PO Box 421 Mystic, CT. 06355 RE: SCTM#9-3-1 Hay Harbor Club Bell Hill Avenue Fisher's Island, NY Dear Mr. NeilsC'n: The Board ofT,)wn Trustees took the following action during a Regular Meeting, held on May 21,2003 regarding the above matter WHEREAS, Docko, Ine. on behal[ of IIa)' Harbor Clllb applied to the Southold Town Trustees for a permit under the provisions ofthe Wetland Ordinance of the Town o[Southold, application dated October 9, 2002 WHEREAS, s"id application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Tmstees with respect to said application on May 21,2003 elt which time all interested persons were given an opportunity to be heard, and. WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS. the str1lcture complies with thp. standard set f(\r:1I in Chapter 97-18 o[the Southold Town Code. . . . . WHEREAS, the Board has detennined that the project as proposed will not affect the health, safety and general welfare of the people of the town. NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approved the application of Docko,lllc. on behalf of Hay Harbor Club for a Wetland Pennit at the diving area at the swimming dock filled in with sand !Tom gales from the west and northwest to be dredged 3 feet +/- dredged sand will be transported by barge over to the Mobil Dock in West Harbor and offloaded- trucked 'back to replenish the beach near the south dock used for upland fill purposes - landward oftheMHW line. BE IT FURTHER RESOLVED that this detennination should not be considered a detennination made for any other Department or Agency, which may also have an application pending for the same or similar project. Fee must be paid, if applicable and pennit issued within six months of the date of this notification. Inspections are required at a fee 01'$5,00 per inspection. (See attached schedule). Located: Bell Hill Ave., Fishers Island. SCTM#3-1-3 TRUSTEE FOSTER: There are no comments on this one. There is a swimming dock out there and it is very, very shallow. TRUSTEE DICKERSON: It says maintenance dredging. Has it been done before? TRUSTEE POLIWODA: Do they have a permit that says they dredged it? TRUSTEE FOSTER: I don't know. You kind of have to look at where it is and what it is. It's big place. They have a very, very, shallow, muddy kind of a beach, water thing, but the dock goes off to the right and its way out. It's kind of shallow. TRUSTEE POLIWODA: It's kind of hard to swim in those clam flats. TRUSTEE FOSTER: I don't know what's in there. TRUSTEE POLIWODA: How big of an area? TRUSTEE KRUPSKI: Take a look. They really did a nice job, The area is only here. TRUSTEE FOSTER: It's just one little area that they want to dredge. TRUSTEE KRUPSKI: Has it ever been dredged and is there eelgrass in the area? We're going to have to ask, we need a report on the shellfish resources and eelgrass in the area. SCTM#9-3-9 TRUSTEE KRUPSKI: Is there anyone here for or against the application. They want to relocate it seaward. TRUSTEE POLIWODA: I can't agree with this. This is a residential lot right? TRUSTEE KRUPSKI: Yes, They want to go out that much more. They have seven new pilings they want to put in. I have a problem with the tie- off piles. TRUSTEE POLIWODA: I don't like the tie-off piles either because they monopolize the bottom, Once they're in, they're in, and it's a residential lot. If they need a tie-off pile, they can just throw an anchor. TRUSTEE KRUPSKI: I don't have a problem with one tie off pile. TRUSTEE POLIWODA: Right. One pile to accommodate the boat is fine. It's usually on the inshore side of their float. (talking, inaudible) TRUSTEE KRUPSKI: I know what you're saying. Peggy is questioning the need to go out further too.
