It is not clear from the plan and cross section what the finished height of the bulkhead will be. The maximum height we can approve is +12' NGVD. This should be consistent from the cross section to the site view. 2. Sand cover of the bulkhead. The entire bulkhead should be covered with sand and planted with beach grass on 18" centers. This aspect must be shown on plan view and cross section. 3. Since our beginning, we have not remanded frozen in place, but have changed our policies, codes and ordinances to respond to changing human activities and the environment. The process of re-evaluating how the Board conducts itself within our jurisdiction make us more responsive to our "modern" problems such as access to the water, shellfish limits and erosion control. In regard to your letter from Dr. Stritzler, I am afraid that Dr. Stritzler has taken his application our of context with the workings of the Trustee Boards, present and past, and tries to hold you responsible for our actions. It is my belief that Dr. Stritzler's application received the proper review from the Board necessary to protect the environment and his property. (This involved many phone calls to the contractor and many site inspections). On an application of the magnitude of this we wanted to insure both and took all steps necessary to do so. Dr. Stritzler should be grateful that his application wasn't "rubber stamped". Without a proper review a poorly planned erosion control structure could result in tremendous property loss on his part. . . Methods of construction will be those ordinarily used and generally recognized as suitable for the installation of bulkheads on the Sound shore of Long Island. Mr. Roger Evans -2- September 29, 1994 The question of the relative value of a rock revetment is addressed in detail in the letter from Thomas E. Samuels, of James H. Rambo, Inc., also enclosed. In addition, information from the Corps of Engineers suggests that rock revetments are generally more successful in protecting against "normal" wave action, and less so in protecting against the waves which would reach a revetment under storm conditions such as those necessitating the proposed project. Dr. Stritzler agrees that the minimization of rain run-off along the top of the bluff is a significant factor in protecting the bluff, and necessary regrading and collection of run-off from impervious surfaces will be undertaken as part of the overall project. Dr. Samuels' letter also contains other information and comments which should be of value in your continuing review of the project. With regard to your request for site-specific cross-sections of the bluff: the preparation of exact cross sections by a surveyor by means of a ground survey would involve considerable further expense, and I would hope that an examination of the contour lines on the submitted survey would provide sufficient data for your purposes. The same comments, to an extent, apply to your request for the depiction of vegetation on the plan. Extensive photographic coverage is available, some of which was included with the original submission. Box 617 cutchogue, N.Y. 11935 Re: Ronald stritzler Dear Mr. Fitzgerald, This letter is in response to the letter dated September 1, 1994 by Roger Evans, the Deputy Regional Permit Administrator, regarding the above referenced application. I suggest you forward this letter to him. I understand that you have submitted a revised plan to Mr. Evans depicting the bulkhead at the toe of the bluff, removing the bulkhead from the surf zone during all but very severe storm surge. The Southold Town Trustees, specifically Mr. John Holzapel, stipulated that the bulkhead be completely covered with sand on completion and that this sand be replaced on an annual basis. This "trial" procedure, if it fails, would result in the placement of stone toe armor and a landward splash pad (quarry stone) and this may well be a condition of the D.E.C. permit. Mr. Starr of the Coastal Hazards Section Region I has consulted with Mr. Holzapel and has approved this approach as indicated by Mr. Holzapel. As per the N.Y.S.D.E.C. Tidal Wetlands regulations, this structure is listed as "generally compatible" and should not generate a positive declaration. As to the proposal to revegetate undamaged portions of the bluff, it would be recognized that partial bulkhead construction at the toe of the bluff would exacerbate the long term stabilization sought by the applicant. Revegetation stabilization of sound bluffs have been notably unsuccessful in the absence of toe protection. The N.Y.S.D.E.C. may be correct, believing a rock revetment would protect the bluff, however, the following facts must be stated. .. . . 1. The cost of such a structure is ±2 times the cost of an armored timber bulkhead. 2. The footprint of a revetment would be 18' seaward of the toe of the bluff in order to attain the 9' MSL top elevation with a N.Y.S.D.E.C. 1 on 2 slope requirement. 3. Access for either structure is from Bailey's Beach Road, 3/4 mile west of the project. Construction of a revetment would require in excess of 35 trailer loads of quarry stone and at least 250 payloader trips from Bailey's Beach Roqd. 4. This would be a major construction project. 5. Rock revetments do require splash pads as wave runup is increased as the waves run up a 1 on 2 rock revetment. In fact, splash pads must be increased with revetment construction. 6. Rock gabion construction on the Long Island Sound has been spectacularly unsuccessful in these extremely high wave energy environments. To conclude, I would suggest that the bluff, upon completion of toe protection, be planted with Cape American Beach Grass, 18" on center.
