Following up on our meeting last night we have revised the application drawings for
Barbara Hoch to include partial reconstruction of her seawall at her home on Hedge Street on
Fishers Island, and then re-facing the seawall with a concrete cap and steel sheet pile toe,
administratively approved at last night's meeting. ~I t~'ust that you will find these drawings
acceptable as they depict current conditions and the approved configuration shown in the DEC
permit as well. We have sent copies of the revised drawings to Ms Darlene Gerbino at the NYS
DEC and to Mr. Russell Smith at the US ACOE office in New York so that all of the permits
will be consistent. Your assistance last night was greatly appreciated.

Dear Ms Gerbino:
This letter will confirm terms of our conversation early in January regarding the
rehabilitation and new facing to be installed on the mortared stone seawall at property of Barbara
Hoch on Hedge Street on Fishers Island. I delayed in sending this letter because I was to have
been on the January 2006 docket at the Town of Southold but was postponed until last night at
which time this project was approved by the Board of Trustees.
The scope of work and modified project description are attached. In addition, we have
clarified the drawings to show the extent of wall to be repaired temporarily this spring until the
new concrete facing can be installed later this summer. The boulder will be temporarily
relocated under the pier in fi-ont of Mrs. Hoch's property and later returned to its existing
location a~er completion of the wall repair work.
I trust that all of this satisfies your program requirements and look forward to the
requested permit. By copy of this letter I am also confirming to the Town of Southold, Board of
Trustees and the US Army Corps of Engineers the modified scope of work on this project. Your
assistance is greatly appreciated.

Dear Ms Gerbino:
We are in receipt of your letter dated June 30, 2006 and transmit herewith drawings for
the modification of Permit No. 1-4738-00587/00003 in accordance with your stated concerns.
We have addressed them as follows:
The site plan view has been modified to show the excavated depth of sediments
immediately in front of the existing wall to accommodate the new footing for the
seawall to be rebuilt and the new facing on the south half of the seawall.
Material excavated will be temporarily stockpiled on Ms Hoch's property
immediately in front of the brick wall, back a distance of approximately 15 feet from
the face of the seawall so as not to impose a load burden on the weakened structure.
A~er completion of the work, this material will be used as backfill along the back of
the new seawall at the north end where so much material has been lost.
The existing stone will be moved by hand or machine (barge mounted crane with
clamshell bucket) into an area clear of the trench excavation at approximately the
apparent low water line during constxuction, then it will be re-s¢$ by hand or machine
only as necessary upon completion of the wall reconstruction activities.
The new wall profile shows the thicknesses of the structure to be built. The seawall
at the north end which must be completely rebuilt will be 1 to 2 feet thick, nqTlinally
18 inches. The facing on the south half of the seoxyall will be a foot or less in
thickness. Both concrete structures will be reinforced with steel. R is our desire to
have the foundation of the seawall a couple of feet, or three feet at the most, below
mean low water to assure that the structure retailas stability and integrity even if
storm-driven waves occur at low tide.

excavation which will vary due to the stony nature of the shorefront but should be.in
general 3 feet, and in any case, less than 5 feet in width.
)~ The drawings have been revised to show that the reeonstructi0n at the north end of
the property will not go onto the Brown's property; the rebuilt seawall will stay on
property of Barbara Hoch. We will obtain permission from the Brown's to
temporarily remove stone from their property while the wall is being rebuilt and then
replace the stone upon completion of the seawall. The new face of the wall at the
north end will be on the property line. i
I trust that you find all of these responses acceptable so that this permit amendment can
be processed. Dr. Hoch wishes to begin construction on September 7, 2006 so as to have this
wall completed prior to seasonal hurricanes. Your efforts to help us move this along would be
greatly appreciated. We are simultaneously transmitting these same documents to the US Army
Corps of Engineers, the New York Department of State and the Town of Southold which has
already given us verbal approval as a minor amendment to their permit. Please give me a call if
the need for any further discussion arises.

Following up on our conversation last week we have been advised by the contractor for Barbara
Hoch, Hedge Street, Fishers Island, that sheet piling cannot be driven in accordance with our earlier
permit modifications for the seawall reconstruction part of her project on West Harbor. As a result, the
contractors have reconvened at Ms Hoch's property and decided that the best way to pursue this project is
to establish a concrete foundation in the bottom sediments immediately in front of her wall. In order to do
this, they will have to dig the trench utilizing a clamshell bucket and pick up rock and sand from the
bottom sediments immediately in front of her existing seawall out to a distance of approximately 3 feet
and at a depth of approximately 3 feet. This same technique will have to be utilized along her entire
property frontage to expose enough area to pour a foundation footing to which the concrete form work
can be anchored. The form work will then be attached and tied back into the existing wall. Then, the 1-
foot thick reinforced concrete facing will be poured along the seaward side of the existing deteriorated
stone and mortar seawall as originally proposed and covered under existing permits (NYS DEC, Town of
Southold and US ACOE). We respectfully request a permit modification to allow this altered scope of
work. Attached are revised permit drawings depicted the proposed construction methodology.
Time is of the essence for this project. Ms Hoch is desperately trying to get this work done
before her wall collapses and before the next rash of hurricanes or nor'easters. We have coordinated this
project with Mr. Jim King of the Town of Southold, Board of Trustees and he has authorized us to
proceed since the work is substantially in accordance with the previous permit issued by the Town as well
as authorizations from the State and Federal governments (US ACOE). I trust that you will find this
request acceptable and complete. If you have any questions please do not hesitate to give me a call. If
I'm not in the office, please leave a detailed message with Joan McLaughlin and I will catch up to you as
quickly as possible. Your assistance as always is appreciated. I'm sorry that this project has been so

I appreciated the opportunity to speak with you yesterday. Atter our conversation I
went back and looked through the application documents and in particular, the permit drawings
that accompany the above referenced permit for Barbara Hoch on Hedge Street on Fishers
Island. The project description that we had offered was to rebuild 45 feet of mortared stone
seawall (the north half) and install the steel sheet pile scour protection and pour a new concrete
seawall face of approximate 35 CY over a footprint of I00 SF waterward of the existing
seawall. The scope of work that I mentioned to you yesterday is therefore fully covered under
the scope of work we requested and was permitted both by your office and the Town of
Southold. It appears that no further modification is required and work will begin within a
couple of weeks. Please consider this letter the required work start notice. Your assistance is
greatly appreciated. We anticipate beginning work in the immediate future.

Dear Mr. Krupski:
In our most recent correspondence with the NYS DEC we were advised to prepare
amended pcmsit application drawings for the wall repair outlined by your recent resolution.
During the course of that process I went back to the site with the potential contract and re-
analyzed the wall for a simpler reconstruction approach. There are many fine cracks in the
grout of the stone wall across the entire width of the property. It is felt that perhaps the easiest
and least environmental impact for reconstruction will be achieved through the construction of
a concrete wall on the face of the existing stone. This will require driving short steel sheet pile
as a kneewall for toe stability of the new concrete and then pouring a concrete face
approximately 12 inches thick, with suitable reinforcement, in front of the stone wall; thus
concealing and protecting the stone wall from further deterioration.
In order to do this, one boulder would have to be removed, at least temporarily, from the
northerly side of Barbara Hoch's dock. The DEC seems to believe that this will be permittable.
As a result of this further project modification it appears that we will need an
amendment to the existing Town permit for Barbara Hoch to build the concrete wall as
indicated in the attached drawings. These drawings have also been sent to the DEC for their
processing as a permit amendment and will be sent to the U. S. Army Corps of Engineers
immediately upon an indication from the Town that this modification to the scope of work can
be processed as an amendment. It would be greatly appreciated if you would give me a call and
let me know how the Town would like to proceed in this regard. Your assistance as always is
greatly appreciated.

We are pleased to transmit herewith the drawings for Ms Barbara Hoch at Hedge Street,
fronting West Harbor on Fishers Island. This project has been delayed while waiting for re-
issuance of the US ACOE permit which was received earlier this spring. The wall has
deteriorated to the point that reconstruction of the north half of the wall is required as a
minimum and it may be better to just install a steel sheet pile kneewall at the base of the
existing stone wall and pour a new concrete seawall in front of the existing structure. New, fine
cracks have been noticed in much of the wall which leads me to believe that piecemeal
reconstruction may actually have more adverse and long-term impacts and require more
frequent rehabilitation than a new concrete face. We have covered both options in this
application indicating the scope of work including the relocation of a boulder north of the
existing pier in about two feet of water which will be necessary in order to access the wall from
a barge to drive the sheeting. The boulder can be placed on the shallow intertidal zone adjacent
to the wall upon completion of the work or it can be replaced in its current' location if you
would prefer. We respectfully request a permit amendment to allow this scope of work

Seawall Reconstruction
This past spring in May, the US Army Corps issued the last of the three requested permits
for the repair of the seawall at propen'y of Barbara Hoch and her fzmily on Hedge Street on
Fishers Island. Upon examining the wall prior to the start of repair work last month, it was
discovered that tbero was significant, furthar deterioration of the wall from the pier, north (north
half of~the wall) since the application was first filed. Tenants have finally vacated the property
alloWing Ms Hoch to move forward with the work however, now it is appar:mt that the upper
part of the wall should be chipped out in order to allow the lower section to be re-built correctly.
In speaking with Ms Heather Cusack and Ms Lauren Standish of the Trustees' office, it
was felt that I should request an amendment to the existing permit in order to ldlow this work to
proceed this fall; this letter is Ms Hoch's request for that amendment. I have notated our
previous application drawings, adding shading to the area that will be affected.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 18, 2004 regarding the above matter:
WHEREAS, Docko, Inc. on behalf of BARBARA HOCH applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated July 6, 2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 18, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the
application of BARBARA HOCH to replace 12 pier support piles with new 12 "Butt piles
and repair sections of stone and concrete seawall, 2(+/-) CY of concrete and stone over
50 (+/-) SF, and install a 6' x 20' float including 2 restraint piles all at or water ward of
the apparent high water line, with the condition that the intertidal area will be cleaned up
of the concrete rubble and the dead plant debris which is in the water, and after the
work is complete an area of Spartina alterniflora marsh (Saltwater Cordgrass) will be
planted, similar to what is to the northwest of the pier in front of the neighbor's land, and
all as depicted on the plan prepared by Keith Neilson last dated June 22, 2004, and the
updated plans showing the float received in our office on September 8, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Tuesday,
August 10, 2004, the following recommendation was made:
BARBARA HOCH to replace 12 pier support piles and repair sections of stone and
concrete seawall, 2 (+/-) cy. of concrete and stone over 50 (+/-) sf. waterward of the
apparent high water line.
The CAC did not make an inspection, therefore no recommendation was made.
NARRATIVE STATEMENT &
SUPPLEMENTAL INFORMATION

BARBARA HOCH
WEST HARBOR, FISHERS ISLAND, NY
JULY 1, 2004
GENERAL
The Hoch property is located at the far south end of West Harbor on Fishers Island. The
exposure is to the north and the site is subject to occasional waves and flooding conditions
depending on weather conditions and wind direction. The Hoch's property is a relatively small
lot with a vertical grouted stone seawall at the shoreline. This structure has been long-standing
and has been reviewed during previous permit applications for dock construction and
reconstruction.
At this time, the seawall is suffering from deterioration at its base involving the loss of
concrete and stone. Repairs must be implemented immediately in order to preserve the structural
integrity of the wall. In addition, approximately half of the piles supporting the wood pier are in
need of replacement. The attached narrative substantiates the scope of work and provides
responses to various concerns outlined in Local Law No. 6 2004, relating to new Chapter 97
"Wetlands and Shoreline" of the Code of the Town of Southold
SEAWALL REPAIR
This project involves the localized repair and rehabilitation of the seawall as
demonstrated in the photographs attached and permit application drawings. This represents in
kind, in place replacement of a functional bulkhead or seawall in accordance with Sub-section B
(la). It is strongly suggested that the same materials be utilized for this repair since alteration of
materials would require an alteration of the structure itself, and perhaps major reconstruction.
This new material will not result in the structure being moved seaward of adjacent neighboring
structures, or even a significant change in the face of the structure. Stone currently lines the
bottom of the existing seawall and will be retained in that position.
There is a drop of about five feet from the Hoch's yard to the highest point of the bottom
sediments along the shore at the toe of the seawall. If the seawall were to fail or not be repaired,
excessive erosion could result. The localized repairs and extent of work does not appear to
require machine excavation. It is anticipated that work will be done by hand although materials
will be delivered to the site by truck or barge.
