Specifically, the eastern end of the proposed retaining wall will tie into the landward terminus of the return of the adjacent retaining wall, rather than into the face of that structure. Consequently, the final proposal is for a 107' timber retaining wall. By copy of this letter and plans, I am informing the New York State Department of Environmental Conservation (NYSDEC) of this change. Southampton, NY 11968 Re: Birch Hills Property Owner's Association SCTM#83-1-4 Dear Mr. Herrmann: The following action was taken by the Board of Town Trustees during its regular meeting held on June 23, 1999 regarding the above matter: WHEREAS, En-Consultants, Inc. on behalf of BIRCH HILLS PROPERTY OWNER'S ASSOCIATION applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 28, 1999 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 23, 1999, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97 and Chapter 37 of the $outhold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees grant a Wetland Permit and Coastal Erosion Permit to construct a 107' timber retaining wall. Eastern end of the proposed retaining wall will tie into the landward terminus of the return of the adjacent retaining wall. Backfill with approx. 100 c.y. of clean sand to be trucked in from an upland source and replant as necessary. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification.
