Dear Mr. Bowman:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 24, 2000 regarding
the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of JOHN
HURTADO, JR. applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated November 3, 1999, and,
WHEREAS, said application was referred tú the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 24, 2000 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97 of the Southold Town Code,

WHEREAS, the Board has determined that
will not affect the health, safety and
people of the town,
the project as proposed
general welfare of the
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of
JOHN HURTADO, JR. to construct a single-family dwelling and
sanitary system, with the condition that there be a 50 'non-turf
buffer from the top of the bank.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mr. Krupski:
Can you kindly put the above referenced project back on the agenda for the next Trustees
meeting. The applicant wishes to pursue the above referenced project as originally submitted to the
trustees in November 1999, with the driveway access off of Bayview Ave. through the two ponds. It is
now apparent that it is not legally possible to access the proposed residence utilizing the adjacent
common right-of-way with an easement.

A meeting of the Southold Town Conservation Advisory Council was held Wednesday,
November 17, 1999. The following recommendalions were made:
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT AND

Moved by Scott Hilary, seconded by Ken Meskill, it was
RESOLVED to recommend to the SouthoId Town Board of Trustees DISAPPROVAL
of the Wetland Pennit Application of PAT SCOLLARD 123-10-3 to construct 102'
retaining wall of"C-Loc" series 4700 vinyl sheathing.

The CAC Disapproved the application because the bulkhead would impact the nalural
hydrology of the tidal system and have a potential impact on lhe habilat. The CAC
recommends an alternative such as re-vegetation.

Moved by Ken Meskill, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS the Wetland Pennit Application of JOHN HURT ADO, JR.
79-5-20 to construct a single-family dwelling, sanitary system and access drive on a
23.77 acre parcel. Driveway construction incorporates grading between (2) small
freshwater wetland areas not regulated by DEC.

1. All construction is to be 75' landward with no disturbance.
2. The driveway be re-routed to existing right-of-way in order
to avoid a negative impact on the freshwater wetlands and
fragmentation of the habitat.
3. A new site plan to be submitted prior to final Approval.

RESOLVED to TABLE the Wetland Permit Application of LISA EDSON 87-5-25 to
clear an upland area up to 30' landward of the tidal wetland boundary and establish a 30'
wide non-disturbance buffer adjacent to the wetlands. Letter of non-jurisdiction
requested to construct a two-story, one-family dwelling, attached deck, and swimming
pool, all on pilings and a pervious driveway; connect to public water; install a sanitary
system and place 600 C.y. of clean sand fill for sanitary system.

regarding the wetlands delineation's to the west and the north within 75' of proposed
structure.

RESOLVED to TABLE the Wetland Permit Application of PHYLLIS GUNN 90-1-15
to clear an upland area up to 50' landward of the tidal wetlands boundary; establish a 50'
wide non-fertilization/non-disturbance buffer adjacent to the wetlands; and install a
drinking water well. Letter of non-jurisdiction requested for construction of proposed
house, deck, and driveway and sanitary system, as all work will be conducted more than
75' landward of the tidal wetland boundary.

PROJECT DESCRIPTION:
Applicant proposes to construct (1) single family dwelling. sanitary system and access drive on a 23.77
acre parcel. Driveway construction incorporates grading between (2) small freshwater wetland areas not
regulated by NYSDEC under Art. 24. A grading/environmental protection plan for this construction is
described below. Dwelling will be located landward of the 10' contour from tidal wetland resources of
Shelter Island Sound. An additional wetland resource is located on the adjacent property owned by the
Peconic Land Trust. This wetland is directly connected through tide gate of the existing aquaculture
faciltiy.
DRIVEWAY CONSTRUCTION SPECIFICATIONS:
Prior to construction, the east and west sides of the driveway limit will be staked within 100' of the (2)
wetland ponds. Proposed drive will be 12' wide and will incorporate an additional 2' wide drainage swale
in areas bordering wetlands. Once construction limit is located, staked haybales will be placed on limit
line to prevent siltation of wetland areas. Vegetation will then be cleared from drive area utilizing a small
bulldozer. Stumps and brush will be removed from area. Once clearing of drive area is completed. final
grade will be established to provide a level surface with a slight crown pitched to the east and west. 6"
road base material will be installed topped by blue stone gravel. 2' area on either side of the drive will
contain a 6" deep swale to catch storm water during precipitation events. Swale to be immediately
seeded with Switchgrass (Panicum virQatum). Haybales will not be removed until swale areas have
100% vegetation cover.

Project Description (Driveway Detail):
1. - Install (2) rows staked haybales 15' off drive, between pond to the East and the Driveway.
Haybales are to remain permanently. A single row of haybales is to be installed between the drive
and the pond to the West between the two storm water runoff basins.
2. - As the driveway enters between the ponds, the driveway is to be filled to match existing grade
in low cut area within existing path to help minimize disturbance to existing vegetation. The
amount of fill required will be 10+/- yards.
3. - (2) storm water recharge basins, 6' x 15' and 2' deep. are to be installed at either end of the
pond to the west of the driveway. The driveway to be slightly graded to the west to allow for storm
water to drain onto this side into basins. An existing berm around this pond to the west will protect
it from runoff.
4. - Existing timber piles and steel debris in area of drive and proposed basin location to the West
to be removed and transported to an approved offsite location.

HURTADO-SOUTHOLD
PROJECT DESCRIPTION:
Applicant proposes to construct (1) single family dwelling. sanitary system and access drive on a 23.77
acre parcel. Driveway construction incorporates grading between (2) small freshwater wetland areas not
regulated by NYSDEC under Art. 24. A grading/environmental protection plan for this construction is
described below. Dwelling will be located landward of the 10' contour from tidal wetland resources of
Shelter Island Sound. An additional wetland resource is located on the adjacent property owned by the
Peconic Land Trust. This wetland is directly connected through tide gate of the existing aquaculture
faciltiy.
DRIVEWAY CONSTRUCTION SPECIFICATIONS:
Prior to construction. the east and west sides of the driveway limit will be staked within 100' of the (2)
wetland ponds. Proposed drive will be 12' wide and will incorporate an addi1ional 2' wide drainage swale
in areas bordering wetlands. Once construction limit is located, staked haybales will be placed on limit
line to prevent siltation of wetland areas. Vegetation will then be cleared from drive area utilizing a small
bulldozer. Stumps and brush will be removed from area. Once clearing of drive area is completed. final
grade will be established to provide a level surface with a slight crown pitched to the east and west. 6"
road base material will be installed topped by blue stone gravel. 2' area on either side of the drive will
contain a 6" deep swale to catch storm water during precipitation events. Swale to be immediately
seeded with Switchgrass (Panicum viroatum). Haybales will not be removed until swale areas have
100% vegetation cover.
