RESOLVED, that the Southold Town Board of Trustees Approve an Amendment to Permit #5553 to change the proposed staircase wetland line from 55 feet to 49 feet from the freshwater wetland line. Box 1179 Souftm Torn Board of Trustees Southold, New York 11971 Re: Fowler House —Fishers Island, New York Dear Mr. Krupski: As we discussed on May 1, 2003, I would very much appreciate the Trustees assistance in getting the stop work order lifted on the project to remodel our house on Fishers Island at the next meeting of the Trustees,which I understand is scheduled for May 22, 2003. As I explained when we spoke, the NY DEC has approved the approximate 7' expansion of the porch toward the side yard setback which was in violation of our original permit. In discussing the situation with Art Foster on May 5, 2003, he indicated that he thought it would be fine if the Trustees gave instructions to the building department to lift the stop order subject to Art's inspection of the property and Trustees approval. As I mentioned in my message to you on May 5, 2003, Art did say that he would have to defer to you on this. Our goal would be to be allowed by the building department to proceed on the rest of the project, if not on the section of the porch in violation of our approvals, so we will be able to use the house this summer. As we are not allowed to paint the new siding and exterior portions of the house until the stop work order is lifted, we are very concerned about water damage to the exterior of the building that has been completed to date. Additionally, I am concerned about the 20 or more workers and contractors on the job that are temporarily out of work. For your information, Gary Fish of the building department has indicated to our contractor that he cannot review and approve the updated porch plans or lift the stop work order without a letter from the Trustees authorizing him to do so. As we discussed, I hope that Art Foster is able to inspect the property and file his report so that this matter can be voted upon at your meeting on May 22, 2003. In the meantime, Mr. Albert Krupski • • 5/7/2003 Page 2 of 2 if the Trustees could instruct the building department to allow the project to proceed "subject to"as Art suggested, that would be great. Of course, our concern, based on our experience with our dock permit, is that the Trustees may not be able to vote on this if an inspection is not completed and the inspection report submitted on a timely basis to the Trustees for the next meeting. As you know, our dock permit has been tabled four or five times since late last fall because of this. Again, I would respectfully request that the Trustees assist us by instructing the building department to allow the project to proceed and/or doing everything possible to make sure all the necessary inspections and other requirements are completed so this matter can be voted on, along with our dock permit, at the meeting on May 22, 2003. As I mentioned to you, my cousin Bob Evans would be willing to transport Art Foster to and from Fishers at his convenience—an approximately 30 minute trip each way. Bob makes this trip routinely to get his wife Louisa to town board meetings. With many thanks for your assistance in this matter.
