At the meeting of the Southold Town Conservation Advisory Council held Thursday, April 15,
1999 the follox~ing recommendation was made:
MARGARET BRYAN 10-6-12.4 requests a Waiver to install a split-rail fence along westerly
property line including a portion within 25 ft. of bluff line and to remove encroaching deck and
boardwalk build by neighbors at edge of bluff.

The CAC did not make an inspection, therefore no recommendation was made.

Dear Sirs:
This will refer to the application for waiver of permit to install a
split rail fence and remove an encroaching deck and boardwalk from the above
lot, which Mrs. Bryan filed with the Trustees on April 1, 1999 and is on the
agenda for the Trustees' meeting on April 21, 1999.
On April 5, 1999, after inspecting the deck and boardwalk, the
Southold Building Department issued an order against Mrs. Bryan (but not
against her neighbors the Porters, who built the deck and boardwalk) to cure
the violations of the Town Zoning and Building Codes by removing the deck.
In view of this order and the continued refusal of the Porters to respond to the
Trustees request on September 9. 1999 to cure their violation of the Coastal
Erosion Hazard Area Law, Mrs. Bryan hopes that the Trustees will grant her
request for waiver of the permit to remove the deck at its meeting next
Wednesday.
However, in the event that the Trustees conclude that a permit
is necessary for removal of the entire deck, Mrs. Bryan requests that the permit
be waived with respect to removal of the superstructure of the deck and board-
walk, leaving in place the supporting pilings, which are the environmentally
sensitive portions of the structure. This limited waiver of the permit would
allow her to proceed with the fencing project and accelerate full compliance
with the Coastal Erosion Hazard Area Law. Mrs. Bryan would then file an

application for a permit to remove the rest of the deck (i.e., the pilings) at the
next meeting of the Trustees, since she does not believe that the Porters will
ever take any action until compelled to do so by order of the Trustees.

Application for a permit to install a fence along the western property line, including a portion within 25
feet of the bluff line.
I am a property owner to the west of the Marsh which borders the Mullen property. The bluff is within
full view of my house which I have owned since 1968 and is part of our scenery. Fences between
properties are not traditional at Fishers, since we prefer the open look. I especially find a fence on the
bluff visually offensive and would prefer that the vadance not be granted. It would be a symbol of
creeping suburbanization at Fishers which I think reduces the value of our properties.
The reason for the fence would seem to be the second point of the notice requesting the removal of
the deck and boardwalk -- a structure which I find charming rather than offensive. The neighbors,
Mullen and Bryan, apparently do not get along, and I do not believe that a fence will help matters,
despite some quotation to the effect that fences make for good neighbors. It would seem to me that the
fence will only make matters worse since it symbolizes their differences. We have a small island, we all
know one another, and I my hope is that we might be able to settle our differences without having to
bring in Town officials. That has not happened. If there has peen an environmental wrong in building
the lookout, that is unfortunate, though there are many similar structures on the edge of bluffs
throughout the island celebrating our wonderful views. I certainly see no point in committing another
environmental violation in building a fence on the bluff in order to counter the alleged pnor violation of
the lookout. Nor is it clear to me that tearing down the existing structure will necessarily improve the
environment -- it might actually harm it, but that is not for me to judge.
This is all so silly, embarrassing and a waste of the Trustees time. I do wish that these nice neighbors
of mine, both parties of whom are friends, could all share the deck and lookout and from time to time
invite me to join them for a drink at sunset time.
