Dear Mr. Neilson:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 21, 2004 regarding the above matter:
WHEREAS, Docko, Inc. on behalf of JOSEPH PENDERGAST applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the South old Town
Code, the Wetland Ordinance of the Town of Southold, application dated October 18,
2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 21, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JOSEPH
PENDERGAST to construct a pier assembly consisting of an "S" shaped, pile-supported
timber pier consisting of 35',25' and 10' sections, a 40' by 3.5' ramp, and a 24' by 8'
float secured by four (4) guide pilings and install five (5) mooring pilings, and with the
condition the construction doesn't begin until August and must be completed by January
31 st of the following year, and as depicted on the plan prepared by Docko, Inc. last
dated March 3, 2003.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Dear Ladies and Gentlemen,
Thank you for the opportunity to again review the application ofMr. Joseph
Pendergast to construct a dock adjacent to our property on West Harbor,
Fishers Island, NY. We have no objection to the proposed dock, but because
we swim in the Cove, fish in the Cove and base our livelihood in the Cove,
we would like to repeat our concerns.
Our aquaculture business has been our sole source of income for the last 20
years. We operate both a shellfish hatchery and extensive nursery systems.
Our hatchery cultivates microscopic larvae, the most sensitive stage of the
life history, and operates from January through July. The hatchery draws
approximately 1000 gallons of the Cove water per day during operations.
This water is filtered with a I micron bag filter. On our dock we have land
based upwellers which are flow through nursery systems utilizing about 100
gallons of Cove water per minute, and in the water attached to our dock are
4 large FLUPSY nursery systems that flow approximately 3000 gallons per
minute. Our livelihood, therefore, is intimately dependent upon the
maintenance of excellent water quality in the Cove. The Cove is very small
and activities at any of the docks or on any of the properties (lawn and tree
treatments for example) in the Cove affect the water quality of the entire
Cove. Our concerns reflect this issue of water quality.
I. The construction of the dock will cause a significant amount of
turbidity in the small cove which could be a significant problem for
our hatchery operations. We have larvae in the hatchery from the
beginning of February until the end of July. Impacts to our hatchery
associated with dock construction would be significantly reduced if
construction occurred outside this time frame.
2. Floating sawdust from CCA treated lumber that ends up along the tide
line in the Cove could cause a long term chronic problem. Shellfish
larvae are extremely sensitive to copper. When we built our dock, we
cut and trimmed lumber at a cutting station and removed all sawdust
from this site. Mr. Neilson, ofDocko, Inc. states that there are

alternative environmentally sound materials, which would be best of
all.
3. Cleaners and solvents used in routine maintenance of pleasure boats
are extremely toxic to young shellfish and the food they eat
(phytoplankton). In fact, they are harmful to all marine life.
4. The bottom sediments of most of this small cove are fine silts that are
mayonnaise-like in consistency. The Cove is shallow and it is
necessary for us to tilt our outboard to get from our dock to the
channel at low tide, as it will be for Mr. Pendergast. Propellers can
stir up the bottom and create turbidity throughout the entire cove.
This impact can be minimized by tilting engines and using minimum
power in the Cove. Without dredging, this Cove is unsuitable for a
large inboard vessel.
Carefully maintaining high standards of water quality in the Cove benefits
everyone who shares it. I do not believe my concerns result in restrictive
suggestions associated with this project. IfI can be of any help please don't

Dear Chairman Krupski:
In regards to the application of Joseph Pendergast for a dock and float in
the inner cove of West Harbor on Fishers Island, I wish to urge your favorable
consideration. Mr. Pendergast is a client of this boat yard and as such we are
well aware of his boating enthusiasm despite the nature of his handicap.
In the design process for his dock, careful consideration has been taken to
accommodate his immediate neighbors' concerns and activities. The sensitive
design process also accommodated the requirements which allow easy access for
Mr. Pendergasrs physical handicap. The design also considers the limited nature
of the small cove in which it is located. In short, Mr. Pendergast has had a dock
project designed with sensitivity for all aspects of the marine environment.
I would urge you and the Board of Trustees to favorably consider this
application.

I am writing this letter in regards to the dock that Mr. Joe
Pendergast is submitting for permitting. Joe's house is directly across from
my dock in the cove. I fully support his building a dock, as it would be no
hindrance to navigation in the cove.
Mr. Pendergast is handicapped and in a wheel chair. A dock at his
home would offer him the opportunity to enjoy boating and fishing.
Therefore r urge the Southold Board of Trustees to approve his application
for a dock permit.

Dear Mr. Neilsen:
Please allow this letter to confirm our recent telephone conversation wherein you
indicated that you would be withdrawing your client's application for waiver from
the Trustee moratorium.
As we discussed, you applied to the Town Board for the waiver. According to the
terms of the moratorium, the Town Board will consider a waiver only if a residential or
commercial structure is in danger of collapse or structural failure. As this is not the case
with your client's dock proposal, you have agreed to withdraw the application.
I am enclosing a copy of the moratorium law for your reference. You indicated
that you may still wish to apply to the Trustees for an exemption, but I urge you to
review the enclosed language. From the information you have presented to date, it does
not appear that you have met the requirements for the granting of an exemption.

Trustee dock mOraIorium. This is the first time the Town has asked for our review and
comment on a dock pennit application. We have supplied unsolicited comments in the
past on various dock permit applications from Fishers Island.
Although we appreciate Ihe opportunity to comment on Fishers Island shoreline and
harbor activities and issues. we are somewhat unelear as to why you seek our input
regarding the Pendergasl dock. According!O the documents you sent for our review, the
NY DEC and NY DOS have issued approvals for this fixed pier and float. It may be that,
according 10 the documents, the Trustees were unable to conducI a Bile inspection before
the moratorium went into effect?
The Committee met on May 23" and discussed this permit application. Our Comrninee
reviewed this application using the same criteria we use for approving and siting mooring
locations. We considered impacts on navigation, the environment, and the adjacent
properties.
The orily concern raised during our discussion was !bal of water depth and the size of !be
vessel using the dock. Weare unclear about the size of thc vessel or vessels that will be
docked at this site. This particular area is shallow. In the past we have not issued
mooring pennits for larger vessels in shallow areas despiTe their proximity to launch sites
or particular requesls of the mooring pennil holders due to our concern of chw-ning up
the bonom.
Thank you for seeking our comments regarding the Pendergast dock permiL application.
Perhaps the Town will solicit comments from th r Committee
pennit applications at Fishers Island as well.

NARRATIVE STATEMENT
GENERAL
The Pendergast's have bought property which fronts on the Inner Bay located off Pirate's
Cove in West Harbor on the north shore of Fishers Island. It is their desire to have a fixed pier
and float at which they can dock their motor boat. The site is situated between the property of
Mr. J. Lester Parsons and Mr. Steven Malinowski on the south shore of Inner Bay. Mr.
Malinowski operates a shellfish aquaculture facility which is dependent on clean water for the
health of the shellfish. Mr. Parsons owns a small docking system for recreational boating
immediately west of the Pendergast property. Clockwise around the Inner Bay, other properties
are owned by John Ski, Ronald Zanghetti and Paul Tombari. On the north side of the entrance
to the Inner Bay is property of BD Remodeling.
BASIS OF DESIGN
Mr. Pendergast is handicapped and utilizes a motorized wheelchair for mobility. The
dock system for the Pendergast usage was originally to consist of a fixeq pier, sloping down
gently from a 7-foot elevation at its beginning, to a S-foot pier elevation at the end, followed by a
hinged ramp to a float.
After considerable discussion with Mr. Malinowski, the pier was aligned so as to parallel
the Malinowski dock and provide access to the deepest water possible (at lease 4 feet deep in
accordance with NYS DEC policies) within reasonable length of shore from Mr. Pendergast's
shoreline. In an effort to avoid as much bottom scour with its resulting turbidity, the end of the
float was kept at a point where the deepest water was accessed. Water of a depth of S feet was
measured in this area during bottom probing, The float position was on the line between the
outennost extent ofMr. Malinowski's dock and Mr. Parson's dock.
Mr. Malinowski called as a result of the draft dock concept plans and requested that the
float system be re-aligned slightly to the west so that the bottom turbidity issues would be
minimized. This modification was made and drawings were issued to Mr. Malinowski and Mr.
Parsons. Mr. Malinowski raised four other concerns: dealing with construction timing,
containment of saw dust, avoidance of solvents and minimum power maneuvering, all of which
will be accommodated by Mr. Pendergast.

Mr. Parson's response to the drawing indicated a significant objection to the amount of
encroachment of the pier and float; that it would adversely affect access to his dock and use of
the "Inner Bay" as a hurricane haven. Accordingly, the float and associated tie-off piles have
been moved shoreward 15 feet and the northwesterly tie-off piles on the south slip have been
removed. Additional field work has been doneto assure that this configuration will not interfere
with the range line Mr. Parson's has established for access to his slip to avoid navigational
conflicts. Mr. Pendergast is also not adverse to people securing their boats to his piles during
hurricanes.
In addition, in order to maXimIze compliance with ADA standards for handicapped
access, the pier has been shortened 20 feet and a longer hinged ramp of 40 feet is to be installed.
Because of the weight of the ramp, we have made the float a 24-foot length and landed the ramp
near the middle of the float. The tie-off piles have not changed their location as a result of the
longer float. This configuration however, will allow Mr. Pendergast ride down the ramp and
access the northerly edge of the float from which he can immediately board over the cockpit
gunwale into his boat. This boat will be tied bow in (to the south) to allow for this access
method and in order to keep the propeller in the deepest water possible to remain sensitive to Mr.
Malinowski's concerns about turbidity and water quality.
The pier will span the tidal wetlands fringe at the shore with a beginning deck elevation
of 7 feet to allow adequate sunlight exposure during the morning and afternoon to the grounds
beneath the deck. Wetlands along the fringe of the Inner Bay were marked by a certified soil
scientist using US Army Corps of Engineers standards to provide the most accurate data for
compliance with standards. The end of the pier remains at elevation 5 and the ramping section
slopes at 1 foot vertically to 12 feet horizontally, in accordance with ADA standards. Mr.
Pendergast has agreed that the hinged ramp will exceed this 12:1 slope when the tide is at the
low end of its cycle but feels that this is acceptable for his use and approves of the design.
Accordingly, known concerns over this project have been accommodated and a safe
docking facility can be built at this site for recreational boating in accordance with existing laws,
regulations, design criteria and standards for approval without impeding navigation or public
access to public trust lands and waters. The revised application drawings have been issued to
Mr, Malinowski and Mr. Parsons so that they have an opportunity to comment on this modified
approach.

Dear Mr. Neilson,
Thank you for your letter of October IS, 2002 and revised plans. While you
clearly intend to maximize Mr. Pendergast's dock, your changes are helpful and I have
less objection than I did. This is not to say I approve a dock of this size, but assuming this
is your final proposal I will not actively oppose it. I leave it to the Trustees and Army
Engineers to decide the appropriateness of this structure.
I must say I am concerned by the statements about Mr. Pendergast's disability.
Building the proposed dock to suit his access needs is fine, but the landward end of this
project is at the foot of a very steep hill. The house is at about the 40-foot elevation and
no more than 100 feet inland. There is no way a motorized wheelchair can climb the hill.
Carving the hill into a series of ramps of l2-to-l or less grade would be difficult if even
possible and would certainly be unsightly. Constructing a tramway of some sort might be
possible, but the result would also be unsightly and disruptive to the environment.
I question whether the application should be considered unless the Trustees are
also told what the plans are for providing a means for Mr. Pendergast to travel between
the house and the dock. As it is, the application is silent about a matter that may involve
considerable construction and that is essential to provide the intended use of the dock.
Sympathetic as I am to everyone's desire to keep his boat at home and to Mr.
Pendergast's special needs, it would be far easier, cheaper and less disruptive to the cove

We have reviewed your letter regarding the proposed pier for Mr. Joseph Pendergast in
the Inner Bay off Pirate's Cove and have made several modifications to the pier as previously
discussed and transmitted to you by fax. We have moved the pier and float system 15 feet closer
to shore to make sure that your navigation line is not impeded and we have talked with Mr.
Pendergast about boats tying up to his piles during use of the Inner Bay as a hurricane haven, Mr
Pendergast is glad to be of assistance in those types of circumstances.
These revised drawings have been submitted to the Town as part of the official
application for Mr. Pendergast. I trust that you will find these revisions acceptable and that they
adequately deal with your concerns over boating in the Inner Bay.

Dear Sir,
I have reviewed the application of Mr. Joseph Pendergast, to construct a dock adjacent to
our property in West Harbor, Fishers Island, NY. As I have discussed with Mr.
Pendergast, we have no objection to the proposed dock. However, since we operate a
shellfish aquaculture business trom our dock and the boat Mr. Pendergast plans to berth
at this dock is considerably larger than any of the other boats berthed in the Cove, I do
have several concerns.
Our aquacuhure business has been our sole source of income for the last 20 years, We
operate both a shellfish hatchery and extensive nursery systems. Our hatchery cultivates
microscopic larvae, the most sensitive stage of the life history, and operates trom January
through July. The hatchery draws approximately 1000 gallons of the Cove water per day
during operations. This water is filtered with a I micron bag filter. On our dock we have
land based upwellers which are flow through nursery systems utilizing about 100 gallons
of Cove water per minute, and in the water attached to our dock are 4 large FLUPSY
nursery systems that flow approximately 3000 gallons per minute. Our livelihood,
therefore, is intimately dependent upon the maintenance of excellent water quality in the
Cove and my concerns all reflect this issue of water quality.
Our Cove is very small and activities at any of the docks or on any of the properties in the
Cove could potentially affect the water quality of the entire Cove. My primary water
quality concerns associated with this project are:
1. The construction of the dock will cause a significant amount of turbidity in the
small cove which could be a significant problem for our hatchery operations. We
have larvae in the hatchery trom the beginning of February until the end of July.
Potential impacts to our hatchery associated with dock construction could be
significantly reduced if construction occurred outside this time trame.
2. Floating sawdust fÌ'Om CCA treated lumber that ends up along the tide line in the
Cove could cause a long tenn, chronic problem. Shellfish larvae are extremely
sensitive to copper. When we built our dock we cut and trimmed lumber at a
cutting station and removed all sawdust trom the site. I understand fÌ'Om Mr.
Neilson of Docko, Inc. that there may be alternative, environmentally sound,
materials. If these other more environmentally sound alternatives are more

expensive, we would be willing to discuss the possibility of making a contribution
to help deftay the increased costs of materials.
3. Cleaners and solvents normally used in the routine maintenance of large pleasure
boats can be extremely toxic to young shellfish and the food they eat
(phytoplankton). This boat will be approximately 40 feet &om the nursery
systems attached to our dock. Minimizing the use of these materials while the
boat is at the dock would minimize the impact of this new dock on the water
quality of the Cove.
4. The bottom sediments of most of this small cove are fine sihs that are
mayonnaise-like in consistently. The propeller of such a large boat will
undoubtedly create turbidity throughout the entire cove. I believe this impact
could be minimized if care is taken to use minimum power in the Cove.
We live on a beautiful little cove and I sincerely believe that maintaining high standards
of water quality is not just important to our business, but in everyone's best interest. I do
not believe that any of my concerns resuh in any overly restrictive suggestions associated

Ladies and Gentlemen:
As to the above named permit, my brother and I are owners of tax map #47388910,-10-2
on the Gloaming, Our property is directly across the cove from Mr. Pendergasts property. the cove
is already overdeveloped. Each property owner should have access to the water from his property
but not so to overwhelm the entire cove. The Pendergast project would affect all property owners in
the cove, the area is just to small for so large a dock with tie off piles. This is a small sheltered
cove, not a Marina.
Furthermore, I was under the impression that all involve neighbors should have been
notified about this project, we were not. Although we are not direct neighbors, construction of this
magnitude would definitely affect my property in an adverse way.

Ladies and Gentlemen:
Although I hate to be a bad neighbor, I must object to the request of the
Pendergasts for a permit for a 95-foot dock and tie-off piles next to my property on an
(apparently unnamed) cove off West Harbor, Fishers Island, NY. I own the property
immediately west of the Pendergasts, with a dock, as shown on Pendergast-3.dwg
submitted by Docko, Inc. in support of the application. I should note that note 6 of
Pendergast-l.dwg incorrectly places me to the east of Pendergast and Malinowski to the
west. The drawings themselves place us correctly.
I concede the Malinowski dock is about as long as the proposed Pendergast dock.
I was not party to the Malinowski permit process and doubt I would have consented to
the Malinowski dock being as long as it is, but the Malinowski dock is much less
intrusive than the proposed Pendergast dock. It is in shallower water near the mouth of
the cove, angles so as almost to parallel the shore east of it, and in spite of its length is no
obstacle to navigation by others, since there are rocks northeast of it that require all traffic
to and from the cove to pass well north of its northern end.
Malinowski uses his dock in business and apparently needs its full surface area to
rinse and dry the oysters he raises for market. No reason appears why tht> Pendergasts
cannot use a much shorter dock, about the length of ours, extending only to the depth of
three feet below mean low water as does the Malinowski dock and all other docks in the
cove. If the Pendergasts have a larger boat, they should keep it at the marina.
Entrance to and exit from the cove by boat requires close attention to mostly-
submerged rocks northeast of Malinowski's dock and near the end of the road named
"The Gloaming" as depicted on Pendergast-l.dwg. As an aid to myself and others, some
years ago, and long before this application, I posted on my dock a day range, consisting
of a yellow triangle on a piling and a yellow stick on a piling 10 feet behind it. By
keeping the stick in line with the triangle, one can navigate in and out with safety. The
trustees are welcome to examine the site, and I am no artist, but I believe the safe course
marked by the range runs approximately (references are to Pendergast-l.dwg) from the
center of the letter "0" in "PROJECT" to the center of the 'T' in "NIF PROPERTY OF

PARSONS" and passes extremely close to the proposed Pendergast dock. It looks like it
may well pass south of some of the proposed tie-off piles. Consequently, a dock of this
size with tie-off piles will prevent use of the range and be a hazard to anyone navigating
to or from the cove. Far worse if a boat is tied to the dock and part of it protrudes north to
or beyond the piles.
Plus, I see no reason why I should have to detour around the proposed dock. It is
twice as long as it needs to be to serve the types of boats everyone else in the cove (six
existing docks, not counting those at the entrance) keeps and uses.
Finally, although I am told casual anchorage in the cove is prohibited under the
Harbor Management Plan, this cove provides excellent protection in hurricanes. When a
storm threatens, small boats often tie to or near our docks, and larger boats anchor and
raft in the middle ofthe cove. Since the Pendergasts propose to take over the deepest
water and much of the center of the cove for their private use, this will no longer be
possible, There will no longer be swing room for boats drawing 4 feet as there is now.
I have no problem at all with the Pendergasts having a dock. I used to keep a 28'
Bertram at my dock and have no doubt they could do likewise with a 55' dock with tie-
off piles in line with the outboard end of that dock. The proposed 95' dock, plus IO extra
feet of extension into the center of the cove for tie-off piles, is far more than needed,
compatible with the other docks pointing into the cove center or reasonable. I understand
that a longer dock would permit keeping a larger boat without grounding or churning up
the bottom-so would it for us all. The answer to that is to keep a smaller boat.
I respectfully request that this application be denied. I further request notice of
any hearings on this application so that I may arrange to be present.

After discussions with Mr. Pendergast's neighbors, J. Lester Parsons and Steven Malinowski, we
shortened the pier and dock encroachment, changed to a larger, more suitable hinged ramp and changed
the tie-off pile configuration so as not to hinder other operations in this cove and yet provide maximum
handicapped access and usability for Mr. Pendergast. In order to avoid adverse impacts to Mr.
Malinowski's aquaculture operation, we respectfully request your most expedient review of this
application so that construction of the permitted facility can be completed prior to February I, 2003.

REGARD 2a & b, THE PROPOSED FIXED DOCK, RAMP AND FLOAT WILL BE LOCATED ON THE WATERFRONT
AND IS LOCATED WITHIN THE FEDERAL FLOOD ZONE ON THE STATE JURISDICTION FOR TIDAL WETLANDS
(LESS THAN 6' DEPTH). THE SITE IS SUBJECT TO COASTAL FLOODING BECAUSE OF ITS LOCATION ON WEST
HARBOR IN FISHERS ISLAND SOUND, NYS WATER QUALITY CERTIFICATION IS REQUIRED FOR THIS
PROJECT BY THE CLEAN WATER ACT.
THIS CONSTRUCTION REPRESENTS NO SIGNIFICANT CHANGE OR SIGNIFICANT EVIRONMENTAL
IMPACT AND WILL NOT CAUSE ANY DETERIORATION TO SENSITIVE ENVIRONMENTAL FEATURES, WATER
FLOW AND CIRCULATION; IT IS CONSISTENT WITH PROGRMS FOR PROTECTION OF WATERS, TIDAL

Dear Mr. Malinowski:
Several weeks ago we had a chance to talk with you about the proposed pier and float for
Mr. Pendergast, your neighbor to the west in the Inner Bay off Pirate's Cove. We have re-
aligned the dock structure and after two brief discussions with J. Lester Parsons, we have made
further revisions. We have shortened the pier by approximately IS feet, put on a longer ramp to
ease access by Mr. Pendergast who utilizes a wheelchair, and yet maintained access to the water
as deep as possible in accordance with DEC standards (4 foot minimum to avoid future dredging
potential). We have also deleted some of the tie-off piles at the northwesterly end of the dock
configuration to assure that Mr. Parsons' range line for navigation to his dock would not be
obstructed.
I trust that you will find these modifications acceptable. We realize that your initial
concerns on the project, remain; that you'd like to have construction completed to January 31,
2003, you'd like to use materials that do not have CCA treated wood, if possible, or at least
contained and collect any CCA sawdust and debris so that copper leaching into the Inner Bay
waters is minimized or completely eliminated, that you would encourage Mr. Pendergast to use
low-power settings for berthing maneuvering and no solvents would be used on the boat. Mr.
Pendergast is agreeable to all of these and we are urging the pennitting agencies to review these
documents for approval as quickly as possible to allow construction in January.
We wish to thank you for your input into this project and would encourage you to review
these drawings and correspond further with the Town if you feel so inclined.
