Dear Mr. Herrmann,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on November 30, 1999, regarding
the above matter:
WHEREAS, PHYLLIS GUNN, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated September 29, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on November 30,. 1999, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees approves the application of
PHYLLIS GUNN to construct a two-story dwelling and attached deck
and pervious driveway, clear an upland area up to 40' landward
of the tidal wetland boundary and establish and maintain a 40'
wide non-disturbance/non-ferti1ized buffer adjacent to the tidal
wetland boundary, all as depicted on the site plan prepared by
Joseph Ingegno, dated November 23, 1999.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete pro;ect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Board Members:
As we discussed during our meeting at the Gunn property on Wednesday, November 17, please fmd
enclosed (3) copies of a revised site plan, depicting a revised location of the tidal wetland boundary and
40' non-disturbance buffer located adjacent thereto.
Please note that the proposed house and deck is now situated within your jurisdiction and the proposed
well, which has been relocated to the southwest corner of the parcel, is now out of your jurisdiction,
Therefore, the project description for the subject application should now read as follows:
Construct a two-story, one-family dwelling and attached deck and pervious driveway; clear
an upland area up to 40' landward of the tidal wetland boundary; and establish and
maintain a 40' wide non-disturbance/non-fertilization buffer adjacent to the tidal wetland
boundary, all as depicted on the site plan prepared by Joseph Inegno, last dated 23
November 1999.
Letter of non-jurisdiction requested for emplacement of a sanitary system to be located
more than 130' landward of the tidal wetland boundary.
Although I trust that a permit can be issued at your regular meeting 000 November 1999, please contact
me should you require any further information. I thank you for your time and cooperation with this
application.

2, The driveway be re-routed to existing right-of-way in order
to avoid a negative impact on the freshwater wetlands and
fragmentation of the habitat.
3. A new site plan to be submitted prior to final Approval.

requested to construct a two-story, one-family dwelling, attached deck, and swimming
pool, all on pilings and a pervious driveway; connect to public water; install a sanitary
system and place 600 c,y. of clean sand fill for sanitary system,

regarding the wetlands delineation's to the west and the north within 75' of proposed
structure.

drinking water well. Letter of non-jurisdiction requested for construction of proposed
house, deck, and driveway and sanitary system, as all work will be conducted more than

Dear Sirs,
We, the undersigned are the owners of the home on Lot # 130, Tax Map # 473889 90-1-14. In
reference to the above building permit, we have one concern.
The proposed location for the cesspool system is on a direct downward line with our well water.
Since we use this water for all household purposes, we would like to be assured that any below surface
sewage will not seep into our welL
We feel that a cesspool in such a location might make our drinking water vulnerable. Our well is
relatively shallow and we are well aware of the danger of run-off of E. Coli and other bacteria into our
well,
However, we'll leave it to the experts to determine,
