Dear Mr. Ham:
The Southold Town Board of Trustees reviewed the survey prepared by Chandler,
Palmer & King dated September 14, 2002 and letter from J.M.O. Environmental
Consulting Services dated November 12, 2003 and determined the proposed additions
and alterations to the existing single-family dwelling to be out of the Wetland jurisdiction
under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.

However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

At the request of the above noted applicants I personally inspected t~is property earlier today.
The reason for this inspection was to determine whether or not there were any areas of regulated
wetlands located on or adjacent to the property. Prior to inspecting the site I reviewed a copy of
the New York State Freshwater Wetlands Map of Suffolk County Map 1 of 39 (copy enclosed).
In reviewing the N.Y.S.D.E.C. Freshwater Wetlands Map it is noted that there is an area of
freshwater wetlands (noted NL-5) located southeast of the applicant's property.
In inspecting the site it was noted that the area of freshwater wetlands is a small kettle hole
located at the intersection of Mannatauket Avenue and Central Avenue. The area of wetlands is
located entirely within the parcel of the property indicated upon the enclosed Suffolk County Tax
Map and identified as parcel number 1000-006-03.00-008.003.
As measured in the field earlier today and scaled offofthe enclosed Suffolk County Tax Map. it
is clear that the project, as well as the entire subject property is located in excess of greater than
150' from the limits of tbe existing area of regulated freshwater wetlands.
Given this it should be noted that under Article 24 of the New York State Environmental
Consetwation Law the N.Y.S.D.E.C. would have no jurisdiction over this project. The reason for
this is that under Article 24 the Department only has jurisdiction within that area located within
10ft (landward) of the freshwaters wetland line. As far as the Southold Town Trustees are
concerned, they too would have no jurisdiction over the project. The reason for this is that under
Chapter 97 (Wetlands ~ of the Southold Town Code, the Trustees only have jurisdiction within
100' of wetlands.

Dear Board Members:
I represent Laurence and Betty Ann Rubinow who own a house at Fishers
Island on a parcel bearing the Suffolk County Tax Map number 1000-006.00-03.00-
003.000. I have enclosed a survey map of the parcel showing existing structures.
At a recent hearing before the Town of Southold Board of Appeals
concerning my clients' property, Board member George Horning inquired about possible
wetlands on the property.
I had been advised by surveyor Richard Strouse that there are no officially
designated wetlands at this site and so advised the Board. However, the Zoning Board
has requested a letter from your Board confirming that there are no wetlands on the
property. Please provide me with such a letter or, if you determine that in fact wetlands
do exist on the property, kindly identify their location so that they can be reflected on the
survey.
