However any activity within 100' of the Wetland line and/or seaward of the Coastal Erosion Hazard Line, would require action from this office. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Please find the completed application form, site plan, aerial photo~aph, three pictures of the Long Island Sound Side of the seawall and a recent survey of the property,. The scope of the project is to upgrade the existing restaurant septic system to present Suffolk County Health Department standards. The project satisfies two of the three conditions required to obtain a Letter of Non-Jurisdiction The two satisfied conditions with documentation are: The project is landward of a substantial man-made structure that is greater than 100 feet long and was constructed prior to August 20, 1977 and remains functional. The aerial photograph taken and dated on April 6, 1976 clearly shows the seawall bordering the beach on Long Island Sound. The attached recent survey shows that the seawall is approximately 300 feet long. Three photographs taken on January 30, 2002 show the sea side of the seawall and indicate that the condition is good and perfectly functional. The project is also landward of the 10 foot (MSL) elevation contour. The attached survey shows that the project is landward of the seawall shown on the survey. The survey shows that the top of the seawall is at elevation 11. If there are any questions please feel flee to contact me during the day at 631-344-2841. Please be advised we have reviewed the copy of the Joint Application sent to this office by NYSDEC. Based solely upon the information provided, it appears that a Department of the Army permit is not required for your proposal. The Department of the Army regulates construction activities in navigable waterways and discharges of dredged or fill material into waters of the United States, including inland and coastal wetlands. If your proposal would involve such work, and has"not been portrayed as such in your Joint Application, you should contact this office immediately so that a project-specific determination can be made as to whether a Department of the Army permit will be required. Crotty Commrssioner Alex Demetriades 213 West 28~h Street New York, NY 10001 March 25, 2002 Re; Application #1-4738-00710/00003 Demetriades Properly, A/K/A Santorini Hotel, 3800 Duck Pond Road, Cutchogue, NY Dear Mr. Demetriades: Based on the information you have submitted, this Department has determined that: The property landward of the concrete seawall as shown on the survey prepared by John C. Ehlers last revised on 04-25-00, is beyond the jurisdiction of Article 25 (Tidal Wetlands Act). Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part 661) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above or the bulkhead itself, without a permit. It is your responsibility to ensure that all precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier, or hale bay berm. Please be further advised that this letter does not relieve you of the responsibility of obtaining any necessary permits or approvals from other agencies. Very truly yours, Mark C.
