Dear Ms. Beard:
The Southold Town Board of Trustees reviewed the site plan prepared by Richard H.
Strouse dated June 25, 2004 and determined the proposed single-family dwelling to be
out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and
Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Board of Town Trustees,
This letter is to request a pre-submission inspection of a lot on Fishers Island in order for the
Trustees to grant a letter of non-j urisdiction.
In order to assist, I have also enclosed two separate documents:
· Smwey last updated on 6/24/04, showing all work shall be more than i21' from the
marked edge of the wetlands. The survey was completed by Richard Strouse, a licensed
NYS Professional Engineer.
· A copy of a letter granted to Virginia Campbell on August 26, 1996 stating the Trustees
have no jurisdiction. Looks like her file number was SCTM #7-3-3.16.
For your reference, the location of the property is on Fishers Island on the south side of Barlow
Pond. The tax map ID is Tax Map 1000 Sect 007 Block 3 Lot 3.20.

The above referenced property was inspected. The proposed single
family dwelling, associated sahitary system with waterline,
telephone and electrical hookup, decking, driveway and guest
house with sanitary system, waterline, telephone and electrical
hookup. There shall be no construction located with 108' of the
freshwater wetlands line as per DEC and a 75' buffer area shall
be established, is out of the Trustees jurisdiction as per map
dated 7/24/96.
