Trustees Dear Ms Tetrault: Please find enclosed the executed and sworn application for an administrative ~nder the Coastal Erosion Hazard Area Law and, if applicable, the '~Vetlands La~.r ot the To~vn of Southold to install a split-rail fence along the northerly boundary of the above-&scribed lot fi.om the top of the bluffto Isabella Beach Road, as indicated on the survey submitted to you earlier. As requested, I also enclose several photographs of the site of the fence, on ~vhich we have enhanced with red pen the boundary stakes placed recently by the surveyor when he surveyed the adjacent lot. The lot was originally acquired in 1986 in my name; in February 2003 [ transferred the property to Mrs. Bryan and myself as Tenants-in-Common; and in June 2004 each of us transferred his or her undivided 50% interest to a qualified personal residence trust of which the transferor acts as trustee. I believe that the 2003 transfers have been recorded in the Suffolk County land records, but I do not know the recording status of the 2004 transfers to the trusts. Hence, I have made the application in the name of each of us individually and as trustee. Please submit this application for consideration by the Trustees at their next meeting, which I understand will be held next week. Box 197 Fishers Island, NY 06390 Re: MARGARET BRYAN PRIVATE RD, FISHERS ISLAND SCTM# 10-6-12.4 Dear Mr. Bryan: The Trustees are in receipt of your request for waiver of a permit to build a fence on the above referenced property line. The Trustees no longer issue waivers but they do issue letters of No Jurisdiction if the project is beyond the 100' jurisdiction from the high tide mark and behind the coastal erosion line. According to the line drawn on the survey that was sent here and received on October 1,2004 the fence will be in the Coastal Erosion area and will require a permit from this office. If you erect the fence along the property line behind the coastal erosion line and beyond our 100' from the high tide mark, you will not need a permit. The fence will need to start 40' back from the bluff, according to the location of the coastal erosion line on the survey submitted to us. Please call our office with any questions.
