grant the Tidal wetlands Permit for this dock assembly as applied for just as every other regulatory agency has already done.
