Box 421 Mystic, CT 06355 RE: RICHARD BINGHAM Central Ave., Fishers Island SCTM#6-4-2 Dear Mr. Neilson: The Board of Town Trustees took the following action during its regular meeting held on Thursday, June 21,2001 regarding the above matter: WHEREAS, Docko, Inc. on behalf of RICHARD BINGHAM applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of South old, application dated May 25, 2001, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 21,2001, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southoll! Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 . . NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approve the application of RICHARD BINGHAM to remove 5+/- cy. of stone over an area of 300+/- sf. NYS DOS Environmental Questionnaire Richard Bingham Fishers Island, NY May 10,2001 Permit Attachment GENERAL: This project is for the removal and relocation of stone at the south end of the berthing slips for recreational boating. The stones are at a depth of 2' to 3' and constitute obstructions and potential sources of damage to the propeller and hull of the boat at low tide, especially in wavy conditions. It is anticipated that removal of5 (+/-) CY of stone nom an area of300 (+/-) SF and relocate the stone approximately 10 to 20 feet south in shallower subtidal waters. The stones are generally 1 to 2 cubit feet in size. In effect, this will merely be the relocation of existing bottom habitat. The names and addresses of adjacent property owners are listed on the application drawings. Photographs of the project site are included herein. In addition, we have enclosed copies of the Town of Southold, Board of Trustees, New York State Department of Environmental Conservation and U.S. Army Corps of Engineers Permit Applications which provide all of the environmental impact assessment statements that have been prepared for this project. There are no shorenont stabilization or erosion control measures proposed for this project. The existing shorenont consists of a rocky sandy shorenont with a steep sloping and eroding coastal bluff. The bluff has been protected with armor stone and boulders which naturally occur at this site or may have been added. The history of this protection is not known. COASTAL ASSESSMENT- 2a. State designated neshwater or tidal wetlands? (44) In accordance with the defmition of tidal wetlands extending down to a depth of approximately -6 feet at mean low water, this site and the scope of the project falls within this jurisdiction. The existing bottom habitat is sandy gravel with scattered boulders and large stones such as the ones to be relocated. This is a shallow subtidal area exposed to tremendous wave energy and seasonally, rock weed grows on many of the boulders and large stone. Much of this rock weed is decimated in stonns but has a tendency to re-grow on the rocks. It is anticipated that this feature will remain with these stones even after their relocation. 2b. Federally designated flood and/or state designated erosion hazard area? (11,12,17) This part of Fishers Island is exposed to direct wave attack nom northeasterly wind- induced waves. It is by all terms of the definition, a coastal erosion hazard area. 3a. Waternont site? (2,21,22) This project is to be conducted on a waternont site. The dock and berthing facilities span nom the shore through the intertidal zone to the shallow subtidal zone to provide adequate berthing facilities for the owner's recreational boating needs. . 3d. State water quality permit or certification? (30, 38, 40) . It is our belief that this project requires a state water quality permit or certification because it constitutes excavation of bottom sediments under the strictest definitions of the project. In effect, the work will have virtually no impact on water flow, circulation, sediment transport or tidal flushing in this area. There will be no increased turbidity or degradation of water quality as a result of the work except for minor disturbances during the actual construction process. This'process should take only one or two days at the most. Because of the site's open exposure, work will have to be done during periods of high tide and low wave to calm conditions in Fishers Island Sound. No. 1-4738-01599/00004 Revised Plans Dear Ms Farkas: Thank you for your letter of September 24, 2002, In accordance with your request for further information, we have added depths along the edge of the existing pier at 10-foot intervals and beyond, reference to the apparent low water elevation. We have also attached a copy of a location map of Fishers Island Sound which shows Mr. Bingham's dock and property and the area that is utilized for navigation which extends out about II.. of a mile off shore. There is no marked channel in this area however, the buoys off shore will delineate a traveiway which is approximately 150 yards offshore at the closest point to Bingham's dock extension. This would place the nearest proximity of the traveiway approximately 300 feet or more from the end of the pier. One copy of this map has been hi-lighted to show the travelway at its nearest point to Bingham's property. During our close examination of the site, we took extra care to mark two small areas of eel grass in close proximity to the end of the pier. The pier extension that we have requested will allow berthing of the boat on either slip, just beyond these two eel grass areas in water that will be deep enough that it will not threaten Mr. Bingham's boat with bottoming out during wavy sea conditions.
