The Bureau of Marine Habitat Protection conducted a field review of the site and objects to the project as proposed. Water depth measurements were taken at low tide and it was determined that the proposed float will be located at a depth of 2 feet at apparent Iow water. Because of the shallow conditions of the mooring area, a boat ~vould sit on the bottom at Iow tide conditions and to gain access to and/or leave the dock would result in "prop" dreding of the bottom Therefore, the Department suggests the following alternatives: 1. A mooring (anchor) and floating dock totaling less than 200 square feet. 2. A seasonal stick dock with a short calwalk (3' x 20') with a piling/pully system ( see attached dra~ ing) 3. However. New York State Department of Environmental Conservation has raised an objection to the proposed plan because of water depth. Their latest guidelines require a minimum of 2.5 feet of water at low tide in order to approve a seasonal dock. During their field inspection, they measured only 2 feet..We understand that there are some hearings scheduled for August where the DEC's denial of several other dock applications for the same reason will be reviewed and possibly overturned. Accordingly, we would like to request an extension of the permit fee filing deadline until after these hearings. In the letter we received from them, they presented two alternatives that would provide us with access to the boat from our property. We would like to get a reading from the Trustees regarding acceptability~of these alternatives, so that we can possibly select one of them. The two alternatives were a floating dock (less than 200 square feet in area) secured by moorings and a mooring pole with a pulley combined with a smaller catwalk and steps to allow use of the pulley. Nekher of these approaches required the 2.5 feet of water that the permanent installation demands. Attached to this letter are plan and crossview diagrams ora floating dock ( 4' X 36') secured by two moorings. The land end of the floating dock would be situated just beyond the low water mark and four feet to the south of the originally proposed fixed catwalk. The far end of the floating dock would be located at the same distance from AHW mark as the original to provide maximum water depth for the boat and motor. We selected this approach since it was the least intrusive to the environment while providing us with ready access to the boat and the ability to use the dock for fishing and crabbing. Because the boat would never have to enter water more shallow than 2 feet and the engine would always be at the seaward end of the dock, there would be minimal prop scour. Clearly, this is an advantage over the pole and pulley approach. The dock would be constructed in two parts to facilitate its removal at the end of the season. Access to the dock at low tide would be by walking it and at high tide by using a floating pontoon bridge that starts at the seaward boundary of the wetlands. This bridge would be stored against the concrete bulkhead when not needed. As I stated during the hearing on April 21, 1999 we intend to use this dock with a 17 - 18 foot Whaler-like boat. We have investigated several alternatives that meet our needs and draw less than a foot of water. This would enable us to use an outboard engine with a short drive shaft helping to minimize prop scour. While we still believe that our original proposal poses the least possibility of harm to the environment, we think that the alternative proposed is environmentally responsible and workable fi.om the convenience point of view. What we need to know is if the Trustees find this proposed alternative acceptable and what are the implications of this with regard to mooring regulations, permit fees, etc. Please let us know as soon as possible about the extension for the filing fee and the acceptability of the proposed alternative.
