Dear Mr. Neilson:
The Board of Town Trustees took lhe following action during its regular meeting held on
Wednesday, December 19,2001 regarding the above matter:
WHEREAS, Docko, Inc. on behalf of PIRATE'S COVE MARINA, INC. applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town
of South old, application dated September 20, 200l, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
December 19, 200 I, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of PIRATE'S COVE
MARINA, INC. to conduct maintenance dredging to restore a depth of 7' below mean low
water, removing 300+/- cy, of silty sandy bottom sediments over 4,000+/- sf. for upland disposal.
Permit will run concurrent with the permit issued by the DEe.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years rrom the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified upon completion of said project.

At the meeting of the Southold Town ConserVation Advisory Council held Monday,
October 15, 2001, the following recommendation was made:
PIRATE'S COVE MARINA, INC. to conduct maintenance dredging to restore a depth'of
7' below mean low water, removing 300 +/-cy. of silt and sandy bottom sediments over
4,000 +/-sf. for upland disposal. -
Located: Peninsula Rd., Fishers Island. SCTM#10-3-22
The CAC did not make an inspection, therefore no recommendation was made.

Following up on our conversations yesterday, we are submitting herewith revised Sheets
2 and 3 of the application drawings to show actual spot elevations or soundings in the area to be
dredged on the plan view as well as the profile. We have also added the apparent high water line
to the profiles as requested.

Dear Ms Gerbino:
We have received your notice of incomplete application for Pirate's Cove to pennit
maintenance dredging. In accordance with your letter we are pleased to attach the following:
· Five copies of the application drawings for your review.
· Photographs of Ihe dredge area and de-watering site on Pirate's Cove Marina's
parking lot.
· More detailed information about the apparent high water line (which typically follows
the bulkhead, but has been higWighted along the west side of the marina).
· A copy of the Town of South old Tax Map for this part of Fishers Island.
The county tax map was included in the original submission, It is No. 1000-010,
Town of South old and we have attached another copy for your reference.
· There was no wetlands boundary delineated because this is not a wetlands permit
request. It is only dredging and there are no wellands grasses anywhere in the area of
proposed dredging. We have now shown the wetlands on Sheet 2.
· The de-watering area has been shown and il is basically in lhe middle of the parking
lot right in ITont of the areas to be dredged.
· The de-watering areas have been shown in the profile for the straddle-lift hoist pier
and the area north of the exisling wood pier and floating dock.
· Dimensions of each dredge area have been added.
· Dredge material will be a fme, sandy materials and will not need physical
containment although ÌI will be surrounded by haybales to assure that it is not spread
over the site while de-watering,
I trust that you will find these modifications to lhe drawings resolve all of your concerns
and questions at this point. Please let us know if the need for any further informalion is required
and we will gladly accommodate you. The Pirate's Cove Marina would like to proceed with this
dredging immedialely in December so that the yard can be bank into shape for boat launching
late in March and April. Thank you.

The project will not adversely affect fish, shellfish, wildlife or sensitive
aquatic or intertidal veqetation. The dredqinq will not create an erosion

known as Inner Harbor, at the southerly end of West Harbor on Fishers

under Chapters 32, 37, or 97 of the Town Code is open to public
